The Council will consider the following items, which are routine and non-controversial in nature,
in a single motion:
5.1 Approval of the minutes from the following meetings:
a. The City Council work session on April 11, 2024.
b. The City Council meeting on April 16, 2024.
c. The City Council work session on April 16, 2024.
5.2 Approval of the list of license applications submitted by the city clerk to the City Council, a
list that is on file in the office of the city clerk.
5.3 Adoption of a resolution accepting a donation.
5.4 Adoption of a resolution approving the participation of the Hennepin County Housing and
Redevelopment Authority in an affordable housing project.
6. Open Forum
The City Council appreciates hearing from citizens about items of concern and desires to set aside
time during each meeting for Open Forum. To provide ample opportunity for all, speaking time is
limited to three minutes, and topic discussion is limited to 10 minutes. The Mayor may, as

presiding officer, extend the total time allowed for a topic. By rule, no action may be taken on any
item brought before the Council during Open Forum. The Council may place items discussed during
Open Forum onto subsequent council meeting agendas.
7. Regular Agenda
7.1 The Council will consider approval of disbursements of more than $25,000 submitted by the
finance department to the City Council, a list that is on file in the office of the finance
department.
Recommend approval of disbursements over $25,000.
7.2 The Council will consider civil penalties for violation of liquor license regulations by Klever
Liquor, Inc. d/b/a Klever Liquor located at 5120 56th Ave. N.
Following routine liquor license compliance checks last fall, an employee of Klever Liquor
was convicted of selling alcohol to a minor. The City Council may now impose civil
administrative penalties against the license holder. This is the second liquor violation for
Klever Liquor within two years, and according to the City Code, the City Council may
impose a penalty of up to a $1,500 fine and a three-day license suspension. Before acting
on the civil penalties, the City Council should hear any comments from the
representative(s) of Klever Liquor. Pursuant to the city ordinance and the penalty for a
second violation, staff recommends the City Council impose a three-day license suspension
and a civil fine of $1,500.
7.3 The Council will consider civil penalties for violation of liquor license regulations by Family
Café and Diner, LLC d/b/a Family Café and Diner located at 6236 56th Ave. N.
Following routine liquor license compliance checks last fall, an employee of Family Café
and Diner was convicted of selling alcohol to a minor. The City Council may now impose
civil administrative penalties against the license holder. This is the first liquor violation for
Family Café and Diner, and according to the City Code, the City Council may impose civil
penalties of up to a $750 fine and a one-day license suspension. Before acting on the civil
penalties, the City Council should hear any comments from the representative(s) of Family
Café and Diner. Pursuant to the city ordinance, staff recommends the City Council impose a
one-day license suspension and a civil fine of $750.
7.4 The Council will consider civil penalties for violation of liquor license regulations by Milton’s
Café, LLC d/b/a Milton’s Café located at 3545 Douglas Dr. N.
Following routine liquor license compliance checks last fall, an employee of Milton’s Café
was convicted of selling alcohol to a minor. The City Council may now impose civil
administrative penalties against the license holder. This is the first liquor violation for
Milton’s Café, and according to the City Code, the City Council may impose civil penalties of
up to a $750 fine and a one-day license suspension. Before acting on the civil penalties, the
City Council should hear any comments from the representative(s) of Milton’s Café.
Pursuant to the city ordinance, staff recommends the City Council impose a one-day license
suspension and a civil fine of $750.

7.5 The Council will consider civil penalties for violation of liquor license regulations by Northern
Tier Retail, LLC d/b/a Speedway #4187 located at 7818 36th Ave. N.
Following routine liquor license compliance checks last fall, an employee of Northern Tier
Retail, LLC d/b/a Speedway #4187 was convicted of selling alcohol to a minor. The City
Council may now impose civil administrative penalties against the license holder. This is the
first liquor violation for Speedway #4187, and according to the City Code, the City Council
may impose civil penalties of up to a $750 fine and a one-day license suspension. Before
acting on the civil penalties, the City Council should hear any comments from the
representative(s) of Speedway #4187. Pursuant to the city ordinance, staff recommends
the City Council impose a one-day license suspension and a civil fine of $750.
7.6 The Council will consider civil penalties for violation of liquor license regulations by Charles R.
Knaeble VFW Post #494 located at 5222 56th Ave. N.
Following routine liquor license compliance checks last fall, an employee of Charles R.
Knaeble VFW Post #494 was convicted of selling alcohol to a minor. The City Council may
now impose civil administrative penalties against the license holder. This is the first liquor
violation for VFW Post #494, and according to the City Code, the City Council may impose
civil penalties of up to a $750 fine and a one-day license suspension. Before acting on the
civil penalties, the City Council should hear any comments from the representative(s) of
VFW Post #494. Pursuant to the city ordinance, staff recommends the City Council impose a
one-day license suspension and a civil fine of $750.
7.7 The Council will consider a resolution awarding a contract for construction of the hard
surface courts in Valley Place Park and a parking lot in North Lions Park.
The Valley Place Park hard surface courts and the west parking lot in North Lions Park are
both in the Long Term Plan for replacement due to their poor condition. The total amount
budgeted in the LTP for the parking lot, hard surfaces, and lighting is $890,000. The City
Council authorized the advertisement for bids for the parking lot and hard surfaces on
March 19. The bids were opened on April 18, and the low, responsible bidder was
Bituminous Roadways, Inc. with a bid of $429,363.65, which is $208,110 under the
engineer’s estimate of $637,473.75 for the project. Staff recommends awarding the
contract to Bituminous Roadways, Inc. for the amount of $429,363.65.
7.8 The Council will consider a resolution approving agreements for the purchase and installation
of court lighting at Valley Place Park.
The Valley Place Park hard surface courts replacement and related lighting are both in the
Long Term Plan for replacement due to their poor condition. The total amount budgeted in
the LTP for the hard surfaces and lighting is $600,000. Item 7.7 addressed the hard surface
court replacements and came in under budget. This item includes the lighting system
purchase, delivery, and installation at $105,300, which is also under budget. Staff
recommends awarding the respective contracts for the lighting system purchase and
delivery to Musco Sports Lighting, LLC for the amount of $62,450 and Killmer Electric Co.,
Inc. for the amount of $42,850.

a. To accommodate Crystal residents practicing No Mow May, the city waits until June 1 to begin
long grass enforcement.
b. The City Council will hold a work session on Thursday, May 9 at 6:30 p.m. in Conference Room
A at City Hall and via Zoom.
c. The Friends of Crystal Parks plant sale is Saturday, May 18 from 9 a.m. to 1 p.m. at Becker
Park.
d. The next City Council meeting is Tuesday, May 21 at 7 p.m. in the Council Chambers at City
Hall and via Zoom.
e. City Council meetings and work sessions are open to the public. Current and previous

As you are aware, we annually celebrate and honor police officers during National Police
Week. This year, police week is May 12 through May 18, 2024. Attached is a proclamation
in which we request Mayor Adams to read at the May 7, 2024 city council meeting to honor
those officers who have lost their lives in the line of duty and to honor those officers serving
their communities honorably with compassion, integrity, and professionalism.
I would also like to humbly say a few words on behalf of our police department.

"NATIONAL POLICE WEEK"
MAY 12-18, 2024
"PEACE OFFICER MEMORIAL DAY"
MAY 15, 2024
WHEREAS, the week of May 12 to 18, 2024, is National Police Week in the United
States.
WHEREAS, there are over 800,000 law enforcement officers serving in communities
across the United States, including the dedicated members of the Crystal Police
Department.
WHEREAS, over 56,000 assaults against law enforcement officers are reported each year,
resulting in over 17,000 injuries.
WHEREAS, since the first recorded death in 1786, a total of 24,067 law enforcement
officers in the United States have made the ultimate sacrifice and died in the line of duty,
including 305 Minnesota law enforcement officers.
WHEREAS, the names of these dedicated public servants are engraved on the walls of the
National Law Enforcement Memorial in Washington, D.C.
WHEREAS, 282 new names of fallen heroes, including two officers from Minnesota, are
being added to the National Law Enforcement Memorial this spring, including 118 line of
duty deaths in 2023 and 164 officers who died in previous years but whose stories of
sacrifice had been lost to history until now.
WHEREAS, May 15th is designated as Peace Officer Memorial Day, in honor of all the
fallen officers and their families and U.S. Flags should be flown at half-staff.
NOW, THEREFORE, I, Jim Adams, Mayor of The City of Crystal, hereby recognize
May 12th – 18th, 2024 as NATIONAL POLICE WEEK in the City of Crystal, MN and call
upon the people of Crystal to observe this week in honor of the men and women whose
diligence and professionalism keep the residents and city of Crystal safe.

W HEREAS, public infrastructure in the City of Crystal is an integral part of our
everyday lives; and
W HEREAS, the health, safety, and comfort of residents, visitors, and businesses
greatly depend on public infrastructure and services; and
W HEREAS, support from an encouraging, understanding, and informed
citizenry is vital to the efficient operation of public infrastructure systems and programs
including transportation, buildings and facilities, parks and forestry, water supply and
treatment, sanitary sewers, and surface water management; and
W HEREAS, Crystal’s public works department is committed to the
mission of quality design, construction, operation, and maintenance of the city’s
public infrastructure; and
WHEREAS, continued community support and resources are essential for the
public works department to carry out its mission.
NOW, THEREFORE, I, JIM ADAMS, MAYOR OF CRYSTAL do hereby
proclaim the week of May 19 through May 25, 2024, as Public Works Week in the
City of Crystal and recognize the everyday commitment made by the public works

RESOLUTION ACCEPTING A DONATION
WHEREAS, Minnesota Statutes §465.03 requires that all gifts and donations of real or personal
property be accepted only with the adoption of a resolution; and
WHEREAS, said donations must be accepted by a resolution adopted by the City Council.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Crystal to accept the following

SUBJECT: Consider a resolution approving the participation of the Hennepin County
Housing and Redevelopment Authority in an affordable housing project

BACKGROUND
W est Hennepin Affordable Housing Land Trust (WHAHLT) is a private, non-profit organization
that operates a program called Homes Within Reach (HWR) which provides affordable owner-
occupied housing. Hennepin County Housing and Redevelopment Authority (HCHRA) desires
to provide financial assistance to HWR. HCHRA policy is to get the city’s consent in the form
of a City Council resolution before county funds are spent in that city. The proposed resolution
is limited to approving the use of HCHRA funds in the city and explicitly excludes any financial
obligation or endorsement of the project by the city.
PROJECT DESCRIPTION
HW R purchases residential properties, rehabs them, and sells them to a household below
80% of Twin Cities Area Median Income. HWR homebuyers have the same obligations as any
other homeowner (mortgage payments, property taxes, insurance, maintenance and so forth).
Long term affordability is achieved with a combination of initial public funding, removing the
land value from the home price, and restricting future sales to similarly qualifying households.
Under the program, the homebuyer enjoys the same benefits as any other homeowner:
Appreciation in the value of the house and accessory buildings (although not the land)
Residential stability
Ability to make changes and improvements
Intergenerational accumulation and transfer of wealth
Income tax deductions for mortgage interest and property taxes

RESOLUTION NO. 2024 - ___
APPROVING THE PARTICIPATION OF THE HENNEPIN COUNTY HOUSING AND
REDEVELOPMENT AUTHORITY IN AN AFFORDABLE HOUSING PROJECT
WHEREAS, West Hennepin Affordable Housing Land Trust, dba Homes Within Reach, has
purchased or will purchase residential properties for the purpose of preserving the supply of
affordable housing and long-term affordability, with one or more of the properties being located
within the City of Crystal (the “Project”); and
WHEREAS, the Hennepin County Housing and Redevelopment Authority (“HCHRA”) has
approved Homeownership Assistance Program funding for the Project contingent upon the
Crystal City Council’s consent to the HCHRA’s participation in the Project.
WHEREAS, HCHRA funds will complete the financing required for the Project to go forward.
NOW, THEREFORE BE IT RESOLVED that the participation of HCHRA in the Project for
the limited purpose of providing HCHRA financial support to the Project is hereby approved by
the Crystal City Council.
BE IT FURTHER RESOLVED that nothing in this resolution shall create a pecuniary
obligation of the City of Crystal to assist the project, nor shall the City be in any way responsible
for any financing obligation or agreement of the HCHRA or any other agency or entity with
respect to their provision of financial assistance to the Project.
BE IT FURTHER RESOLVED that nothing in this resolution is intended to endorse the merits
of the Project.

Background
On Sept. 23, 2023 alcohol compliance checks were conducted at licensed liquor establishments
by Crystal Police Department. As a result, Klever Liquor did not pass this compliance check. An
employee of the business has pleaded guilty in court to the sale of alcohol to a minor, which is a
violation of state law and Crystal City Code § 1200.35.
The attached notice was mailed to the liquor licensee on April 26, 2024.
This is considered a second violation for this licensee.
Requested City Council action
Consistent with City Code and Resolution No. 2018-160, staff recommends Klever Liquor
receive a three-day license suspension and civil fine of $1,500 with the city clerk determining
the dates of the license suspension and payment date for the fine.

(a) The licensed premises of the business are destroyed by fire or other catastrophe;
(b) The licensee ceases business because of death or serious illness; or
(c) The business ceases to be lawful for a reason other than a license revocation.
The city council shall, in its sole discretion, determine whether such a refund is appropriate, and if so, in
what amount.
1200.33. Consumption and display permits.
Subd. 1. Permit required. No business establishment or club which does not hold an on-sale
intoxicating liquor license may directly or indirectly allow the consumption and display of alcoholic
beverages or knowingly serve any liquid for the purpose of mixing with intoxicating liquor without first
having obtained a permit from the commissioner. Rental of a public facility does not make the city or the
facility a “business establishment” for purposes of this section. The city council must consent to all permits
issued by the commissioner pursuant to Minnesota Statutes, section 340A.414, subdivision 5.
Subd. 2. Additional fees. There is imposed upon holders of permits issued pursuant to Minnesota
Statutes, section 340A.414 an additional fee of $300 per annum. The fee must be paid to the city finance
director on or before March 31 of each year and a receipt given thereof, provided, however, upon
commencement of a new permit period under the state permit, if a portion of the year has elapsed when
payment is made, a pro rata fee may be paid but no such pro rata fee may be less than $150. In computing
the fee, an unexpired fraction of a month is counted as one month. The receipt must be posted in some
conspicuous place upon the premises alongside the state permit.
Subd. 3. Inspections. A business establishment or club issued a permit shall be open for inspection
pursuant to Minnesota Statutes, section 340A.414, subdivision 7.
Subd. 4. Hours of consumption and display. The hours of consumption and display of intoxicating
liquor are those specified in section and Minnesota Statutes, section 340A.414.
1200.35. Conditions of license; penalties.
Subd. 1. Conditions of license. The failure of a licensee to meet any one of the conditions of the
license specified below shall result in the application of penalties as provided in this subsection.
(a) Within 90 days after employment, every person selling or serving liquor in an
establishment which has an on-sale license shall receive training regarding the selling or
serving of liquor to customers. The training shall be provided by an organization approved
by the city council. Proof of training shall be provided by the licensee.

(b) Every licensee is responsible for the conduct of the place of business and the conditions of
sobriety and order in it. The act of any employee on the licensed premises is deemed the
act of the licensee as well, and the licensee shall be liable for all penalties provided by this
Crystal city code and the law equally with the employee.
(c) Every licensee shall allow any peace officer, health officer, city employee, or any other
person designated by the city council to conduct compliance checks and to otherwise enter,
inspect, and search the premises of the licensee during business hours and after business
hours during the time when customers remain on the premises without a warrant.
(d) No on-sale establishment shall display or sell liquor to the public during hours when the
sale of liquor is prohibited.
(e) Compliance with financial responsibility requirements of state law and of this Crystal city
code is a continuing condition of any license.
(f) Compliance with all laws, rules, and regulations related to the retail sale of intoxicating
liquors, including the provisions of Minnesota Statutes, chapters 297F and 340A,
Minnesota Rules, chapter 7515, and the Crystal city code.
Subd. 2. Penalties.
(a) Misdemeanors. A person who violates this section is guilty of a misdemeanor unless
otherwise provided by law.
(b) Presumptive revocation. The city council may revoke a license, following, notice and an
opportunity to be heard, on the first violation for the following types of offenses:
(1) Commission of a felony by licensee or an employee of licensee related to the
licensed activity authorized by this chapter and Minnesota Statutes, chapter 340A.
(2) The sale of alcoholic beverages on the licensed premises while a license is under
suspension or revocation.
(c) Administrative civil penalties. If a licensee or an employee of a licensee is found to have
violated any of the provisions of state law or this section, the city council may impose an
administrative penalty, including a civil fine and/or suspension of the license, in such
amounts and for such periods as set out Crystal city code, appendix IV.

Subd. 3. Presumptions regarding administrative penalties. The administrative penalties described
in subdivision 2 of this subsection and set out in Crystal city code, appendix IV are the presumed sanctions
for the violations indicated. In the event of any license suspension imposed under this section, the city
council may select which days a suspension will be served. Notwithstanding any of the provisions
contained herein, a license may be revoked for any violation of this section when in the judgment of the
city council it is appropriate to do so. The city council may impose lesser penalties under subdivision 2 of
this subsection when in the judgment of the city council it is appropriate to do so. Other mandatory
requirements may be made of the establishment including, but not limited to, meetings with the police
department staff to present a plan of action to assure any observed problems will not continue, mandatory
education sessions with crime prevention staff, or other actions that the city council deems appropriate.
1200.37. Hours of sale.
Subd. 1. Statutory. The hours of operation and days of sale shall be those set by Minnesota
Statutes, section 340A.504, including sales after 1:00 a.m. pursuant to a permit issued by the commissioner,
except that the city council may, by resolution or ordinance, provide for more restrictive hours than state
law allows.
Subd. 2. Consumption prohibited. No person shall consume, nor shall any on-sale licensee permit
any consumption of, intoxicating liquor or 3.2 percent malt liquor upon an on-sale licensed premises more
than 30 minutes after the time within which intoxicating liquors may be sold.
Subd. 3. Display. No on-sale licensee shall permit any glass, bottle, or other container containing
intoxicating liquor or 3.2 percent malt liquor to remain upon any table, bar, stool, or other place where
customers are served, more than 30 minutes after the time within which intoxicating liquors may be sold.
Subd. 4. Vacate premises. No person, other than the licensee and any employee, shall remain on
the on-sale licensed premises more than 30 minutes after the time within which intoxicating liquors may be
sold.
Subd. 5. Penalty. Any violation of this subsection may be grounds for revocation or suspension
of the license subject to the terms of this section.
1200.39. Licenses in prohibited locations. No license shall be issued under this section in any place which
is prohibited under Minnesota Statutes, section 340A.412, subdivision 3.
1200.41. Temporary on-sale licenses. The city council may issue temporary on-sale licenses for the on-
sale of intoxicating liquor to clubs, or charitable, religious or other non-profit organizations in the manner
and subject to the conditions specified in Minnesota Statutes, section 340A.404, subdivision 10. The fee
for a temporary on-sale license shall be in an amount as provided in Crystal city code, appendix IV.

violation of state law and Crystal City Code § 1200.35.
The attached notice was mailed to the liquor licensee on April 26, 2024.
This is considered a first violation for this licensee.
Requested City Council action
Consistent with City Code and Resolution No. 2018-160, staff recommends Milton’s Café
receive a one-day license suspension and civil fine of $750 with the city clerk determining the
date of the license suspension and payment date for the fine.

education sessions with crime prevention staff, or other actions that the city council deems appropriate.
1200.37. Hours of sale.
Subd. 1. Statutory. The hours of operation and days of sale shall be those set by Minnesota
Statutes, section 340A.504, including sales after 1:00 a.m. pursuant to a permit issued by the commissioner,
except that the city council may, by resolution or ordinance, provide for more restrictive hours than state
law allows.
Subd. 2. Consumption prohibited. No person shall consume, nor shall any on-sale licensee permit
any consumption of, intoxicating liquor or 3.2 percent malt liquor upon an on-sale licensed premises more
than 30 minutes after the time within which intoxicating liquors may be sold.
Subd. 3. Display. No on-sale licensee shall permit any glass, bottle, or other container containing
intoxicating liquor or 3.2 percent malt liquor to remain upon any table, bar, stool, or other place where
customers are served, more than 30 minutes after the time within which intoxicating liquors may be sold.
Subd. 4. Vacate premises. No person, other than the licensee and any employee, shall remain on
the on-sale licensed premises more than 30 minutes after the time within which intoxicating liquors may be
sold.
Subd. 5. Penalty. Any violation of this subsection may be grounds for revocation or suspension
of the license subject to the terms of this section.
1200.39. Licenses in prohibited locations. No license shall be issued under this section in any place which
is prohibited under Minnesota Statutes, section 340A.412, subdivision 3.
1200.41. Temporary on-sale licenses. The city council may issue temporary on-sale licenses for the on-
sale of intoxicating liquor to clubs, or charitable, religious or other non-profit organizations in the manner
and subject to the conditions specified in Minnesota Statutes, section 340A.404, subdivision 10. The fee
for a temporary on-sale license shall be in an amount as provided in Crystal city code, appendix IV.

Valley Place Park and Parking Lot Improvements in North Lions Park
Pavement on the hard surface courts in Valley Place Park and west parking lot in North Lions
Park is in poor condition and needs to be replaced. Replacement of the hard surface courts is
in the 2024 long term plan (parks fund) and replacement of the parking lot is in the 2024 long
term plan (buildings fund). Total funding for the combined projects is $890,000; $600,000 for
the courts and $290,000 for the parking lot. This budget covers preparation of construction
documents and court lighting in addition to the bid items below.
Advertisement for bids was authorized by the city council on March 19, 2024. Ads for
construction were published on March 28 and April 4, with bids being opened on April 18, 2024.

Valley Place Park
The court lighting in Valley Place Park is scheduled for replacement in 2024 as part of a
hard surface court improvement project. Replacement of the hard surface courts is in the
2024 long term plan (parks fund) in the amount of $600,000. This budget includes
preparation of construction documents, bid items and LED lighting (this item).
Replacement of court lighting includes two parts: 1) purchase and delivery of the lighting
system and 2) installation of the lighting system by an electrician.
A Musco sports lighting system can be purchased at a reduced rate through the Sourcewell
Cooperative Purchasing Program. The majority of sports lighting in Crystal in on a Musco
lighting system, which allows for the LED lights to be controlled remotely. Killmer Electric
Co. Inc. is the preferred installer of Musco lighting systems, and as such has installed LED
light systems in Becker and North Lions Parks. They also installed a Musco control panel
in 2022 at Valley Place Park in preparation for this project. The quotes for these items are:
