AN ORDINANCE AMENDING THE ZONING MAP TO REZONE
PROPERTY FOR YELLOW TREE CORPORATION LOCATED AT 7000 — 56T" AVENUE NORTH FROM
COMMERCIAL (C)
TO TOWN CENTER - PLANNED DEVELOPMENT (TC-PD)
THE CITY OF CRYSTAL ORDAINS:
Section 1. Legislative Findings. The City Council of the City of Crystal hereby finds and
determines as follows:
(a) Yellow Tree Corporation ("Applicant") has requested to rezone property it
proposes to purchase at 7000 — 56th Avenue North ("Property") to the town
center - planned development overlay district as provided in Crystal city
code, subsection 515.13; and
(b) The request would rezone the Property from Commercial (C) to Town Center
- Planned Development (TC-PD); and
(c) The rezoning request is to allow the Applicant to construct a five story, 174-
unit apartment building, which involves the approval of a site plan; and
(d) The Planning Commission held a public hearing on the rezoning request on
December 8, 2025 and voted to forward the requested rezoning to the City
Council with a recommendation that it be approved with certain conditions;
and
(e) The City Council determines the proposed rezoning of the Property complies
with the approval criteria in Crystal city code, subsection 510.31 and 515.13
and other applicable provisions.
Section 2. Rezoning. Subject to the conditions in Section 3 of this ordinance, the Zoning
Map of Crystal, Minnesota is hereby amended as follows:
The zoning classification of the following legally described property addressed as
7000 — 561h Avenue North, currently classified as Commercial (C), shall henceforth
be classified as Town Center — Planned Development (TC-PD), which is legally
described as:
Previous legal description:
Lot 1, Block 1, Crystal State Bank Addition, and Outlot A, Palmer Addition,
both in Hennepin County, Minnesota.
Pending legal description upon recording of consolidation plat:
Lot 1, Block 1, Crystal State Bank 3rd Addition, Hennepin County,
Minnesota.
Section 3. Site -Specific Regulations. The following additional regulations apply to the
Property:
Site Plan. The development shall be constructed according to the site
plan approved by and on file with the city and included as attachment H
to the City Council file. Prior to issuance of the building permit, the
applicant shall:
l . Provide documentation that the lot consolidation plat and the
resolution for the easement vacation have been recorded at
Hennepin County.
2. Receive approval from the Shingle Creek Watershed Commission of
the stormwater management plan.
3. Sign a site improvement agreement with the city and provide an
escrow to guarantee installation of the surface parking lot,
underground stormwater chamber, and landscaping plan.
4. Provide a maintenance agreement for city approval for the
stormwater infiltration facility which will be recorded against the
property.
5. Provide an updated site plan showing the location of electric vehicle
charging stations for approval by the city and WMFRD.
6. Provide an updated grading plan to demonstrate to the city's
satisfaction that vegetation in the drainage and utility easements will
not negatively impact drainage to and from neighboring properties.
7. Provide an approval letter from the Federal Aviation Administration
to the city.
2. Certificate of Occupancy. Prior to the issuance of the certificate of
occupancy for the building, the applicant shall:
a. Provide as -built utility and grading plans to the city.
b. Remove the mobile construction office from the property.
3. Overhead utilities. If utility lines are installed, relocated or extended, the
lines shall be buried underground. New private utilities, such as Xcel
Energy, Center Point Energy, or Comcast shall be buried underground.
4. Special provisions related to Town Center - Planned Development
rezoning. At this time, the rezoning to TC-PD implements the following
special provisions in place of the standard town center requirements.
Upon submittal of additional information as described in section D,
additional flexibility to the city's zoning requirements may be approved.
a. The front building setback along 56th Ave. N. is varied from 5' on the
west to 24' on the east.
b. The primary building street frontage requirement is reduced from
75% to 64% along 56th Avenue N.
c. The secondary building street frontage requirement is reduced from
50% to 47% along 57th Avenue N
d. Glazing on the south building elevation is reduced from 30% to 24%
of the fagade and from 30% to 20% on the north building elevation.
e. Balconies on the primary fagade are allowed to be stepped back
rather than flush or recessed.
f. A functional secondary entryway is not required on the primary
fagade.
g. The number of parking spaces is reduced from the required 348
spaces to 257 spaces.
Section 4. Zoning Map Amendment. The zoning administrator is authorized and directed to
amend the Zoning Map in accordance with this ordinance and to take any such
other actions as may be required to effectuate this rezoning.
Section 5. Effective Date. This ordinance shall not be codified into the Crystal city code and
is effective thirty (30) days following its passage and publication.

RESOLUTION APPROVING SUMMARY LANGUAGE
FOR PUBLICATION OF ORDINANCE NO. 2025-14
WHEREAS, the Crystal City Council adopted Ordinance No. 2025-14 "An Ordinance
Amending the Zoning Map to Rezone Property for Yellow Tree corporation located at 7000 — 56th
Avenue North from Commercial (C) to Town Center — Planned Development (TC-PD)"
("Ordinance") at its meeting held on January 6, 2026; and
WHEREAS, Section 3.12 of the Crystal City Charter and Section 110.13 of the Crystal City
Code indicate that ordinances approved by the City Council will be published in summary form
and that the City Council is to approve the form of the summary.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Crystal that the
following summary language is hereby approved for publication of the Ordinance:

SUMMARY OF ORDINANCE No. 2025-14
Ordinance No. 2025-14 was approved by the city council on January 6, 2026. A printed copy of
the full text of the ordinance is available for public inspection in the office of the city clerk and is
available on the city's website.
The ordinance rezones the property at 7000 — 56th Avenue North from Commercial to
Town Center - Planned Development. The ordinance makes various legislative findings,
amends the City's zoning map to reflect the new district, set out conditions, and directs
the zoning administrator to amend the zoning map. A copy of the full ordinance is
available on the City's website.
BE IT FINALLY RESOLVED, that the City Clerk is hereby authorized and directed to do each of
the following:
1. Publish the approved summary language once in the City's official newspaper;
2. Place a copy of this Resolution, the full text of the Ordinance, and the affidavit of publication of
the summary language in the City's ordinance book;
3. Make the full text of the Ordinance available for public inspection in the office of the City Clerk
during the City's regular business hours;
4. Incorporate the text of the Ordinance into the Crystal City Code; and
S. Post the updated Crystal City Code on the City's website.
