Ord No 2019-01 Amending the Zoning Map to Rezone Property for Rivertree School Located at 3709 & 3733 Vera Cruz Ave N from Low Density Residential (R-1) to Low Density Residential (R-1) - Planned DevelopmentORDINANCE NO. 2019 - 01 CITY OF CRYSTAL AN ORDINANCE AMENDING THE ZONING MAP TO REZONE PROPERTY FOR RIVERTREE SCHOOL LOCATED AT 3709 AND 3733 VERA CRUZ AVENUE NORTH FROM LOW DENSITY RESIDENTIAL (R-1) TO LOW DENSITY RESIDENTIAL (R-1) — PLANNED DEVELOPMENT THE CITY OF CRYSTAL ORDAINS: Section 1. Legislative Findings. The City Council of the City of Crystal hereby finds and determines as follows: (a) Rivertree School ("Applicant") is the owner of Lot 1, Block 1, Rivertree School ("Property") and has requested the City to rezone the property to the planned development overlay district as provided in Crystal city code, subsection 510.31; and (b) The request would rezone the Property from Low Density Residential (R-1) to Low Density Residential Planned Development (R1 -PD); and (c) The rezoning request is to support an expansion of the Applicant's existing school, which involved the consolidation of the Applicant's parcels into the current single platted parcel, approval of an amended conditional use permit, and approval of a site plan; and (d) The Planning Commission held a public hearing on the rezoning request on March 11, 2019 and voted to forward the requested rezoning to the City Council with a recommendation that it be approved with certain conditions; and (e) The City Council determines the proposed rezoning and site plan comply with the approval criteria in Crystal city code, subsections 510.17, 510.29, 510.31, and other applicable provisions. Section 2. Rezoning. The Zoning Map of Crystal, Minnesota is hereby amended as follows: The zoning classification of the following legally described property addressed as 3709 and 3733 Vera Cruz Avenue North, currently classified as Low Density Residential (R-1), shall henceforth be classified as Low Density Residential (R-1) — Planned Development (R1 -PD): Lot 1, Block 1, Rivertree School Section 3. Zoning ME Amendment. The zoning administrator is authorized and directed to amend the Zoning Map in accordance with this ordinance and to take any such other actions as may be required to effectuate this rezoning. 559766v2 TJG CR205-30 Section 4. Effective Date. This ordinance shall not be codified into the Crystal city code and is effective in accordance with Crystal city code, subsection 110.11.
