The Council will consider the following items, which are routine and non-controversial in nature,

4.1 Approval of the minutes from the following meetings:

4.2 Approval of the list of license applications submitted by the city clerk to the City Council, a
list that is on file in the office of the city clerk.
4.3 Adoption of a resolution accepting a donation.

5. Open Forum
The City Council appreciates hearing from citizens about items of concern and desires to set aside
time during each meeting for Open Forum. To provide ample opportunity for all, speaking time is
limited to three minutes and topic discussion is limited to 10 minutes. The Mayor may, as presiding
officer, extend the total time allowed for a topic. By rule, no action may be taken on any item
brought before the Council during Open Forum. The Council may place items discussed during
Open Forum onto subsequent council meeting agendas.

6. Public Hearing
6.1 The Mayor will open a public hearing to receive comment, and the Council will consider
approval of a new on-sale wine and beer license for Family Café and Diner, LLC d/b/a Family
Café and Diner located at 6236 56th Ave. N.
Pedro V. Torres, owner of Family Café and Diner, LLC d/b/a Family Café and Diner, is
requesting new on-sale wine, beer, and Sunday liquor licenses for 6236 56th Ave. N. All the
required paperwork is in order and the background check has been completed. After taking
public comment, staff recommends approval of the new liquor licenses.
7. Regular Agenda
7.1 The Council will consider approval of disbursements over $25,000 submitted by the finance
department to the City Council, a list that is on file in the office of the finance department.
Recommend approval of disbursements over $25,000.
7.2 The Council will consider civil penalties for violation of tobacco license regulations by Abi
Saab and Sons for Liquor, LLC d/b/a Crystal Wine and Spirits located at 4920 West Broadway.
During routine tobacco license compliance checks last September, an employee at Crystal
Wine and Spirits sold tobacco to a minor. The employee did not appear in court and is still
subject to the individual penalty. Typically, the city waits to consider a civil penalty on the
licensee following the individual phase. However, the City Council may consider civil
penalties for the licensee any time following a violation. In this case, staff recommends
proceeding with the licensee’s civil penalty consideration instead of waiting for the
individual employee’s case to conclude due to the uncertainty of when that may occur.
This is a first tobacco violation for Crystal Wine and Spirits, and according to the City Code,
the City Council may impose civil penalties of up to a $750 fine and a one-day license
suspension. Prior to acting on the civil penalties, the City Council should hear any
comments from the representative(s) of Crystal Wine and Spirits, including whether the
licensee admits to the violation.
7.3 The Council will consider a resolution authorizing the purchase of Public Works Security
Cameras – Capital Replacement.
The city is seeking to transition all the security cameras at the Public Works facility over to
the Verkada cloud-hosted system that we previously did for the recreation and utility
location cameras. Because this is a single-source item, the city did not obtain additional
quotes. We have been pleased with the product so far. It should be noted that the City of
Robbinsdale, the West Metro Fire-Rescue District, and the Joint Water Consortium also
have recently selected the Verkada system. The city budgeted $50,000 in the IT Fund for
this security work in 2023 as part of the long-term plan, so this purchase will be $7,110
under budget. Staff recommends adoption of the resolution approving the purchase of the
Verkada IP Security Cameras for Public Works.

7.4 The Council will consider a resolution authorizing the purchase of a tractor backhoe.
The city’s current tractor backhoe, which is a 2003 model, is used widely year-round in
various applications. Based on the Vehicle Condition Index rating, the backhoe should be
replaced immediately. The city budgeted $250,000 for a replacement in 2023, and the state
contract price for a replacement unit is $37,343.32 under budget. The current lead time for
order fulfillment is six months to a year. Staff recommends adoption of the resolution
approving the purchase of the tractor backhoe from Ziegler Cat in the amount of
$212,656.68.
7.5 The Council will consider a resolution authorizing the professional services agreement for the
2024 Utility Reconstruction Project.
Staff has received a proposal from SEH for professional services associated with the 2024
Utility Reconstruction project including everything from surveying and design through
bidding and construction services, which will include a field project representative on-site
during the entire project. The proposal has a not-to-exceed cost of $386,839. Due to this
being a joint project with New Hope, staff is still working out the cost-sharing agreement for
these services and will present that to the council at later date. Staff recommends adoption
of the resolution authorizing the agreement for professional services with SEH, Inc. for the
2024 Utility Reconstruction project.
8. Announcements
a. City Council vacancy interviews will be held during the work session following tonight’s regular
meeting.
b. The next City Council meeting is Tuesday, April 18 at 7 p.m. in the Council Chambers at City
Hall and via Zoom.
c. Metropolitan Airports Commission will hold a series of meetings at the Crystal Community
Center on Wednesday, April 19 regarding a proposed Crystal Airport Zoning Ordinance. There
will be an open house from 4:30-5:30 p.m., a presentation from 5:30-6 p.m. and a public
hearing starting at 6 p.m.
d. City Council meetings and work sessions are open to the public. Current and previous
meetings are available for viewing and listening at www.crystalmn.gov.

WHEREAS, Public infrastructure in the City of Crystal is an integral
part of our citizens’ everyday lives; and
WHEREAS, the health, safety, and comfort of residents, visitors, and
businesses is greatly dependent on public infrastructure and services;
and
WHEREAS, support from an encouraging, understanding, and
informed citizenry is vital to the efficient operation of Public
infrastructure systems and programs including transportation, buildings
and facilities, parks and forestry, water supply and treatment, sanitary
sewers, and surface water management; and
WHEREAS, crystal’s public works department is committed to
the mission of quality design, construction, operation, and maintenance
of the city’s public infrastructure; and
WHEREAS, continued community support and resources are essential
for the public works department to carry out its mission.

SUBJECT: MAC Special Assessment
Summary
At the October 18, 2022 Council Meeting the Council cancelled the Special Assessments on two Metropolitan
Airport Commission (MAC) properties totaling $380,290.69. The assessment for 60th Ave in the amount of
$98,585.47 remained in place.
Since that time, MAC has paid the County $98,585.47. However, since MAC had taken no action prior to late
2022, they had incurred $24,796.13 in penalties and interest.
Because MAC has occurred penalties and interest from the City assessment, the County cannot just remove
those charges. In talking with County staff, the most efficient way to clear this up is for the City Council to
cancel the special assessment, which in turn would void the penalties and interest. Then the County would
issue a check directly to the City in the amount of $98,585.47. Basically, taking the approach that MAC should
have paid the City directly instead of the County.

RESOLUTION CANCELLING ASSESSMENT IMPOSED ON
METROPOLITAN AIRPORTS COMMISSION FOR 60TH AVENUE
WHEREAS, the City of Crystal (“City”) has imposed special assessments on a
property owned by the Metropolitan Airports Commission (“MAC”) in accordance with
its usual procedures and as is authorized by Minnesota Statutes, section 435.19,
subdivision 2 (“Act”) which indicates property owned by the state and its
instrumentalities are subject to special assessments; and
WHEREAS, in 2017 the City imposed an assessment in the amount of $98,585.47
on MAC property (PID 05-118-21-14-0001) located at 5900 Lakeland Avenue North for
improvements to 60th Avenue North (“60th Ave. Assessment”); and
WHEREAS, MAC asserts it is an “instrumentality” of the state under the Act and
is authorized to determine for itself the amount of benefit its properties receive from a
City improvement project; and
WHEREAS, MAC determined its property was benefited by the improvement in
the amount of $98,585.47 and agreed to pay the 60th Ave. Assessment in that amount;
and
WHEREAS, MAC recently paid the agreed to amount for the 60th Ave.
Assessment, but the $24,796.13 in interest and penalties that accrued since it was
imposed remain unpaid on the County’s system; and
WHEREAS, City staff has worked with the County to determine how to remove
the interest and penalties from the MAC property and the County recommended the City
cancelling the 60th Ave. Assessment, which would automatically cancel the penalties and
interest, and then the County would pay the $98,585.47 is received from MAC directly to
the City to satisfy the 60th Ave. Assessment; and
WHEREAS, the City Council determines it is in the best interests of the City to
clear the interest and penalties amounts that MAC did not agree to pay from the MAC
property using the approach recommended by the County.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Crystal,
Minnesota as follows:

Background
A portion of the fuel tax collected by the State is remitted to Cities to assist with maintenance and
construction of city streets that are designated as State Aid routes. This process is managed by the Minnesota
Department of Transportation’s Office of State Aid. In 2023, the City received $250,584 in maintenance
allotment and $751,750 in construction allotment.
In 2017, the City did an Advance for $3,101,780 which closed out many of the past Street Reconstruction
Projects. At the time, this provided funding to start the Street Maintenance Fund as part of the Long Term
Plan. It is proposed that the City do another Advanace in MnDOT State Aid funding for $1,549.137.14 to close
out the remaining Street Reconstruction Projects. Basically, while it is called an “Advance” in our situation the
City is collecting on past IOU’s from the State for projects we have already completed. By taking this approach,
the City collects the money sooner and it goes into the Street Maintenance Fund (where we earn interest).
Between this advance ($1,549.137.14) and a cash out of the existing City State Aid fund balance ($1,275,371)
the City will be receiving $2,824,508.14. This income is already included in the Long Term Plan assumptions.
Based on State Aid rules, the City can request up to $3,758,750 in advance funding from the City’s
construction annual allotment. This amount is determined either by the rules maximum of $4,000,000 or what
the City would have received for the next five years (assuming no increase in future year’s construction
allotment).
Summary
If Council approves the advance:
-City will continue to receive $250,584 in maintenance allotment yearly
-City will collect $2,824,508.14 this year in a lump sum. The next, roughly 2 years of construction
allotments will then go to credit the advance portion ($1,549.137.14). It should be noted there are no
interest or other charges/penalties with taking an advance.
If no Council action is taken and assuming the amount the City gets from State Aid does not change:
-City will continue to receive $1,002,334 per year ($250,584 maintenance, $751,750 construction)
-At $751,750 it will take two years for the City to collect the $1,549.137.14 advance that is proposed to
be collected at one time, this year.

restaurants with on-sale liquor are a permitted use in this district.
Staff has reviewed the liquor license application materials. A background check was completed by the
police department and Police Chief Revering finds no reason to prohibit issuance of the license.
A public hearing notice was published in the SunPost on March 23, 2023 (Attachment A).
The proposed hours for the restaurant are as follows:

Background
Late last year, annual tobacco compliance checks were conducted at licensed tobacco establishments by
Crystal Police Department. Consequently, Crystal Wine and Spirits did not pass this compliance check.
An employee of the business sold tobacco to a minor, which is a violation of state law and Crystal
City Code § 1105.13, Subd. 2. Moreover, the employee of the business has failed to appear in court
for this offense and is still subject to the individual penalty.
The attached notice was emailed and mailed to the tobacco licensee on March 16, 2023.
This is considered a first tobacco violation for this licensee.
Requested City Council action
Consistent with City Code and Resolution No. 2020-83, staff recommends Crystal Wine and Spirits
receive a one-day license suspension and civil fine of $750 with the city clerk determining the date
of the license suspension and payment date of the fine.

1105.13. Administrative civil penalties.
Subd. 1. Individuals. A person who sells, gives or otherwise furnishes a covered product to a person
under the age of 21 years is subject to an administrative penalty identified in Crystal city code, appendix
IV, after the individual has received notice, served personally or by mail, of the alleged violation and been
provided an opportunity for a hearing.
Subd. 2. Licensee. If a licensee or an employee of a licensee is found to have sold, given or
otherwise furnished a covered product to a person under the age of 21 years, or committed a violation of
Minnesota Statutes, chapter 297F, the city council shall impose administrative penalties on the licensee as
provided in Crystal city code, appendix IV. Prior to imposing an administrative penalty the city shall
provide the licensee written notice of the alleged violation and provide an opportunity for the licensee to be
heard by the city council.
Subd. 3. Defense. It is an affirmative defense to a charge of selling, giving or otherwise furnishing
a covered product to a person under the age of 21 years in violation of this section that the licensee or
individual making the sale relied in good faith upon proof of age as described in Minnesota Statutes, section
340A.503, subdivision 6.
Subd. 4. Education and training. In addition to or in lieu of any other penalty imposed under this
section, any person under the age of 21 years who purchases, possesses, or consumes a covered product
shall attend an educational seminar approved by the chief of police regarding the legal and medical
implications of using a covered product.
Subd. 5. Presumptions regarding administrative penalties. Though the administrative penalties
described in this subsection are presumed, in no event shall the amount of any fine or period of suspension
be less than the amounts and periods required in Minnesota Statutes, section 461.12, subdivisions 2 and 3.
Other mandatory requirements may be made of the business including, but not limited to, meetings with
law enforcement to present a plan of action to ensure the problem will not continue, mandatory education
sessions with crime prevention staff, or other actions the city council may deem appropriate.
1105.15. Compliance monitoring.
Subd. 1. Compliance checks. As required by Minnesota Statutes, section 461.12, subdivision 5,
the police department shall at least once a year perform compliance checks at each location licensed under
this section to sell a covered product. License applicants may be informed of this policy at the time of
license application and renewal. Violators of this section may be subject to more frequent compliance
monitoring than non-violating licensees. The police department may annually report to the city council the
results of said compliance checks.

Subd. 2. Exemption. A person no younger than 17 nor older than 20 may be enlisted by the police
department to assist in the compliance checks. If the person is under the age of 18, no such person may
conduct compliance checks unless the police department obtains written consent from the person’s parent
or guardian and the person must at all times act only under the direct supervision of a law enforcement
officer, an employee of the licensing department, or in conjunction with an in-house program that has been
pre-approved by the police department. A person who purchases or attempts to purchase tobacco while
acting in this capacity is exempt from any penalties related to said purchase or attempt to purchase.
Subd. 3. Additional checks. If a licensee or employee of a licensee is guilty of a second violation
within the 24-month period since the initial violation, the police department must conduct at least one
compliance check at that licensed premises within the time remaining in that 24-month period.
1105.17. Signage and age verification required.
Subd. 1. Signage. At each location where tobacco, tobacco-related devices, electronic delivery
devices, or nicotine or lobelia delivery products are sold, the licensee shall display a sign in plain view to
provide public notice that selling any of these products to any person under the age of 21 is illegal and
subject to penalties. The notice shall be placed in a conspicuous location in the licensed establishment and
shall be readily visible to any person who is purchasing or attempting to purchase these products. The sign
shall provide notice that all persons responsible for selling these products must verify, by means of
photographic identification containing the bearer’s date of birth, the age of any person under 30 years of
age.
Subd. 2. Age verification. At each location where tobacco, tobacco-related devices, electronic
delivery devices, or nicotine or lobelia delivery products are sold, the licensee shall verify, by means of
government-issued photographic identification containing the bearer’s date of birth, that the purchaser or
person attempting to make the purchase is at least 21 years of age. Verification is not required if the
purchaser or person attempting to make the purchase is 30 years of age or older. It shall not constitute a
defense to a violation of this subdivision that the person appeared to be 30 years of age or older.

Computer Integration Technologies to provide a one-for-one transition to cloud-
hosted Verkada IP security cameras.
The security cameras, mounting equipment, and installation services in this quote
were budgeted for as planned capital replacement items in the 2023 long-term plan.
Upgrading our cameras and transitioning to cloud-hosting will allow us to better
secure and protect our facilities – while also offering us more robust capabilities
and easing the administrative burden on staff.
We transitioned our recreation cameras to Verkada last year, and have been
outfitting utilities locations with them as fiber runs have been completed. By
transitioning the rest of the Public Works cameras to Verkada, staff will be able to
monitor all locations through one system. Additionally, Verkada offers multi-
tenant operations, so our staff are also able to monitor partner agencies (West
Metro Fire).
Computer Integration Technologies was able to obtain a price of $42,890 for
replacement of the public works cameras. We have $50,000 alotted for this work in
the building access control and security portion of the IT fund.

SUBJECT: Purchase of replacement tractor backhoe
Background
The 2024 Long Term Plan includes the replacement of the tractor backhoe and attachments (#420)
and has $250,000 allocated for this purchase. The City purchased the existing tractor backhoe used (it
is a 2003) from the City of New Hope in 2018 for $28,500. The tractor backhoe is used year-round for
a wide variety of tasks including various utility repairs, digging out catch basins in the winter, and
general excavating. The hydraulic arm on the back of the unit can hold a jackhammer, various bucket
types, and plate tamper (among other attachments).
The existing tractor backhoe scored a 29 on the Vehicle Condition Index. Based on the Vehicle
Condition Index, scores in the range of 23-27 are qualified replacement; anything above 28 should be
immediately considered for replacement.
The new tractor backhoe will be purchased off of the 2023 Sourcewell Cooperative Purchasing
agreement (Contract 032119-CAT) for the price of $212,656.68 from Ziegler CAT. This purchase cost
includes a trade in credit of $21,325 for the existing tractor backhoe.
Overall, the purchase will be under budget by $37,343.32. We have been told that the lead time on a
tractor backhoe is 6 months to a year, hence the reason for bringing this to Council now.

APPROVING THE PURCHASE OF A
REPLACEMENT TRACTOR BACKHOE
WHEREAS, the Crystal City Council is committed to providing and maintaining quality
infrastructure that is essential for everyday residential, commercial, industrial, and recreational activities
in the City; and
WHEREAS, a tractor backhoe is used year round in various types of common public works
operations and projects; and
WHEREAS, the existing tractor backhoe scored for replacement under the Vehicle Condition
Index; and
WHEREAS, adequate funds are available in the Fleet Service Fund for this purchase;
NOW, THEREFORE, BE IT RESOLVED that the Crystal City Council hereby approves the
purchase of tractor backhoe from Ziegler CAT for $212,656.68.
BE IT FURTHER RESOLVED that the Crystal City Council hereby approves the trade in of
the existing tractor backhoe as part of this purchase.

SUBJECT: Authorize professional services for 2024 Utility Reconstruction Project
Summary
Staff has received a proposal from Short Elliott Hendrickson, Inc. (SEH) for professional services associated
with the 2024 Utility Reconstruction project, dated March 23, 2023. The professional services will include
everything from surveying and design through bidding and construction services which will include a field
project representative on site during the entire project. The proposal includes a not to exceed cost of
$386,839.
Staff has reviewed the proposal from SEH and found it to be accurate and in order with previous work they
have provided during the street reconstruction and utility reconstruction projects.
Project Location
The 2024 Utility Reconstruction Project will include Louisiana Ave N from Medicine Lake Road to 32nd Ave
(roughly the west half of the road is in New Hope) and 31st Ave cul-de-sac to the west of Louisiana Ave N
(entirely New Hope).
Cost Sharing
In the past, projects on shared roads have included 20% (of the total project cost) administrative fee to the
City not managing the contract (in this case New Hope). However, this project is different because one of the
streets included is entirely in New Hope. City staff are working with staff from New Hope to figure out an
equitable cost sharing of this professional service agreement. The cost sharing will be part of the agreement
between New Hope and Crystal.

Dear Mark:
Short Elliott Hendrickson Inc. (SEH®) is pleased to submit our Supplemental Letter Agreement (SLA) for
the 2024 Utility Reconstruction project. If accepted, this SLA describes how we will provide design,
bidding and construction phase services for a not-to-exceed fee of $386,839.00. This amount is detailed
in the attached Task Hour Budget (THB) and includes our reimbursable expenses. We will bill the City
monthly for reimbursable expenses and on an hourly basis for labor. We will provide these services in
accordance with our Agreement for Professional Services dated January 15, 2019 (Agreement).
During the course of the construction phase, we will bill the City monthly for services, expenses, and
equipment. This financial arrangement is based on the orderly and continuous progress of the project. If
the contractor fails to complete work by the specified date, and/or the scope of work is changed, SEH will
invoice our services an additional amount on an hourly basis plus expenses in accordance with previously
agreed upon rates.
Based on the feasibility study recently completed by SEH in 2019, one (1) street segment was identified
for utility and street reconstruction: Louisiana Avenue between Medicine Lake Road and 32nd Avenue.
City staff also requested that the 31st Avenue cul-de-sac in New Hope be added to the project scope.
Because this segment was no included in the feasibility study, a topographic survey was not completed.
We have included the supplemental topographic survey required that will be completed this spring.
Louisiana Avenue will be narrowed from 40-feet wide to 32-feet wide with the potential to add a trail or
sidewalk to one side. We assume that the 31st Avenue cul-de-sac will similarly be narrowed. Because
Louisiana Avenue will be narrowed, we also assume that any retaining walls required will be small
enough that detailed geotechnical or structural design is not required.
Included in our scope of services are tasks to meet the requirements associated with the MS4 permit. We
will complete an analysis of the stormwater drainage within the project area and will present City staff with
various treatment device alternatives (including pros/cons and estimated cost). The selected device will
then be implemented during construction. Because Louisiana Avenue is a Municipal State Aid roadway,

we will complete stormwater calculations including spreads and storm sewer main capacity and submit all
required documentation to State Aid for review and approval.
The cul-de-sac storm sewer system outlets into the pond immediately north of 31st Avenue and we
propose to complete a field delineation of the wetlands. We assume that we will only replace the catch
basins and main between the catch basins (and not to the outlet into the pond) to avoid the need for
wetland permitting. Because the City of New Hope has also requested that the storage capacity of the
pond be analyzed, we will complete a delineation in the event the pond will require modification. However,
for the purposes of this proposal, we assume that modification will not be required.
Because the project area is adjacent to several businesses with access from Louisiana Avenue or 31st
Avenue, we have included two design meetings with representatives from these entities to discuss
construction staging, schedule, and access requirements.
It is understood that this is a joint project between the Cities of Crystal and New Hope. We assume City of
Crystal staff will be our main contacts for the project. We have included time for up to two design
meetings with City of Crystal and City of New Hope staff to review the design, phasing, and schedule.
Louisiana Avenue is also a Municipal State Aid route, which will require design documents to be reviewed
by State Aid staff prior to final approvals.
Major differences between this project and the 2020 through 2023 Utility Reconstruction projects include
the 31st Avenue cul-de-sac pond topographic survey and spread capacity analysis and preparing the
submittal package for Municipal State Aid review, which requires the completion of catch basin spread
and storm sewer capacity calculations, bituminous pavement design, and intersection/ADA pedestrian
ramp design.
We will start our services promptly after receipt of your authorization of this Agreement. We anticipate
conducting our work to match the following approximate production schedule.

AUTHORIZING PROFESSIONAL SERVICES CONTRACT FOR THE
2024 UTILITY RECONSTRUCTION PROJECT
WHEREAS, the maintaining and reconstructing City infrastructure is an essential service
in the City of Crystal; and
WHEREAS, SEH, Inc. provided professional services for the entire Street Reconstruction
Program which lasted over 20 years and the Utility Reconstruction Projects; and
WHEREAS, the City has developed a long-term plan for reconstruction of the City’s
water, sanitary sewer, and storm water infrastructure; and
WHEREAS, a portion of the work will be in the City of New Hope and New Hope has
budgeted funds accordingly for this project; and
WHEREAS, the cost sharing with the City of New Hope is being determined and will be
finalized in the cooperative agreement between the two cities; and
WHEREAS, SEH, Inc. has completed the feasibility study for this area; and
WHEREAS, the equipment and staffing required for the design of such projects is
beyond the in-house capability of the City;
NOW, THEREFORE, BE IT RESOLVED that the Crystal City Council hereby
authorizes the agreement for professional services with SEH, Inc. for the 2024 Utility
Reconstruction project.
BE IT FURTHER RESOLVED that the Mayor and/or City Manager are hereby
authorized to sign such contract.
Adopted by the Crystal City Council this 4th day of April, 2023.
