CITY OF CRYSTAL
AN ORDINANCE AMENDING THE TOWN CENTER - PLANNED DEVELOPMENT
(TC-PD) AT 5240 WEST BROADWAY AVENUE
THE CITY OF CRYSTAL ORDAINS:
Section 1. Legislative Findings. The City Council of the City of Crystal hereby finds and
determines as follows:
(a) Crystal Housing Group ("Applicant") previously applied to the City to rezone
their property located at 5240 West Broadway Avenue ("Property") to the
Town Center — Planned Development (TC-PD) zoning district as provided in
Crystal city code, subsection 515.13; and
(b) On September 6, 2022 the City Council adopted Ordinance No. 2022-05
("Approval Ordinance") approving the requested rezoning, which places
restrictions on the use of the Property; and
(c) The Applicant is now applying to amend the Approval Ordinance to expressly
allow it to construct a sport court with a chain -link fence on the Property; and
(d) The Planning Commission held a public hearing on the requested amendment
on May 13, 2024 and voted to forward the requested amendment to the City
Council with a recommendation that it be approved; and
(e) The City Council determines the proposed amendment to the Approval
Ordinance to allow a fenced sport court on the Property complies with the
approval criteria in Crystal city code, subsection 515.13 and other applicable
provisions.
Section 2. Special Provisions. The Approval Ordinance is hereby amended by adding the
double -underlined material as follows:
1. Special provisions related to Town Center - Planned Development
rezoning. The rezoning to TC-PD implements the following special
provisions in place of the standard town center requirements:
a. The number of enclosed parking spaces is reduced from 58 to 52
spaces.
b. The minimum glazing requirement is reduced from 50% to 33% for
the first floor and from 30% to 27% for the upper floors.
c. The minimum first floor height is reduced from 12' to 10'.
d. The building street frontage requirement is reduced from 75% to 69%.
e. The maximum front building setback is increased from 10' to 24'.
f. A snort court enclosed by a chain -link fence is allowed in the northeast
corner of the nronertv.
Section 3. Effective Date. This ordinance shall not be codified into the Crystal city code and
is effective in accordance with Crystal city code, subsection 110.11.

RESOLUTION APPROVING SUMMARY LANGUAGE
FOR PUBLICATION OF ORDINANCE NO.2024-03
WHEREAS, the Crystal City Council adopted Ordinance No. 2024-03 "An Ordinance
Amending the Town Center — Planned Development (TC-PD) at 5240 West Broadway" (the
"Ordinance") at its meeting held on June 4, 2024; and
WHEREAS, Section 3.12 of the Crystal City Charter and Section 110.13 of the Crystal
City Code indicate that ordinances approved by the City Council will be published in summary
form and that the City Council is to approve the form of the summary.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Crystal that the
following summary language is hereby approved for publication of the Ordinance:

The City Council adopted the above referenced ordinance amending the Town Center —
Planned Development (TC-PD) at 5240 West Broadway to allow a sport court surrounded
by a chain -link fence on the property. A copy of the full text of the ordinance is available
on the City's website and by contacting the City Clerk.
BE IT FINALLY RESOLVED, that the City Clerk is hereby authorized and directed to do
each of the following:
1. Publish the approved summary language once in the City's official newspaper;
2. Place a copy of this Resolution, the full text of the Ordinance, and the affidavit of publication of
the summary language in the City's ordinance book;
3. Make the full text of the Ordinance available for public inspection in the office of the City Clerk
during the City's regular business hours; and
4. Post the updated Crystal City Code on the City's website.
