Bell, City Manager SUBJECT: Charitable Gambling Proceeds – Contributions to PRISM and NEAR Food Shelves BACKGROUND In 2008, the City Council adopted Resolution #2008-56 outlining policies for the use of charitable gambling proceeds, consistent with Minnesota Statutes, Section 349.12, Subd. 25. The resolution permits expenditures for a variety of lawful purposes, including contributions to local food shelves serving Crystal residents. An updated resolution has been proposed for council consideration that would retain this previously adopted policy. In previous years, the Council had annually contributed $1,000 each to NEAR and PRISM food shelves during the month of March to coincide with the state matching grant program. Although this matching program is not currently available, the need for food assistance in our community continues. Additional matching programs may become available in the future. More recently, due to a lack of available funds and the desire to cut expenses, the city stopped contributing to the food shelves. However, the current council wishes to restart these contributions, and the city now has funds available again. As of this date, there are sufficient funds in the City Initiative Fund, derived from the required 10% contribution from charitable gambling organizations, to continue these contributions. RECOMMENDATION: Staff recommends that the City Council authorize contributions to NEAR and PRISM from the City Initiative Fund and reaffirm the City Manager’s authority to allocate charitable gambling proceeds in alignment with the adopted policy when funds are available. ATTACHMENTS • Resolution No. 2025 – XX, A Resolution Authorizing Contributions to Local Food Shelves Pursuant to the Policy on Charitable Gambling Proceeds • Resolution No. 2025 – XX, A Resolution Adopting Policy Regarding Charitable Gambling Proceeds CITY OF CRYSTAL MINNESOTA RESOLUTION NO. 2025-xx A RESOLUTION AUTHORIZING CONTRIBUTIONS TO LOCAL FOOD SHELVES PURSUANT TO THE POLICY ON CHARITABLE GAMBLING PROCEEDS WHEREAS, the City of Crystal receives a 10% contribution from charitable gambling organizations operating within the city, deposited in the City Initiatives Fund; and WHEREAS, Resolution No. 2025-XX outlines permissible uses of these funds in accordance with Minnesota Statutes, Section 349.12, Subd. 25, including support for food shelves and nutritional programs; and WHEREAS, local organizations such as PRISM and NEAR provide essential nutritional and food assistance services to Crystal residents; and WHEREAS, the Council has historically contributed annually to each of these organizations when sufficient funds are available; and WHEREAS, there are currently sufficient funds available in the City Initiative Fund to continue these contributions; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Crystal: 1. That the City Manager is authorized to contribute to PRISM, NEAR, and other food access organizations from the City Initiative Fund when funds are available. 2. That such contributions shall be consistent with the policy established by Resolution No. 2025- XX and Minnesota Statutes, Section 349.12. 3. That the City Manager will report annually on expenditures made under the Charitable Gambling and City Initiatives Funds to ensure continued transparency and Council oversight. Adopted this ___ day of May 2025. ______________________________ Julie Deshler, Mayor ATTEST: _______________________________ Chrissy Serres, City Clerk CITY OF CRYSTAL MINNESOTA RESOLUTION NO. 2025-xx POLICY REGARDING CHARITABLE GAMBLING PROCEEDS WHEREAS, the City of Crystal requires a 10% contribution from organizations conducting charitable gambling within the city; and WHEREAS, these funds are deposited in the City Initiatives Fund; and WHEREAS, charitable gambling fees may be used for lawful city purposes as defined in Minnesota Statutes, Section 349.12, Subd. 25, paragraph (a), clauses (1) to (7), (10) to (15), and (19); and WHEREAS, the City Council wishes to determine how charitable gambling fees are spent, based on State law and this policy. NOW, THEREFORE, BE IT RESOLVED by the Crystal City Council as follows: Charitable gambling fees may be used towards services provided to area residents, so long as such services are permitted by the following lawful purposes: 1. Relieving the effects of poverty or disability; 2. Festival organizations (501 (c)(3) or 501 (c)(4); 3. Scholarship funds; 4. Activities by an organization that recognize military service to the country, state, or community; 5. Activities and facilities for youth under 21; 6. Expenditures for police, fire, and other emergency or public safety-related services or equipment; 7. A nonprofit organization that is a church or a body of communicants; 8. MPCA-approved water quality testing for public waters; 9. MN DNR-approved wildlife management project that benefits the public at large; 10. Nutritional programs, food shelves, and congregate dining programs primarily for persons aged 62 or older or disabled; 11. Community arts organizations or expenditures to fund arts programs in the community; 12. Recognizing humanitarian service demonstrated through volunteerism or philanthropy; or 13. Other lawful purposes designated by the City Council or state statutes. BE IT FURTHER RESOLVED, that the City Manager is authorized to expend the Charitable Gambling funds pursuant to this policy and will provide an annual report on the Charitable Gambling and City Initiatives Funds so that the Council may direct any specific eligible expenditures.
