Ord No 2023- 01 Amending the Zoning Map to Rezone property for Hampton CompaniesORDINANCE NO. 2023-01 CITY OF CRYSTAL AN ORDINANCE AMENDING THE ZONING MAP TO REZONE PROPERTY FOR HAMPTON COMPANIES LOCATED AT 3401 AND 3415 DOUGLAS DRIVE NORTH FROM MEDIUM DENSITY RESIDENTIAL (R-2) TO PLANNED DEVELOPMENT (R2-PD) THE CITY OF CRYSTAL ORDAINS: Section 1. Legislative Findings. The City Council of the City of Crystal hereby finds and determines as follows: (a) Hampton Companies ("Applicant') has requested to rezone property it proposes to purchase at 3401 and 3415 Douglas Drive North ("Property") to the planned development overlay district as provided in Crystal city code, subsection 515.13; and (b) The request would rezone the Property from Medium Density Residential (R-2) to Planned Development (R2-PD); and (c) The rezoning request is to allow the Applicant to construct two four -unit townhome buildings, which involves the subdivision of the Property into eight platted parcels and one common lot and approval of a site plan; and (d) The Planning Commission held a public hearing on the rezoning request on April 10, 2023 and voted to forward the requested rezoning to the City Council with a recommendation that it be approved with certain conditions; and (e) The City Council determines the proposed rezoning of the Property complies with the approval criteria in Crystal city code, subsection 510.31 and 515.13 and other applicable provisions. Section 2. Rezoning. Subject to the conditions in Section 3 of this ordinance, the Zoning Map of Crystal, Minnesota is hereby amended as follows: The zoning classification of the following legally described property addressed as 3401 and 3415 Douglas Drive North, currently classified as Medium Density Residential (R-2), shall henceforth be classified as Planned Development (R2-PD), which is proposed to be replatted as: Lot 1-4, Block 1, Lots 1-4, Block 2, and Outlot A, Hampton Addition, Hennepin County, Minnesota. Section 3. Conditions. The rezoning approved herein is conditioned on compliance with the following: Site Plan. The development shall be constructed according to the site plan in attachment E. 2. Building permit. The following are the requirements for building permit issuance: 1. Submittal deadline. The applicant shall submit the permit application for the townhomes by May 2, 2024 or submit a request for City Council approval of a one-year extension by April 12, 2024. 2. Building permit issuance. Before the permit is issued, the applicant shall: 1) Receive approval of the erosion and grading plans by the Bassett Creek Watershed Management Commission. 2) Sign a site improvement agreement with the city and provide an escrow to guarantee installation of the parking lot, trench drain, and landscaping plan. 3) Submit an exterior lighting plan that meets UDC requirements. 4) Receive approval by the City Council of the subdivision final plat and the easement vacation applications and then provide documentation that the plat and notice of completion for the easement vacation have been recorded at Hennepin County. 3. Overhead utilities. If utility lines are installed, relocated or extended, the lines shall be buried underground. New private utilities, such as Xcel Energy, Center Point Energy, or Comcast shall be buried underground. 4. Special provisions related to Medium Density Residential - Planned Development (R2-PD,) rezonin r. The rezoning to R2-PD implements the following special provisions in place of the standard R-2 zoning requirements: a. For each four -unit building, the minimum building setbacks are reduced as follows: i South (34"' Ave N.): 23 feel + East (Douglas Drive N.): 13 feet North: 10 feet For each townhome lot, the minimum side setback within each lot is reduced to 0 feet. b. The minimum lot area, depth and width requirements are reduced as follows: * Lot area: + Lot depth: • Lot width: 1,534 — 1,654 sq. ft. 61 feet 25-27 feet c. The maximum fence height along Douglas Drive is increased to 5 feet. Section 4. Zoning Map Amendment. The zoning administrator is authorized and directed to amend the Zoning Map in accordance with this ordinance and to take any such other actions as may be required to effectuate this rezoning. Section 5. Effective Date. This ordinance shall not be codified into the Crystal city code and is effective in accordance with Crystal city code, subsection 110.11. Jir�Adams, Mayor ATTEST: Chrissy Serres, City Clerk First Reading: April 18, 2023 Second Reading and Adoption: May 2, 2023 Publication: May 11, 2023 Effective Date: June 10, 2023 CITY OF CRYSTAL MINNESOTA RESOLUTION NO.2023-52 RESOLUTION APPROVING SUMMARY LANGUAGE FOR PUBLICATION OF ORDINANCE NO.2023-01 WHEREAS, the Crystal City Council adopted Ordinance No. 2023-01 "An Ordinance Amending the Zoning Map to Rezone Property for Hampton Companies located at 3401 and 3415 Douglas Drive North from Medium Density Residential (R-2) to Planned Development (R2-PD)" ("Ordinance") at its meeting held on May 2, 2023; and WHEREAS, Section 3.12 of the Crystal City Charter and Section 110.13 of the Crystal City Code indicate that ordinances approved by the City Council will be published in summary form and that the City Council is to approve the form of the summary. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Crystal that the following summary language is hereby approved for publication of the Ordinance: CITY OF CRYSTAL ORDINANCE NO.2023-01 AN ORDINANCE AMENDING THE ZONING MAP TO REZONE PROPERTY FOR HAMPTON COMPANIES LOCATED AT 3401 AND 3415 DOUGLAS DRIVE NORTH FROM MEDIUM DENSITY RESIDENTIAL (R-2) TO PLANNED DEVELOPMENT (R2-PD) SUMMARY OF ORDINANCE No. 2023-01 Ordinance No. 2023-01 ivas approved by the city council on May 2, 2023. A printed copy of the full text of the ordinance is available for public inspection in the office of the city clerk and is available on the city's website. The ordinance rezones the property at 3401-3415 Douglas Drive North from Medium Density Residential (R-2) to Planned Development (R2-PD). The ordinance makes various legislative findings, amends the City's zoning map to reflect the new district, set out conditions, and directs the zoning administrator to amend the zoning map. A copy of the full ordinance is available on the City's website. BE IT FINALLY RESOLVED, that the City Clerk is hereby authorized and directed to do each of the following: 1. Publish the approved summary language once in the City's official newspaper; 2. Place a copy of this Resolution, the frill text of the Ordinance, and the affidavit of publication of the summary language in the City's ordinance book; 3. Make the fiill text of the Ordinance available for public inspection in the office of the City Clerk during the City's regular business hours; 4.
