Proclamations 3.1 Mayor Adams will proclaim May 1, 2024, as Arbor Day in the City of Crystal. 3.2 Mayor Adams will proclaim May 2, 2024, as a Day of Prayer and Fasting in the City of Crystal. 4. Appearances 4.1 The City will share a presentation for the 2024 Neighbors Recognizing Neighbors Awards. 5. Consent Agenda The Council will consider the following items, which are routine and non-controversial in nature, in a single motion: 5.1 Approval of the minutes from the following meetings: a. The City Council work session on April 2, 2024. b. The City Council meeting on April 2, 2024. 5.2 Approval of the list of license applications submitted by the city clerk to the City Council, a list that is on file in the office of the city clerk. 5.3 Adoption of a resolution accepting donations. 5.4 Adoption of a resolution approving creation of a new special revenue fund for the Police State Aid allotment. 6. Open Forum The City Council appreciates hearing from citizens about items of concern and desires to set aside time during each meeting for Open Forum. To provide ample opportunity for all, speaking time is limited to three minutes, and topic discussion is limited to 10 minutes. The Mayor may, as presiding officer, extend the total time allowed for a topic. By rule, no action may be taken on any item brought before the Council during Open Forum. The Council may place items discussed during Open Forum onto subsequent council meeting agendas. Page 2 of 3 7. Regular Agenda 7.1 The Council will consider approval of disbursements of more than $25,000 submitted by the finance department to the City Council, a list that is on file in the office of the finance department. Recommend approval of disbursements over $25,000. 7.2 The Council will consider a resolution awarding the contract for construction of the Crystal Cove Aquatic Center pool. The city received multiple bids in response to the Crystal Cove Aquatic Center construction project advertisement. The pool portion of the project is split in three parts – Pool Construction, Site Clearing and Earthwork, and Concrete (deck) Work. Overall, the lowest responsible bids all came in favorably compared to the estimate. Therefore, staff recommends approval of the resolution awarding the contracts to Global Specialty Contractors ($2,137,700), Kevitt Excavating ($199,000), and Crosstown Masonry ($165,000) for the construction of improvements at the Crystal Cove Aquatic Center pool. 7.3 The Council will consider a resolution authorizing the modernization of the elevator at City Hall. The Long-Term Plan includes $200,000 in 2024 for elevator modernization at City Hall. City Hall was constructed originally in 1964 and then re-modeled in 1994. The existing elevator is a 1993 model and requires modernization for several reasons, most importantly safety, ADA compliance, and availability of parts. After the elevator was inspected last year, the city was advised that the modernization should take place soon as parts for the elevator are no longer available and safety and reliability were becoming more serious issues. Staff recommends approval of the resolution awarding the contract for elevator modernization to Kone Inc. 7.4 The Council will consider a resolution authorizing the contract for construction materials testing for the 2024 Utility Reconstruction Project. At its February 6 meeting, the Council approved the plans and specifications for the 2024 Utility Reconstruction Project. As with all infrastructure improvement projects, materials testing is done to ensure the quality of the construction. For the 2024 Utility project, staff recommends awarding the materials testing contract to the low bidder, WSB. 7.5 The Council will consider a resolution declaring several diseased trees on private properties as public nuisances and order them abated. As in the past, the city has been working to have private property owners remove the subject diseased trees. Unfortunately, the property owners have either failed to comply with this demand or are unable to remove the trees themselves. Staff is requesting the City Council formally declare the diseased trees as public nuisances, so the city can abate the nuisances. Staff recommends adopting the resolution declaring the specific trees as public nuisances and ordering their abatement. 7.6 The Council will consider two actions regarding an ordinance prohibiting the use of cannabis products in public places: a. Second reading and adoption of the ordinance amending the Crystal City Code to prohibit the use of cannabis in public places. Page 3 of 3 b. Adoption of a resolution approving the summary language for the publication of said ordinance. At its April 2 meeting, the council approved the first reading of the proposed ordinance. Staff recommends the Council approve the second reading and adopt an ordinance prohibiting the use of cannabis in public places. Staff also recommends the adoption of the summary language for publication. 8. Announcements a. The Special Materials Drop-Off Day is Saturday, April 27, 8 a.m. – 3 p.m. at Brooklyn Park Public Works, 8300 Noble Avenue North, Brooklyn Park. For more information, visit www.hrg- recycling.com b. The Crystal Police Department Open House is Saturday, April 27 from 10 a.m. – 1 p.m. at 4141 Douglas Dr. N. c. The Parks and Recreation Commission will host the annual Arbor Day celebration and park clean-up on Wednesday, May 1, from 6 - 7:30 p.m., at Skyway Park. d. To accommodate Crystal residents practicing No Mow May which provides habitat and nutrition for early-season pollinators, the city waits until June 1 to begin long grass enforcement. e. The next City Council meeting is Tuesday, May 7 at 7 p.m. in the Council Chambers at City Hall and via Zoom. f. The Friends of Crystal Parks plant sale is Saturday, May 18 from 9 a.m. to 1 p.m. at Becker Park. g. City Council meetings and work sessions are open to the public. PROCLAMATION 2024 CRYSTAL ARBOR DAY CELEBRATION MAY 1, 2024 WHEREAS, Crystal is a Tree City and has been a Tree City since 1998; and WHEREAS, the Crystal Parks and Recreation Commission serves as Crystal’s Tree Board; and WHEREAS, as Crystal’s Tree Board, the Parks and Recreation Commission holds an annual arbor day event to recognize the importance of trees in our community; and to provide information to residents on the role trees play in filtering our air and water, fostering biodiversity, and strengthening our communities; and WHEREAS, the Friends of Crystal Parks has provided funds to purchase trees for distribution to residents attending the city’s arbor day celebration; and WHEREAS, the 2024 Crystal Arbor Day Celebration will be Wednesday, May 1 at 6 p.m. at Skyway Park; located at 6112 Florida Avenue North and includes: •Park clean-up; •Distribution of free Arbor Day trees; •Information on forestry efforts in Crystal; •Planting of a Northern Red Oak tree in the park; and WHEREAS, the City of Crystal wishes to promote the Parks and Recreation Commission, the Crystal Tree Board and the arbor day celebration. Bell, City Manager SUBJECT: 2024 Neighbors Recognizing Neighbors Awards ____________________________________________________________________ Since 2017, the City of Crystal has honored those who make our city a wonderful place to live and work with its Neighbors Recognizing Neighbors recognition awards program. Early each year, the city seeks nominations from residents who want their wonderful neighbor recognized for their kindness and helpfulness. This year, the Parks and Recreation Commission reviewed the nominations and picked three winners for 2024. The winners were invited to the council meeting and one couple is able to attend. Our great neighbors recently received their inscripted crystal awards, and a video presentation had been put together to honor them and their contributions to our community. Background In 2023, the Minnesota legislature enacted a one-time Public Safety Aid that was distributed on December 26, 2023. The city received an allotment of $1,010,119. The aid is intended to support local police departments in providing public safety and cannot be used for general purposes. To ensure proper tracking of these funds for required reporting purposes and transparency, staff is recommending a new special revenue fund be set up to hold these funds. The new fund will be titled Public Safety Additional Aid Fund and will serve as a dedicated source of funding to support expenditures that are eligible under the legislation. Any asbestos removal necessitated by work described in this Proposal will be the Purchaser’s responsibility. Purchaser shall provide documentation that the asbestos has been abated from the KONE work area and air clearance reports shall be made available upon request. Purchaser is responsible for all costs of oil disposal should it be determined that oil from Purchaser’s equipment is contaminated. KONE undertakes to perform this work in conformity with the usual applied codes and standards, however, no guarantee can be made that all code violations or defects have been found. This work is not intended as a guarantee against failure or malfunction of equipment at any future time. It is agreed and understood that KONE is not responsible for damages, either to the vertical transportation equipment or to the building, or for any personal injury or death, arising from or resulting from any code required safety tests performed on this equipment. Nothing in this agreement shall be construed to mean that KONE assumes any liability of any nature whatsoever arising out of, relating to or in any way connected with the use or operation of the equipment described above. Purchaser shall be solely responsible for the use, repair and maintenance of the equipment and for taking such steps including but not limited to providing attendant personnel, warning signs and other controls necessary to ensure the safety of the user or safe operation of the equipment. Neither KONE nor its affiliates, subsidiaries or divisions shall be responsible or liable for any damages, claims, suits, expenses and payments on account of or resulting from any injury, death or damage to property arising or resulting from the misuse, abuse or neglect of the equipment herein named or any other device covered by this contract. It has further determined that the loss of shade trees growing upon public and private property would substantially depreciate the value of property within the city and impair the safety, good order, general welfare and convenience of the public. Over the last few years the City has been working with around a hundred property owners to get diseases trees removed. Of the properties contacted over the last year, fourteen properties with confirmed shade tree diseases have not responded to any City correspondence or removed the diseased tree(s). As of April 1, 2024, the trees had not been removed. Since the City has contacted the properties multiple times over the last 6 months and received no action, they are coming to Council for abatement consideration. City Code provides a process for which the Council needs to declare these diseased trees to be nuisances so that the City can remove them. The process states that the City must notify the property owner, provide the property owner the opportunity to speak directly to the Council at the Council meeting, after which point the Council may take action to declare the tree a nuisance and order it abated. The prohibition applied to those areas defined in the interim ordinance as being a public place, which was limited to public parks, rights-of-way, or city owned parking lots. The prohibition was temporary and directed staff to review and make recommendations regarding a permanent ordinance to address this issue. As part of the new cannabis legislation, local governments were expressly authorized by Minnesota Statutes, section 152.0263, subdivision 5 to adopt an ordinance to prohibit cannabis use in public places. Instead of attempting to define what constitutes a “public place,” the legislature instead set out what could not be considered a public place: (1) a private residence, including the person’s curtilage or yard; (2) private property not generally accessible by the public, unless the person is explicitly prohibited from consuming cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products on the property by the owner of the property; or (3) the premises of an establishment or event licensed to permit on-site consumption. By implication, any place in the City that is not one of the above could be considered a public place. When discussing the interim ordinance, the City Council agreed with staff’s comments that attempting to apply the prohibition to all other areas of the City was too broad and, instead, it should be limited to publicly owned places like parks, streets, and public parking lots. 7.6(a) As directed in the interim ordinance, staff has considered the City options as to the scope of the prohibition. As previously discussed, the cannabis legislation already prohibits the use of cannabis products through inhalation of smoke, aerosol, or vapor at any place where smoking is prohibited under Minnesota Statues, section 144.414 (Clean Indoor Air Act). Minn. Stat. § 342.09, subd. 1(b)(3). Therefore, staff recommends the permanent prohibition on the public use of cannabis continue to be limited to same publicly owned places. The attached ordinance places the prohibition in a new Section 635 of the City Code and contains the same prohibition imposed by the interim ordinance. The enclosed ordinance is before the City Council for a second reading. Public Use of Cannabis. Chapter VI of the Crystal city code is hereby amended by adding a new section 635 as follows: Section 635 – Prohibiting the use of cannabis products in public places 635.01. Definitions. For the purposes of this section, the terms defined in this subsection have the meaning given them. If a term is not defined herein, it shall have the meaning given it in Minnesota Statutes, section 342.01. To the extent any of the following terms are specifically defined in the rules subsequently adopted by the Minnesota Office of Cannabis Management, the definition set out in the rules shall be controlling. Subd. 1. Cannabis product. “Cannabis product” means any of the following: cannabis flower; cannabis products; lower-potency hemp edibles; or hemp-derived consumer products, as each are defined in Minnesota Statutes, section 342.01. Subd. 2. Park. “Park” means any public park, playground, sports field, open space, swimming pool, community center, or other recreational area or facility. Subd. 3. Parking lot. “Parking lot” means any state, county, or city owned parking area that is made available to the public for parking. Subd. 4. Public place. “Public place” means any public park, right-of-way, or parking lot. The term does not include any of the following: a private residence, including the person's curtilage or yard; private property not generally accessible by the public, unless the person is explicitly prohibited from consuming cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products on the property by the owner of the property; or the premises of an establishment or event licensed to permit on-site consumption. Subd. 5. Right-of-way. “Right-of-way” means the entire area within a public roadway, highway, street, cartway, bicycle lane, trail, and public sidewalk. 635.03. Prohibition. No person shall consume or otherwise use a cannabis product in a public place within the city. 635.05. Penalty. A violation of this section is a petty misdemeanor and is subject to a fine of not more than $300. 7.6(a) ARTICLE II. Effective Date.
