3. PUBLIC HEARING
a. Site plan request from Gernco Construction for a new four-unit residential building at
4741 Welcome Avenue North (Application 2021-06).
Olson presented a summary of the staff report and stated he is recommending
approval of the site plan.
Chair Selton opened the public hearing.
Commission member Maristany asked where snow storage will occur. Olson said
there are areas on both sides of the driveways where snow could be stored.
Maristany asked how big the proposed trees will get. Olson said that the Japanese
tree lilac is fairly small. He was not sure how tall the American Linden and Coffee tree
will get. Commission member Sears added that it will take many years for the trees to
achieve full growth.

Commission member Strand asked if the units will be owned or rented. Olson said the
applicant is proposing to own the four units and live in one of them while renting out
the other three units. However there is no mandate that the applicant live in one of the
units.
Mr. Okeakpu of Gernco Construction said he’s planning on living in one of the units
with his family.
A Crystal resident said she lives near the property. She said the alley has become
busier the last few years. She asked how far the garages will be from the alley. Olson
said 30’ from the property line along the alley, which is typically the edge of the
pavement. She asked if each unit will have its own refuse collector. Mr. Okeakpu said
his plan is to have one collector for all the units.
Commission member Seffren asked how the applicant could sell the units rather than
renting them. Olson said the applicant could do what’s called a Common Interest
Community (CIC) plat so that each unit could be sold.
Hearing no one else from the public who wished to speak, Selton closed the public
hearing.
Moved by Strand and seconded by Sears to recommend approval to the City Council
of the site plan application for Gernco Construction at 4741 Welcome Avenue North.
Ayes: All. Nays: None.

a. Conformance to Comprehensive Plan – sale of 4824 – 56th Avenue North
Planner Olson presented a summary of the staff report and stated staff is recommending that
the Commission determine the sale of the lot is in conformance to the Comprehensive Plan.
Maristany asked if there is a site plan for the two-family dwelling. Olson said not at this time,
but it is anticipated the EDA will authorize an RFP and after that a builder will submit a site
plan to purchase the lot. Since a two-family dwelling is a permitted use that does not require
site plan approval, the only public hearing process will be by the EDA for the lot sale.
Moved by Seffren and seconded by Maristany to determine that the sale of the lot is in
conformance to the Comprehensive Plan. Ayes: all. Nays: None.
b. Select member and alternate for Joint Airport Zoning Board (JAZB)
Planner Olson presented a summary of the staff report and asked that the Commission
select a member and alternate for the JAZB.

JAZB to provide information to those who are not familiar with airport operations. Olson
said that staff from MAC will be on the JAZB, and they have retained an airport

Olson said he is not sure there will be an October meeting, but that the application
deadline is not until tomorrow.

Commission member Strand updated the Commission on the construction progress for
the Suite Living of Crystal assisted living at 3500 Douglas Dr.
Commission member Heigel asked when the new police station will be completed. Olson
said it should be completed by the end of summer, 2022.

A. BACKGROUND
Scott Endres, owner of 5736 Lakeland Avenue North, is proposing to construct a new
10,700 square foot vision clinic on the vacant property. The property is zoned
Commercial (C) and medical clinics are a permitted use within that zoning district. The
city’s unified development code (UDC) requires site plan review and approval for the
new building and site improvements. The applicant is also requesting a variance to
exceed the maximum number of allowed parking spaces on the property.
Notice of the October 11 public hearing was published in the Sun Post on September
30, mailed to owners and renters within 500 feet (see attachment A), and posted to the
Skyway, Twin Oaks, North Lions, and Becker neighborhoods on Nextdoor. A sign was
also posted on the property.

B. SITE PLAN REVIEW
Existing use
The 46,747 sq. ft. (1.1 acre) property is vacant. The previous commercial building on the
property, constructed in 1975 and most recently used as a grocery store, was
demolished in 2011.
Adjacent uses
The following are the existing land uses and zoning districts surrounding this property:
• North – Crystal Airport
• East – Single family homes, zoned R-1.
• West – Across County Highway 81, single family homes, zoned R-1
• South – Crystal Medical Center, zoned Commercial
Proposed use
The applicant is proposing to construct a 10,700 square foot vision clinic. The clinic will
be on the 9,453 sq. ft. main floor, with a 1,255 sq. ft. partial upper floor for storage and
mechanical equipment. The property will be re-addressed as 5730 Bottineau Boulevard
because the frontage road, Lakeland Avenue North, no longer exists in this location. The
following are the notable site plan elements for this clinic:
• Building setbacks and height. The proposed building meets setback requirements
in the Commercial district. The building will have varying heights, but will meet the
maximum building height of 60’. The main floor will be approximately 14’ in height
and the portion with an upper floor will be approximately 26’ in height.
Although the building is not tall, it is located close to the Crystal airport. The
applicant has notified the Federal Aviation Administration (FAA) of the proposed
building construction. Typically with a building of this height the FAA will require
approval of any construction cranes that may be needed. Staff recommends a
condition of site plan approval that the FAA give final approval prior to building
permit issuance.
• Parking. The maximum number of parking spaces set by the UDC is 52, but the
applicant is requesting a variance to construct 57 parking spaces on the property
(see section D for additional information about the variance request). The parking
lot meets UDC requirements for setbacks, and parking space and aisle dimensions.
• Stormwater management and erosion control measures. The applicant is proposing
to construct a stormwater infiltration basin on the east side of the building which is
designed to accommodate additional stormwater runoff created by this new building
and parking lot. After the site improvements are constructed the percentage of
impervious surface on the property will be 69% (the maximum coverage is 85% for
the commercial zoning district). During building construction, the city will require
erosion control techniques to be used on-site including silt fences, a rock
construction entrance, and inlet protection.
• Utilities. The proposed building will connect to an existing water main in Bottineau
Boulevard and an existing sanitary sewer main in Colorado Avenue. Hennepin

County will require the applicant to obtain a right-of-way permit for utility work done
in Bottineau Boulevard.
• Access and circulation. The proposed clinic will have driveway access off of
Colorado Avenue. The city’s Public Works Director and the West Metro Fire
Rescue District staff have reviewed the traffic circulation plan and found it adequate
to meet vehicle movement into and within the site, including fire trucks.
There are no existing public sidewalks on the property and none planned. However
there are proposed private sidewalks from the building entrance to parking areas.
Adjacent to the property, along Bottineau Boulevard, is the Crystal Lake Regional
Trail which connects Crystal to Robbinsdale and Brooklyn Park.
• Building elevations. The proposed major exterior building material is brick with
“exterior insulation finishing system” (EIFS), masonry, and metal panels as accent
materials. These materials meet the city’s requirements. Elevation drawings of the
proposed building is attachment D.
• Landscaping. No trees will be removed to accommodate the new building or
parking lot. The applicant proposes to plant five new species of trees
(Accolade Elm, Hackberry, Imperial Honeylocust, Renaissance Reflection Birch,
and Red Jewel Crabapple) together with five varieties of shrubs.
• Screening. Trash and recycling receptacles will be screened by a dumpster
enclosure west of the building. Rooftop mechanical equipment will be screened
using parapet walls. The parking lot will be screened from the single-family homes
across Colorado Avenue by trees and shrubs.
• Exterior Lighting. There are no existing light poles on the property, but four new
light poles are proposed in the parking lot. Three new wall lighting fixtures will also
be installed. This lighting meets the city’s requirements.
• Signs. The applicant is proposing to locate a monument sign in the southwest part
of the property. Before installing the sign, or any wall signs, the applicant will need
to receive sign permit approval by the city.
C. Site plan review criteria
The following are the relevant criteria for approval of site plans in city code section
510.17.
1. The site plan fully complies with all applicable requirements of the UDC.
Findings: As outlined in section B, above, with the exception of the
number of parking spaces, the proposed site plan meets UDC
requirements. The applicant has requested a variance to exceed the
maximum number of parking spaces.

2. The site plan adequately protects residential uses from the potential
adverse effects of a non-residential use.
Findings: The nearest residential properties are located across
Colorado Avenue at a distance of approximately 125 feet from the
proposed building to the nearest home. The proposed building is not
expected to have an adverse effect on these residential properties.
3. The site plan is consistent with the use and character of surrounding
properties.
Findings: Prior to 2011 when the commercial building on this property
was demolished, the property had been a commercial use since at
least 1975. The proposed building continues this historical
commercial use.
4. The site plan provides safe conditions for pedestrians or motorists and
prevents the dangerous arrangement of pedestrian and vehicular ways.
Findings: The city’s Public Works Director and staff from the West
Metro Fire Rescue District have reviewed the site’s traffic circulation
plan and found it adequate to meet vehicle movement into and within
the site, including fire trucks.
There are no existing public sidewalks on the property and none
planned. However there are proposed private sidewalks from the
building entrance to parking areas. Adjacent to the property, along
Bottineau Boulevard, is the Crystal Lake Regional Trail which
connects Crystal to Robbinsdale and Brooklyn Park.
D. VARIANCE CRITERIA
As discussed in section C, above, the applicant is requesting a variance to exceed the
maximum number of allowed parking spaces from 52 spaces to 57. The applicant has
included a narrative (attachment C) describing their current and future parking needs.
The following are the relevant approval criteria for this variance as outlined in city code
section 510.33, followed by staff response:
a) Variances shall only be permitted when they are in harmony with the general
purposes and intent of the official control and when the terms of the variances
are consistent with the comprehensive plan.
Response: The intent of the city’s zoning ordinance is to provide for
regulations to promote orderly development that allows for adequate
access to light, air, and convenient access to property. The approval of five
additional parking spaces will not impede access to adequate light or air
for adjacent properties or for the proposed building. The clinic use
conforms to the Comprehensive Plan’s Mixed-Use future land use
designation.

b) Variances shall only be permitted when the City Council finds that strict
enforcement of specific provisions of this section would create practical
difficulties due to circumstances unique to a particular property under
consideration. Practical difficulties, as used in connection with the granting of a
variance, means that the property owner:
1) proposes to use the property in a reasonable manner not permitted
by an official control; and
2) the plight of the landowner is due to circumstances unique to the
property not created by the landowner; and
3) the variance, if granted, will not alter the essential character of the
locality.
Response:
The use of the subject property to include off-street parking areas is a
reasonable use permitted by the city’s zoning regulations. The intent of
the maximum number of parking spaces is to reduce the amount of
impervious parking lots within dense walkable environments, such as
Crystal’s main commercial area at West Broadway and 56th Avenue North.
The uniqueness of 5736 Lakeland is that it is an isolated commercial
property some distance from Crystal’s main commercial area, making it
likely that most employees and patients will be driving to this clinic.
The essential character of this area will not change if the variance is
approved since a commercial use has existed on this property since at
least 1975 and the proposed clinic continues that historical use.
c) Economic considerations alone do not constitute practical difficulties.
Response: The applicant has indicated that additional parking spaces
are needed to provide adequate off-street parking for employees and
patients of the clinic. Therefore economic considerations alone are not
the sole reason for requesting this variance.
E. REQUESTED ACTION
The Planning Commission is asked to make a recommendation to the City Council to
either deny or approve the site plan and variance application to allow a new vision clinic
at 5736 Lakeland Avenue North. This recommendation should include findings of fact
either for or against the proposal. The Commission may reference the findings for
approval in sections B, C, and D above. Staff recommends approval of the site plan and
variance application with the following conditions:

1. Site plan. The development shall be constructed according to the site
plan in attachment D.
2. Building permit issuance. Prior to building permit issuance, the applicant
shall:
a. Sign a site improvement agreement with the city and provide an
escrow to guarantee installation of the parking lot, stormwater
infiltration basin, and landscaping plan.
b. Provide an approval letter from the Federal Aviation Administration to
the city.
3. Compliance. The variance is subject to the applicable requirements of the
Crystal City Code. The Applicant is required to comply with all applicable
federal, state, and local laws, rules, regulations, and ordinances and is
required to obtain such other permits and permissions as may be
required.
4. No Waiver. Failure by the city to take action with respect to any violation
of any condition, covenant or term of the variance shall not be deemed to
be a waiver of such condition, covenant, or term or any subsequent
violation of the same or any other condition, covenant, or term.
5. Binding Effect. This variance, and the conditions placed on its approval,
are binding on the Applicant, the Applicant’s successors and assigns,
shall run with the Property, and shall not in any way be affected by the
subsequent sale, lease, or other change from current ownership. The
obligations of the Applicant under this approval shall also be the
obligations of the current and any subsequent owners of the Property.
6. Acceptance of Conditions. Utilization of the property for any of the uses
allowed by this variance shall automatically be deemed acceptance of,
and agreement to, its terms and conditions without qualification,
reservation, or exception.
City Council action is anticipated on October 19, 2021.

Crystal Vision Clinic – Narrative & Variance Narrative:
The enclosed submittal information is for the development of a new vision clinic medical building. The
location of the project site is on the corner of CR 81 and Crystal Airport Rd. The property address is
5736 Lakeland Ave. N. Crystal, MN 55429. The project consists of a two level 10,708 plus/minus SF
building. Currently the property is zoned C-Commercial. The property is currently vacant land without
any use. The nearest residential properties are across CR 81 and across Colorado Ave. N. Similar to the
medical office building located directly adjacent to the south, this project site will be a buffer for the
residents across Colorado Ave. N. as CR 81 is a heavily travelled arterial roadway. Vehicular traffic will
access the site off of Colorado Ave. N. which serves as a frontage road to the commercial properties in
the area. There is an easily accessible link to CR 81 using Crystal Airport Road. There aren’t any use-
specific standards for this project.
The variance request is for additional parking. The code allows us to have 1 space per 250 square feet
plus an additional 4 stalls and 10% additional with city request. That allows us to have 52 stalls. We are
asking for an additional 5 stalls for a total of 57 stalls. Part of the reason the client is moving is for
additional parking as their current site does not have the parking needed for their use. The proposed
project does not interfere with the public health, safety and general welfare of the community. The
patient and staff count for the facility will require the additional parking when operating at full capacity.
To Whom It May Concern,
We, the owners of Crystal Vision Clinic, would like to introduce ourselves to you and explain why we are
requesting a variance for the number of parking spaces at our new clinic location on Bottineau Blvd. As
you may know, Crystal Vision Clinic has been a part of the Crystal community for over 40 years. Currently,
the business is owned by me, Dr. Scott Endres, and my son Dr. Chase Endres. We have enjoyed being a
part of the Crystal medical community all of these years, and as our practice has grown, we wanted to
keep the business in Crystal as we looked for a new location.
At our current location on Douglas Drive we have 33 parking spots, thirteen of which are taken by staff
members. We currently have 21 staff, eight of whom we have asked to park across the street at the
Alpine Dental clinic parking lot, in order to provide adequate and safe parking for our patients, especially
the elderly. This leaves 20 parking spots for patients, vendors, deliveries, etc., and there is still a parking
shortage. In fact, the biggest reason we made the decision to make the financial investment to build a
new facility in Crystal is due to lack of sufficient parking in our current location.
The nature of our business includes a mixture of both scheduled appointments and drop-in patients. In
addition to the daily scheduled patient encounters with our three doctors and other staff members, we
have patients dropping in for office calls, pick-ups for contact lenses and glasses, adjustments for
glasses, and patients with outside prescriptions who drop in to shop for glasses in our optical store. We
also receive daily deliveries from UPS, USPS, FedEx, and weekly services from Cintas, frame vendors,
contact lens vendors, and pharmaceutical representatives. We also have an ophthalmologist and his two
staff working with us at the clinic twice a month for cataract consults, which provides a convenient service
for the elderly in our community. As you can see, our business has many people and many variables each
day that make our parking lot space a challenge.
We expect in the next five years to be adding another doctor and 6 support staff, which will bring the total
of staff members to 28. Adding another doctor means an increase of patient encounters each day.
Furthermore, our plans for continued growth will entail enhancing some of our medical services
surrounding dry eye, diabetic and macular degeneration diagnosis and treatment. These additional staff
and enhanced services will create the need for even more parking spaces. One of our goals as a
business is to create an exceptional experience for both our patients and our staff, and having safe,
convenient parking is an important part of our success in meeting these goals.
We cannot emphasize enough the importance of having as many parking spaces as we can get for our
new facility. We believe that our business provides a vital service to the Crystal community, and we are
proud to contribute to the continued success and growth of the City of Crystal. Thank you for your

COMPLIANCE WITH ALL TERMS AND CONDITIONS OF THE PERMIT. THE OPERATOR (CONTRACTOR) WHO
SIGNS THE NPDES PERMIT APPLICATION IS A PERMITTEE FOR PARTS II.B., PART II.C, PART II.B-F, PART V, PART
IV AND APPLICABLE CONSTRUCTION ACTIVITY REQUIREMENTS FOUND IN APPENDIX A, PART C. OF THE

NOTICE OF TERMINATION AND MUST INCLUDE: DATE AND TIME OF ACTION, NAME OF PERSON(S)
CONDUCTING WORK, FINDING OF INSPECTIONS AND RECOMMENDATIONS FOR CORRECTIVE
ACTION, DATE AND AMOUNT OF RAINFALL EVENTS GREATER THAN 0.5 INCHES IN A 24 HOUR

G.CONTRACTOR SHALL BE RESPONSIBLE TO INSPECT AND MAINTAIN INLET PROTECTION PLACED
WITHIN THE PUBLIC RIGHT OF WAY UNTIL FINAL STABILIZATION IS ACHIEVED. CONTRACTOR SHALL
CONSISTENTLY MAKE SURE INLET PROTECTION IS IN GOOD WORKING ORDER AND EMERGENCY

17.THE SWPPP, INCLUDING ALL CHANGES TO IT, AND INSPECTIONS AND MAINTENANCE RECORDS MUST BE
KEPT AT THE SITE DURING CONSTRUCTION ACTIVITY BY THE PERMITTEE(S) WHO HAVE OPERATIONAL
CONTROL OF THE SITE AS SITE CONDITIONS REQUIRE, OR AT THE DIRECTION OF THE CITY.
18.OWNER MUST KEEP RECORDS OF ALL PERMITS REQUIRED FOR THE PROJECT, THE SWPPP, ALL INSPECTIONS
AND MAINTENANCE, PERMANENT OPERATION AND MAINTENANCE AGREEMENTS, AND REQUIRED
CALCULATIONS FOR TEMPORARY AND PERMANENT STORM WATER MANAGEMENT SYSTEMS. THESE
RECORDS MUST BE RETAINED FOR THREE YEARS AFTER FILING NPDES NOTICE OF TERMINATION.
19.SWPPP MUST BE AMENDED WHEN:
A.THERE IS A CHANGE IN DESIGN, OPERATION, MAINTENANCE, WEATHER OR SEASONAL CONDITIONS
THAT HAS A SIGNIFICANT EFFECT ON DISCHARGE
B.INSPECTIONS INDICATE THAT THE SWPPP IS NOT EFFECTIVE AND DISCHARGE IS EXCEEDING WATER
QUALITY STANDARDS.
C.THE BMP'S IN THE SWPPP ARE NOT CONTROLLING POLLUTANTS IN DISCHARGES OR IS NOT
CONSISTENT WITH THE TERMS AND CONDITIONS OF THE PERMIT.
19.CONCRETE WASHOUT AREAS ARE NOT ALLOWED ON SITE. MATERIALS MUST REMAIN ON THE TRUCKS, ALL
SPILLS MUST BE CLEANED UP IMMEDIATELY.
20.IN THE EVENT OF ENCOUNTERING A WELL OR SPRING DURING CONSTRUCTION CONTRACTOR TO CEASE
CONSTRUCTION ACTIVITY AND NOTIFY ENGINEER.
21.PIPE OULTETS MUST BE PROVIDED WITH TEMPORARY OR PERMANENT ENERGY DISSIPATION WITHIN 24
HOURS AFTER CONNECTION TO A SURFACE WATER.
22.FINAL STABILIZATION
FINAL STABILIZATION REQUIRES THAT ALL SOIL DISTURBING ACVTIVITIES HAVE BEEN COMPLETED AND THAT
DISTURBED AREAS ARE STABILIZED BY A UNIFORM PERENNIAL VEGETATIVE COVER WITH 70% OF THE
EXPECTED FINAL DENSITY, AND THAT ALL PERMANENT PAVEMENTS HAVE BEEN INSTALLED. ALL TEMPORARY
BMP'S SHALL BE REMOVED, DITCHES STABILIZED, AND SEDIMENT SHALL BE REMOVED FROM PERMANENT
