Moved by Counci imeamber Moravec and seconded by Councilmember Herbes to
enter into acreement with Brutger Companies for the purpose of guaran-
teeing faithful performance for certain work requirements as a condition
of issuance of building permits T6888 and 16889 for Cedarwood Court i
Apartments, and further, to authorize the Mayor and City Manager to
sign such agreement. Motion Carried.
The City Council considered a resolution approving Laws, 1985, Chapter

WHEREAS, Laws, 1985, Chapter 193 entitled "An Act Relating to the
City of Crystal; Regulating the Holding of Public Offices by Council -
members; Providing for the Adoption of Emergency Ordinances" requires
approval by the majority of the Council of Crystal before it becomes
effective,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Crystal that Laws, 1985, Chapter 193, is hereby adopted.

The City Council discussed fertilizer in Twin Lake.
Moved by Councilmember Schaaf and seconded by Councilmember Moravec to
refer this matter to the Environmental Commission. Motion Carried.
The City Council considered the Second Reading of an ordinance amend-
ing provisions of the zoning code relative to, accessory buildings on
property abutting Twin Lake.
Moved by Councilmember Pieri and seconded by Councilmember Moravec to
adopt the following ordinance:

RE: Special Law enacted for the City of Crystal
Minnesota Statutes 645.021 require me to submit a copy of the
resolution adopted by the City Council after enactment of the
special law which was requested by our Council.
A resolution of approval is necessary for the law to become
effective. I have attached a copy of a resolution for the
Council to consider which will accomplish what is required.
Also attached is a copy of the Act which was adopted by the
Legislature. Noice it does have a sunset clause.

January 22, 1985
TO WHOM IT MAY CONCERN:
Following is an extract of the minutes of the regular meeting of the
City Council held on January 15, 1985:
Moved by Councilmember Moravec and seconded by Councilmember
Pieri to adopt the following resolution, the reading of which
was dispensed with by unanimous- consent:
RESOLUTION NO. 85-6
RESOLUTION SUPPORTING SPECIAL LEGISLATION
REGARDING CHARTER CHANCES
BE IT HEREBY RESOLVED by the City Council of the City of
Crystal, Minnesota, as follows:
1. The City Council of the City of Crystal finds that cer-
tain provisions of the City Charter are obsolete and inhibit
the sound administration of City Government.
2. The Council has further determined that the City Char-
ter Commission is inactive and has not functioned for several
years-.
3. It is further determined that it is in the best inter-
ests of the City that such obsolete provisions be removed from
the Charter.
4. This Council respectfully requests the Minnesota Legis-
lature to enact special legislation substantially in the form
attached hereto as "Exhibit A" to carryout the purposes of this
resolution.
5. The City Manager is authorized and directed to transmit
a certified copy of this resolution to the members of the Legis-
lature representing the City of Crystal.
By roll call and voting aye: Smothers, Herbes, Pieri, Moravec,
Rygg, Aaker; absent, not voting: Schaaf. Motion carried, reso-
lution declared adopted.
A Bill for an Act
Relating to the Government of the
City of
Crystal, Minnesota
HE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. 1COUNCILMEMBER OFFICES] No the
provisions of Section 3.0.2 of the Charter of the City of Crystal
a member of the Crystal City Council may hold any other public
office not incompatible with the office of member of the City
Council.
Sec. 2. [EMERGENCY ORDINANCES] Notwithstanding the pro-
visions of Section 3.06 of the Crystal City Charter an emergency
ordinance may be adopted by the City Council by a vote of a ma-
jority of all of its members.
Sec. 3. [EFFECTIVE DATE] This act is effective on the
day following compliance by the -governing body of the City of
Crystal with Minnesota Statutes, Section 645.021, Subdivision
3.
