3. PUBLIC HEARING
a. Rezoning to Planned Development from City of Crystal for proposed police building addition
at 4141 Douglas Drive North (Application 2020-05).
Planner Olson presented a summary of the staff report and stated he is recommending
approval of the rezoning to Planned Development.
Commission member Sears asked why the exterior building colors were chosen, what the
easement width will be along the west property line, and what the sewer availability charge
(SAC) will be for this expansion. Ms. Stein said they wanted the addition to mimic the city
hall by using granite and stucco, but also use other materials to show that the police
station is its own entity. The SAC fee has not yet been determined but its based on the

additional square footage. Planner Olson said the easement will be 5’ wide and there will
be no building encroachments within that easement.
Commission member Maristany asked if the police department will operate on this site
during construction. Chief Revering said that most of their operations will be relocated
during the construction, including the police vehicles. Maristany asked if the stop sign
between the city hall and fire station will remain. Mr. Bohl said the sign will be removed.
Maristany asked how the exterior lighting meets city requirements. Planner Olson state the
number of poles has been reduced and he showed how the footcandle requirement is met.
Commission member Einfeldt-Brown asked if the existing raingarden will be removed. Mr.
Bohl said yes, and its replaced by an enlarged underground stormwater storage tank.
Commission member Selton asked what the status is of the existing rooftop solar panels.
Ms. Norris said the original installer has to approve the reinstallation of the panels and
she’s looking into whether or not it makes sense to reinstall the original panels or install
new panels.
Chair Selton opened the public hearing.
A Crystal resident said he likes the new police building addition and the reconfigured
accesses off of 42nd. He said it was too bad that some trees have to be removed.
A Crystal resident asked several questions about how the new building would impact
climate change. Commission members Maristany and Sears said that the new building will
be much more energy efficient that the original building constructed in 1965. Ms. Stein said
that building codes in effect now create efficient buildings that do not contribute much, or
any, carbon emissions. The resident also said she would like to see the building
downsized so that more trees can be saved and that a wider variety of trees could be
planted. Commission member Strand said that during construction it’s very difficult for
trees near the construction to survive. Planner Olson said that the city recently adopted
new regulations that required tree species diversity for new developments. This project
adds four species.
Hearing that no one from the public wished to speak, Selton closed the public hearing.
Moved by Sears and seconded by Strand to recommend approval to the City Council of
the rezoning to Planned Development of 4141 Douglas Dr N for the police building addition
with the conditions in the staff report.
Ayes: Selton, Strand, Maristany, Einfeldt-Brown, Johnson, Heigel, Sears, and Buck.
Nays: None
Motion carried.

A. BACKGROUND
Kevitt Excavating, owner of the property at 3335 Pennsylvania Avenue North, is
proposing to construct a building addition to their existing 15,728 square foot
office/warehouse building. The property is zoned Industrial and offices and indoor
industrial uses, such as contractor’s offices, are a permitted use within that zoning
district. The city’s unified development code (UDC) requires site plan review and
approval for the new building and site improvements.
Notice of the November 9 public hearing was published in the Sun Post on October 29,
mailed to owners within 500 feet (see attachment A), and posted to the Winnetka Hills
and Valley Place neighborhoods on Nextdoor. A sign was also posted on the property.
The hearing notice was sent to the City of New Hope since the property is adjacent to
the New Hope/Crystal boundary line.

B. SITE PLAN REVIEW
Existing use
The 5.1 acre property is the site of a 15,728 square foot office/warehouse building
constructed in 1994 with an addition in 2001. When the site plan was approved for the

building in 1994, the City Council also approved a conditional use permit (CUP) to allow
outdoor storage of equipment. The City Council approved an amendment to that CUP in
2001 to expand the outdoor storage area. The applicant is not proposing additional
outdoor storage with this application.
Adjacent uses
The following are the existing land uses and zoning districts surrounding this property:
• North – Office/warehouse in New Hope zoned Industrial
• East – Across rail line, townhomes zoned Medium Density Residential (R-2)
• West – Office/warehouse in New Hope zoned Industrial
• South – Office/warehouse zoned Industrial
Proposed use
The applicant is proposing to construct a 9,184 square foot, 27’ tall office/warehouse
addition to the existing building. The following are the notable site plan elements for this
addition:
• Building setbacks. The proposed building addition meets setback requirements in
the Industrial district.
• Parking. Currently the property has 26 spaces and the applicant is proposing to add
four more spaces for a total of 30 parking spaces. The parking lot meets UDC
requirements for number of spaces, setbacks, and parking space and aisle
dimensions.
• Stormwater management and erosion control measures. There is an existing
stormwater retention pond on the property that can accommodate additional
stormwater runoff created by this building addition. The percentage of impervious
surface on the property will decrease slightly from 47% to 46.8% (the maximum
coverage is 90% for the industrial zoning district), as the area where the addition is
to be located is already impervious. During building construction, the city will
require erosion control techniques to be used on-site including silt fences, rock
construction entrances, and inlet protection.
• Utilities. The proposed building addition will connect with existing water and sewer
services through the existing building.
• Access and circulation. The property currently only has access from Pennsylvania
Avenue and that is not proposed to change. The city’s Public Works Director and
the West Metro Fire Rescue District staff have reviewed the traffic circulation plan
and found it adequate to meet vehicle movement into and within the site, including
fire trucks.
• Building elevations. The proposed major exterior building material is concrete
masonry with stone veneer and metal panels as accent materials. These materials
meet the city’s requirements. Elevation drawings of the proposed building addition
is attachment E.

• Landscaping. No trees will be removed to accommodate the building addition. The
applicant proposes to plant one black hills spruce and two varieties of shrubs.
• Screening. Trash and recycling receptacles will be screened by a dumpster
enclosure in front of the building addition.
• Exterior Lighting. There are four existing light poles on the property, and no new
poles proposed. Three new wall lighting fixtures will be installed. This lighting meets
the city’s requirements.
• Signs. The applicant is not proposing any new monument or freestanding signs.
C. Site plan review criteria
The following are the relevant criteria for approval of site plans in city code section
510.17.
1. The site plan fully complies with all applicable requirements of the UDC.
Findings: As outlined in section B, above, the proposed site plan
meets UDC requirements.
2. The site plan adequately protects residential uses from the potential
adverse effects of a non-residential use.
Findings: The nearest residential properties are located east of the
property at a distance of approximately 150 feet from the existing
building to the nearest townhome. The proposed building addition is
not expected to have an adverse effect on these residential
properties.
3. The site plan is consistent with the use and character of surrounding
properties.
Findings: The property has been an industrial use since at least 1994.
Except for the townhomes to the east, the property is surrounded by
industrial uses. The planned addition is consistent with this
character.
4. The site plan provides safe conditions for pedestrians or motorists and
prevents the dangerous arrangement of pedestrian and vehicular ways.
Findings: The city’s Public Works Director and staff from the West
Metro Fire Rescue District have reviewed the site’s traffic circulation
plan and found it adequate to meet vehicle movement into and within
the site, including fire trucks. There is no sidewalk accessing the
property and none planned.

D. REQUESTED ACTION
The Planning Commission is asked to make a recommendation to the City Council to
either deny or approve the site plan application to allow an addition to the existing
building at 3335 Pennsylvania Avenue North. This recommendation should include
findings of fact either for or against the proposal. The Commission may reference the
findings for approval in sections B and C, above. Staff recommends approval of the site
plan review application with the following conditions:
1. The development shall be constructed according to the site plan in
attachment E. Prior to disturbing the site, the applicant shall sign a site
improvement agreement with the city and provide an escrow to guarantee
installation of the parking lot and landscaping plan.
City Council action is anticipated on November 17, 2020.

This project is a proposed addition to an existing office and shop facility for an excavating
company. Very little work will be done inside the current building. The addition will be on an
area which is currently hard surface, no open space will be altered. It will not be visible from
any City Streets and will be buffered from adjacent properties either by the existing building or
existing landscape material.
