SUBJECT: Blue Line Extension Corridor Management Committee Update

The Blue Line Extension Corridor Management Committee (CMC) met on October 8.
Governor Walz attended the meeting to express his support for the Blue Line Extension
as a light rail line and to update the Committee on his opinion that it is time to look at an
alignment that is not within the BNSF right-of-way. After the Governor’s comments, the
Committee discussed public input in considering alternative alignments.
Mayor Adams and city staff attended the meeting and will provide additional information
on the CMC meeting at the October 20 work session.

The Council will consider the following items, which are routine and non-controversial in nature, in
a single motion:
4.1 Approval of the minutes from the following meetings:
a. The City Council meeting on October 6, 2020.
b. The City Council work session on October 8, 2020.
4.2 Approval of the list of license applications submitted by the city clerk to the City Council, a list
that is on file in the office of the city clerk.
4.3 Approval of a resolution adopting the American with Disabilities Act (ADA) transition plan for
public right-of-way.
4.4 Approval of a resolution authorizing execution of agreement with the Minnesota Department
of Public Safety for the Multicultural Adult Driver Education Pilot grant program.
4.5 Approval of a resolution authorizing application to Hennepin Youth Sports Grant program for
improvements at Valley Place Park.

5. Open Forum
(The City Council appreciates hearing from citizens about items of concern and desires to set aside
time during each meeting for Open Forum. To provide ample opportunity for all, speaking time is
limited to three minutes and topic discussion is limited to ten minutes. The Mayor may, as
presiding officer, extend the total time allowed for a topic. By rule, no action may be taken on any
item brought before the Council during Open Forum. The Council may place items discussed
during Open Forum onto subsequent council meeting agendas).
6. Public Hearing
6.1 The Mayor will open a public hearing to receive comment and the Council will consider a
resolution approving the assessment roll for the 2020 delinquent accounts.
Earlier this fall the Council approved the annual public hearing on this year’s delinquent
accounts for October 20. Notices have been provided to property owners for the pending
charges. The Council should take public comments during the hearing. After closing the
public hearing, recommend adoption of the resolution approving the assessment roll for the
2020 delinquent accounts.
7. Regular Agenda
7.1 The Council will consider approval of disbursements over $25,000 submitted by the finance
department to the city council, a list that is on file in the office of the finance department.
Recommend approval of disbursements over $25,000.
7.2 The Council will consider a resolution restricting parking on a portion of Florida Avenue North.
Recommend approval of the resolution restricting parking on a portion of Florida Avenue
North (that stub of Florida Avenue that extends south of 36th Avenue).
7.3 The Council will consider first reading of an ordinance rezoning the city hall campus at 4141
Douglas Dr. N. to Planned Development and approving site and building plans for construction
of a new police station.
At its October 12 meeting, the Planning Commission held a public hearing on rezoning the
city hall campus to Planned Development for the new police station and the site and
building plans for this project. After taking comments from several residents regarding the
appearance of the building and landscaping, the Commission unanimously recommended
approval of the first reading of the ordinance rezoning the city hall campus to Planned
Development and recommended approval of the site and building plans for the new police
station project.
7.4 The Council will consider a resolution approving plans and specifications for the police station
building project and ordering advertising bids for this project.
Assuming the Council approves Agenda Item #7.3, the next step in the process is to approve
the plans and specifications for the new police station and advertise for bids for the project.

7.5 The Council will consider a resolution allocating Crystal’s Coronavirus Aid, Relief and Economic
Security (CARES) Act dollars.
In September the City Council approved a preliminary allocation of the city’s CARES money.
After conversations with the city’s auditor and additional guidance from the federal and
state government, it is recommended that we allocate the entire $1.75 million for public
safety expenses. Recommend approval of the resolution making the final allocation of
CARES funds for Crystal.
8. Announcements
a. The next City Council meeting is Tuesday, November 17, at 7 p.m. in the Council Chambers at
City Hall.
b. Absentee voting continues at City Hall, 8 a.m. – 4:30 p.m., Monday – Friday, through October
26. Early voting starts on Tuesday, October 27 – November 2, at City Hall, 8 a.m. – 4:30 p.m.
and Saturday, October 31, 10 a.m. – 3 p.m.
c. Election Day is November 3; polling places are open 7 a.m. – 8 p.m. Find your polling place at

d. City Council meetings and work sessions are open to the public. Current and previous

Mayor Adams opened the public hearing for testimony. There being no one wishing to appear
before the Council to give testimony, Mayor Adams declared the public hearing closed.

Summary
The Federal Government, through the Americans with Disabilities Act (ADA), requires that all public
entities with 50 or more people have a have a Transition Plan within six months of January 26, 1992.
There is a renewed focus by the Federal Government on enforcing this requirement. As such, city staff
have prepared a draft ADA Transition Plan for Council review.
Schedule
This item was discussed at the September 1 work session. The document was available for public
comment for over 30 days and no comments were received.
Integration with existing plans and procedures
Operationally there is nothing new being created by this document. The City has invested tens of
thousands of dollars in just the last few years building new sidewalks (Phase 15 along Wilshire),
maintaining existing sidewalks (trip hazard removal and panel replacement), upgrading pedestrian
ramps (ADA ramp replacements), and improving signage (Welcome crossing at 36th). Consistent with
the process for other issues, complaints and requests for sidewalk issues are done via the existing
online portal for people to submit concerns to the City. Finally, the City’s Long-Term Plan continues to
include projects that relate to providing for a safe and accessible pedestrian network in the City and so
the relevant sections of the Long-Term Plan are included in the Appendix of the Transition Plan.

Introduction
The Americans with Disabilities Act (ADA), enacted on July 26, 1990, is a civil rights law prohibiting
discrimination against individuals on the basis of disability. ADA consists of five titles outlining
protections in the following areas:
1. Employment
2. State and local government services
3. Public accommodations
4. Telecommunications
5. Miscellaneous Provisions
Title II of ADA pertains to the programs, activities and services public entities provide. As a provider of
public transportation services and programs, City of Crystal must comply with this section of the Act as it
specifically applies to public service agencies. Title II of ADA provides that, “…no qualified individual
with a disability shall, by reason of such disability, be excluded from participation in or be denied the
benefits of the services, programs, or activities of a public entity, or be subjected to discrimination by
any such entity.” (42 USC. Sec. 12132; 28 CFR. Sec. 35.130)
As required by Title II of ADA, 28 CFR. Part 35 Sec. 35.105 and Sec. 35.150, City of Crystal has conducted
a self-evaluation of its facilities within public rights of way and has developed this Transition Plan
detailing how the organization will ensure that all of those facilities are accessible to all individuals.
ADA and its Relationship to Other Laws
Title II of ADA is companion legislation to two previous federal statutes and regulations: the
Architectural Barriers Acts of 1968 and Section 504 of the Rehabilitation Act of 1973.
The Architectural Barriers Act of 1968 is a Federal law that requires facilities designed, built, altered or
leased with Federal funds to be accessible. The Architectural Barriers Act marks one of the first efforts to
ensure access to the built environment.
Section 504 of the Rehabilitation Act of 1973 is a Federal law that protects qualified individuals from
discrimination based on their disability. The nondiscrimination requirements of the law apply to
employers and organizations that receive financial assistance from any Federal department or agency.
Title II of ADA extended this coverage to all state and local government entities, regardless of whether
they receive federal funding or not.
Agency Requirements
Under Title II, City of Crystal must meet these general requirements:
Must operate their programs so that, when viewed in their entirety, the programs are accessible
to and useable by individuals with disabilities (28 C.F.R. Sec. 35.150).
May not refuse to allow a person with a disability to participate in a service, program or activity
simply because the person has a disability (28 C.F.R. Sec. 35.130 (a).
Must make reasonable modifications in policies, practices and procedures that deny equal
access to individuals with disabilities unless a fundamental alteration in the program would
result (28 C.F.R. Sec. 35.130(b) (7).

May not provide services or benefits to individuals with disabilities through programs that are
separate or different unless the separate or different measures are necessary to ensure that
benefits and services are equally effective (28 C.F.R. Sec. 35.130(b)(iv) & (d).
Must take appropriate steps to ensure that communications with applicants, participants and
members of the public with disabilities are as effective as communications with others (29 C.F.R.
Sec. 35.160(a).
Must designate at least one responsible employee to coordinate ADA compliance [28 CFR Sec.
35.107(a)]. This person is often referred to as the "ADA Coordinator." The public entity must
provide the ADA coordinator's name, office address, and telephone number to all interested
individuals [28 CFR Sec. 35.107(a)].
Must provide notice of ADA requirements. All public entities, regardless of size, must provide
information about the rights and protections of Title II to applicants, participants, beneficiaries,
employees, and other interested persons [28 CFR Sec. 35,106]. The notice must include the
identification of the employee serving as the ADA coordinator and must provide this information
on an ongoing basis [28 CFR Sec. 104.8(a)].
Must establish a grievance procedure. Public entities must adopt and publish grievance
procedures providing for prompt and equitable resolution of complaints [28 CFR Sec. 35.107(b)].
This requirement provides for a timely resolution of all problems or conflicts related to ADA
compliance before they escalate to litigation and/or the federal complaint process.
Accessibility Policy Development and Implementation Process
1. Finalize Accessibility, Design, Policy and Implementation Manual
2. Provide opportunity for public comment: A hard copy of this document will be available to the
public online, at Crystal City Hall, or mailed upon request. The comment period will last for 30
days from the publishing of the notice of availability for comment.
3. Prioritize locations of needed improvements and sort them into two categories:
a. Those that could be included with other planned projects
b. Stand-alone improvements
4. Identify work items for different improvements
5. Long-range identification, inclusion, and updating of budget for needed projects
a. Implementation of specific projects is noted in the City’s Long Term Plan (Capital
improvement project list) which is updated at least every two years. Appendix E has the
current relevant pages from the City’s Long Term Plan.
6. Monitor construction by county and private developers to coordinate projects where
feasible
Physical Obstacles that Limit Accessibility
Throughout the City of Crystal there are a wide range of obstacles that limit accessibility on
City sidewalks. These obstacles include, but are not limited to:
1. Concrete panels that have heaved or broken
2. Utility poles
3. Fire Hydrants
4. Metal castings for underground communication systems
5. Pedestrian ramps that do not meet current guidelines

6. Push buttons at traffic signals
Public Rights-of-Way Accessibility Opportunities
1. Partnership between Public Works and Community Development Departments to inform
developers and contractors of their responsibility to incorporate accessibility into their
projects.
2. Monitor private projects to facilitate accessibility improvements to the extent feasible.
3. Coordinate with developments, remodeling, and construction projects, including state, and
federal projects, to facilitate accessibility improvements to the extent feasible.
4. Proactively implement an access improvement plan using guidelines from the published
materials to improve overall network accessibility with an emphasis on points of interest
such as government facilities, transit stops, special population residences, healthcare
facilities, and public spaces.
City Project Implementation
The City of Crystal will utilize two processes to implement accessibility projects. The first is the
inclusion of accessibility components as part of scheduled utility reconstruction projects, street
maintenance activities, or other larger projects. The second method is planned accessibility
projects. These projects are under continual development and implementation. The City
utilizes GIS to keep track of all physical assets including sidewalks and pedestrian ramps.
Information on these assets is updated as work is completed so that the database of the
number of assets stays current.
The City's Street Maintenance Fund is the fund used for accessibility projects and includes
sidewalk and trail maintenance, trip hazard removals, and other accessibility improvements.
The Street Maintenance Fund budget document is available for public viewing online and at
Crystal City Hall.
In addition to City-driven projects, the City will also monitor County projects in Crystal to
identify opportunities to coordinate efforts to improve accessibility.
The Director of Public Works/City Engineer is responsible for the development and
implementation of the City’s capital improvement plan, which includes the accessibility
projects.
Accessibility Project Request Process
The City of Crystal has established a sidewalk concern reporting process through the City’s
website. Appendix D of this manual is a screenshot from that page.
Accessibility Grievance Process
The City of Crystal has established a grievance process for submitting to concerns about
accessibility. The grievance form (Complaint Report/Referral form) is included as an Appendix D
of this manual.

The standards of design which apply to construction work within the public right-of-way in

Crystal shall be the 2010 Americans with Disabilities Act Standards for Accessible Design, its
supplements, revisions, or more recent versions. The most current applicable regulations are
available online at http://www.ada.gov.
Additional standards may apply when work is being conducted on County facilities . The Resources
section of this document provides contact information for other agencies.
Design Guidelines
Development and implementation of design guidelines for accessibility will be an evolving
process that may include many revisions and updates. The City of Crystal uses the Minnesota
Department of Transportation’s Standard Plans for Pedestrian Ramps that is available online:

Appendix A Definitions
Accessibility Coordinator
The Director of Public Works, or designee, is the agent responsible for
implementation of the identified improvements as well as responding to
requests, questions, or other inquiries related to public rights-of-way.
Detectable Warning Surfaces
"A surface feature of truncated dome material built in or applied to the walking
surface to advise of an upcoming change from pedestrian to vehicular way."
Pedestrian Access Routes
A pedestrian access route (PAR) is a continuous and unobstructed walkway
within a pedestrian circulation route specifically designed for ADA accessible
travel.
Pedestrian access routes consist of the following components:
• Walkways
• Ramps
• Curb ramps (excluding flared sides) and landings
• Blended transitions
• Crosswalks
• Pedestrian overpasses and underpasses
• Elevators
• Platform lifts
Program Access
As required by the Rehabilitation Act of 1973 and the Americans with Disabilities
Act of 1990, public entities are obligated to not discriminate in the programs or
services offered to the "general public." Parking, sidewalks, pedestrian crossings
are a feature or amenity offered by the City of Crystal. It may be appropriate for
Crystal to create a plan or special projects to improve or provide accessibility
where no work is currently scheduled.
Consideration in planning is to include location of government services, libraries,
schools, specialized housing, health care providers, or other origins or
destinations of significant volumes of pedestrian trips. Inclusion of members of
the community to establish priorities is encouraged.

Appendix B When Are Accessibility Upgrades Required?
The following is a list of typical construction and maintenance activities conducted on sidewalks,
trails, and roads and the degree to which accessibility projects are required for each activity.
Crack sealing - Not required
Crosswalk installation – Required
Example: Any new midblock or corner (intersection) crossing needs to be compliant.
Concrete and pavement repair - Dependent on scope of work
Example: Isolated, partial or full panel replacement does not trigger larger scale accessibility work.
However, the repair should be consistent with accessibility guidelines such as slope and no lips over
0.5 inches when feasible. Larger concrete repair projects may trigger additional accessibility
provisions.
Concrete joint sealing - Not required
Concrete surface planning/grinding - Not required Curb replacement - Dependent on scope of work
Example: If the curb replacement is at an existing or proposed pedestrian ramp location, then it
should meet ADA requirements. If the curb is not at a pedestrian crossing then standard curb
(86-18, etc.) can be used.
Mill and overlay – Dependent on scope of work
Examples: If the mill and overlay project includes miscellaneous concrete work, then impacted
ramps must be brought up to ADA standards. If the work scope does not include concrete work,
then they do not.
New construction - Required
Examples: Curb cuts, sidewalks/trails, pedestrian crosswalks, traffic signal installation, pedestrian
tunnels/overpasses, and new development.
Pavement marking - Dependent on scope of work
Examples: Any pedestrian-related pavement markings should be consistent with accessibility
provisions, but do not trigger any additional accessibility projects. Pavement markings for vehicle
traffic do not trigger any additional accessibility provisions.
Pothole patching – Not required
Reconstruction - Required
Examples: Roadway widening, additional vehicle/bike lanes, horizontal/vertical alignment changes,
bridge replacement, total road rehabilitation, installation of concrete curb and gutter, traffic signal
replacement, sidewalk/trail replacement.
Sealcoating - Not required
Sidewalk panel replacement - Dependent on scope of work
Example: Accessibility upgrades should be done to the extent feasible. If only one or two panels
are being replaced, then there may be no opportunity to make changes. The higher the number
of replacement sections, the better the opportunity to obtain consistency in corridor
accessibility.

Sidewalk joint grinding - Not required
Sidewalk panel bituminous patch - Dependent on scope of work
Example: The larger the patch section, the better the opportunity to accommodate some
provisions such as slope, cross-slope, and path consistency .
Skin patching - Not required
Utility patch - Dependent on scope of work
Example: A utility patch in the street or boulevard would not trigger an accessibility project as the
intended user is vehicle traffic, or no traffic. A utility patch along a trail, sidewalk, or other
pedestrian route may require accessibility provisions. Generally speaking, the larger the patch
area, the better the opportunity to meet accessibility requirements.

Appendix C Frequently Asked Questions
Sidewalks
Question: A project will be undertaken to connect a series of sidewalk
segments near a school. Must the existing segments of sidewalk be modified
if they do not meet width or cross slope provisions?
Answer: Yes, to the maximum extent feasible within the scope of the
project. Agencies are not required to expand a planned scope of work to
include other items of accessibility.
Question: A new sidewalk is being built along an existing road that
contains driveway access points. Must those driveways be modified if
their cross slope exceeds 2%?
Answer: Yes, to the maximum extent feasible within the scope of the project.
Question: A city is rebuilding a sidewalk along Main Street. The distance
between the edge of the right-of-way and the existing road does not provide
sufficient room for a
4-foot-wide pedestrian access route. Does the municipality have to acquire
more right- of-way on private property or narrow the roadway to provide
the necessary space?
Answer: No, these guidelines do not require the municipality to obtain
right-of-way or to narrow roadways. A municipality may decide to do
either for other reasons (for instance, the roadway may be narrowed as a
larger traffic calming effort or as part of a larger project in the roadway).
Curb Ramps/ Blended Transitions
Question: A multi-block length of roadway is being resurfaced. The
corners have curb ramps that meet some, but not all, of the current
specifications; for example, the cross slope may be too steep or the curb
ramps do not have detectable warnings.
Must the curb ramps be reconstructed as part of the resurfacing project?
Answer: Yes, if it is technically feasible to provide complying features.
The work should be done at the same time the resurfacing is .being done.
Question: New curb ramps are being installed at an existing developed
corner. New construction standards require the curb ramp to be within
the crosswalk, but an existing underground utility vault is located where
the ramp should be. Must the utility vault be moved?
Answer: The scope of this project will determine the answer. If utilities are
being moved for other reasons within the project limits, it may be possible

to alter or relocate the vault. If project construction will not involve the
vault, it may be technically infeasible to locate the curb ramp optimally. It
may be possible to widen the crosswalk markings to include the curb ramp.
Question: What if the curb ramp can be placed over the vault, but the
access cover would be located on the curb ramp?
Answer: If the access cover must be located on the curb ramp, it should
meet the surface requirements of the pedestrian access route.
Question: One corner of an intersection is being altered by curb and
gutter reconstruction and paired curb ramps are being installed as part
of this project. The other three comers of the intersection are not being
altered. Must curb ramps be provided at the unaltered comers as part
of this work?
Answer: No. The scope of the project requires curb ramps only at the altered corner.
Question: Are concrete paver blocks for sidewalks acceptable for
pedestrian access routes?
Answer: Yes, but considerations should be made to ensure that the route
is comfortably and safety traversable by wheelchairs and individuals with
canes or other walk assisting devices.
Question: Are expansion joints in sidewalks compliant with accessibility guidelines?
Answer: It depends, as long as there is not a gap (where an expansion
joint has worn away) that is wider than 0.5 inches the expansion joints
are okay.
Question: Where should a detectable warning device be used?
Answer: Truncated domes are required at all street crossings and
discouraged at all alley and driveway crossings. However, if the driveway
access looks and operates like a street approach, truncated domes should
be considered.
Question: What is the minimum Mn/DOT width required for median refuge?
Answer: Mn/DOT is using a minimum width of 6 feet (back of curb to back of
curb) for pedestrian refuges.
Question: When is edge protection required for sidewalk runs?

Answer: Edge protection is required whenever a handrail is required. A
detectable edge is also required for sidewalks adjacent to
roundabouts.
Question: When ramps are being reconstructed, does the curb need to be
removed or the ramp retrofitted to the curb?
Answer: The curb should be removed so that the new ramp meets as
many accessibility guidelines as feasible.
Question: If the slope exceeds 5%, how far can the walk be built before requiring a landing?
Answer: A landing is required for every 30 inches in rise for a sidewalk
that is separated from a roadway.
Question: What does features does a compliant ramp need?
Answer: Generally speaking, a rap needs: a running slope less than or
equal to 8.3%, meets MnDOT Spec. 2521.3, cross slope less than or equal
to 2%, landing slope less than 2% in every direction, landing area at least 4
feet by 4 feet, landing location at the top of the ramp or at a change in the
access route direction, truncated domes covering the entire curb opening,
proper drainage, no vertical discontinuities greater than 0.25 inches.
Signals
Question: Curb ramps are being installed at a signalized intersection as
part of a roadway improvement project. Existing pedestrian signals are
pedestrian actuated but the pushbuttons are not accessible or placed in
accessible locations. Must accessible pedestrian signals be installed at
the existing pedestrian signals?
Answer: If work on pedestrian pushbuttons is not planned as part of this
project, there is no need to expand its scope to include APS.
Question: The pedestrian signals in a corridor are being replaced with new combined
count-down signals. Must APS be included in the new system?
Answer: Yes. The installation of a new system is an alteration that requires
compliance with the new construction guidelines to the maximum extent
feasible. However, the addition of a new feature, such as a countdown face
or larger display, to an existing installed system does not require that the
scope of work be expanded to include other features.
Question: Count-down signal displays are being added to the existing
pedestrian signal heads at an intersection, but the software and signal
controller are not being altered. Must APS be installed?

Answer: No, simply adding a display to the existing WALK/DON'T WALK
signal would not involve the system changes needed to implement
APS.
Question: An intersection is being signalized and will include APS. The
installation of stub poles on the existing sidewalks to mount the new ped
buttons will not involve disturbing the roadway or sidewalk. Must curb
ramps be installed if none existed?
Answer: No. This is a project to install ped buttons; it is not an
alteration to the sidewalk or street that would require the installation
of curb ramps, as required by 28 CFR 35.151(e).
Question: The pushbutton on an existing pedestrian signal is being replaced with a
sturdier model. Must APS be installed?
Answer: No, but the new pushbutton must meet applicable requirements
(i.e., location, height, operable parts).
Question: An intersection with sidewalks and pedestrian signals is being
widened to include a right tum lane. Must APS be installed as a
consequence of the widening project?
Answer: No, installing APS is not within scope of the project. Any new
pedestrian pushbuttons installed in the course of the work must meet
applicable requirements. Note that this project is an alteration to the
street and sidewalk and thus must provide compliant curb ramps.
Accessibility during construction
Question: What provisions for accessibility must be made during
construction activities?
Answer: When a pedestrian access route is disrupted, closed, or relocated
during construction, maintenance work, or other temporary conditions,
the alternative pedestrian access route shall include pedestrian ramps to
maintain accessibility. See the Minnesota Manual on Uniform Traffic
Control Devices (MN MUTCD) for further guidance on the requirements
for establishing an alternative pedestrian access route for temporary
traffic control. See also the "Pedestrian Accessibility Considerations in
Temporary Traffic Control Zones Check List" in the MN MUTCD.

WHEREAS, the Crystal City Council is committed to providing and maintaining quality
infrastructure that is essential for everyday residential, commercial, industrial, and recreational
activities in the City; and
WHEREAS, traffic control and operations for public streets, sidewalks, trails, and other
public facilities is an essential function the City provides; and

MULTICULTURAL ADULT DRIVER EDUCATION PILOT
WHEREAS, the Crystal Police Department is responsible for enforcing local and state
traffic laws; and
WHEREAS, the Crystal Police Department seeks out opportunities to educate residents
and drivers on driver safety, education and laws; and
WHEREAS, the Crystal Police applied for a grant from the Minnesota Department of
Public Safety for a grant for the 2021 Multicultural Adult Driver Education Pilot project to aid in
its driver safety education effort; and
WHEREAS, the Crystal Police department grant application was approved.
NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Crystal
that:
1.The City of Crystal Police Department enter into a grant agreement with the
Minnesota Department of Public Safety, Office of Traffic Safety for the project
entitled 2021 Multicultural Adult Driver Education Pilot during the period from
November 1, 2020 through September 30, 2021; and
2.Deputy Police Chief Brian Hubbard is hereby authorized to execute such
agreements and amendments as are necessary to implement the project on behalf
of the City of Crystal Police Department and to be the fiscal agent and
administer the grant.

Grant Application to the Hennepin County Youth Sports Program
Valley Place Park is a community park in Crystal that draws users from beyond the
immediate neighborhood. The park is active year-round; with a play area, tennis court, trails
and other features available in the summer and a sliding hill, warming house and skating
rinks available in the winter. In 2021, capital improvements are planned to replace the play
area (built 2001) and to replace worn features of the warming house (roof, exterior doors,
lighting, etc.). The addition of grant funds would allow accessible restrooms and access
routes to be added to the project as well.
Hennepin County offers grants through their Youth Sports Program to help develop facilities
for sports or recreational facilities. The city is required to provide funds for the project, and
the ratio of the match requested from the county is one criteria in awarding the grant. For
the Valley Place Park project; the proposed budget is $350,000 from the city and $100,000
from the county for a $450,000 project. The city funds are included in the 2021 capital plan.
The grant applications are due November 2, and a resolution of support from the Crystal
City Council is a requirement of the application.

AUTHORIZING A FACILITY GRANT APPLICATION TO THE
HENNEPIN YOUTH SPORTS PROGRAM TO HELP FUND IMPROVEMENTS
AT VALLEY PLACE PARK
WHEREAS, the Hennepin County Board of Commissioners, via the Hennepin Youth Sports
Program, provides for capital funds to assist local government units of Hennepin County for the
development of sports or recreational facilities, and
WHEREAS, the City of Crystal, hereinafter LGU, desires to develop a new play area with
accessibility and other related improvements at Valley Place Park.
NOW, THEREFORE BE IT RESOLVED BY THE City Council of the City of Crystal:
I. The estimate of the total cost of developing PROJECT shall be $450,000. The LGU is
requesting $100,000 from the Hennepin Youth Sports Program and will assume responsibility
for providing matching funds of $350,000.
II. The LGU is the owner of the property where the PROJECT is located. The LGU will own the
property where PROJECT is located for at least the functional life of the facility, which is
estimated to be 20 years. The PROJECT may not be converted to non-public or non-recreational
uses within this time period without the approval of Hennepin County.
III. The LGU agrees to assume one hundred (100) percent of operational and maintenance costs
for PROJECT. LGU will operate PROJECT for its intended purpose as stated in the PROJECT
application for the functional life of the facility.
IV. LGU agrees to enter into necessary and required agreements with Hennepin County for the
specific purpose of developing PROJECT and managing its long-term operation.
V. That John Elholm, Recreation Director, is authorized and directed to execute the application
for the Hennepin Youth Sports Program grant.

SUBJECT: Resolution Adoption Assessment Roll for 2020 Delinquent Accounts
Introduction:
Each year, the City levies special assessments on properties that have received
services during the year, but have not paid the invoices that were sent out. These
services include: utility charges, administrative citations, garbage and refuse removal,
nuisance abatements, weed mowing, and false alarm fines.
Receivables that are included in the assessment are those that were delinquent on July
31, 2020. Resolution 2020-76 was approved by the City Council on August 18, 2020.
The resolution listed the delinquent amounts to be assessed, set the public hearing for
October 20, 2020 at 7:00 PM, and set the interest rate on the assessments.
Letters have been sent to the owners of each property with an assessment to notify
them of the special assessment and of this public hearing. Notice of the public hearing
was also published in the September 17, 2020 edition of the Crystal/Robbinsdale Sun
Post.
Discussion:
Numerous payments have been received since the assessment rolls were initially
prepared in August. Complete assessment rolls will be available at the meeting for
inspection, but they were not copied for this agenda packet.

The current balances of the assessment rolls are summarized as follows:
For comparison sake, the assessment rolls at this same point last year were as follows:
A $35.00 administrative charge (per address and per assessment type) will be added
on Thursday, October 22nd. Payments will be accepted through 4:30 P.M. on
Wednesday, October 21st, 2020 without the administrative charge. This allows
customers to appeal their assessment to the City Council without incurring the
administrative charge.
Customers will be able to pay the assessment at any time through November 25th
without being charged interest. Payments made after that date will be charged interest
at the rate of 9% per year. Assessments not paid by 4:30 P.M. on November 25th will
be sent to Hennepin County for collection on the 2021 property tax statement.

Appeals:
Any written appeals of assessments that are received will be provided to the City
Council at the council meeting on October 20th. Property owners may still appear at the
public hearing without having given a written appeal in advance.
Recommended City Council Action(s):

b. Read any written appeals into the record
c. Close the public hearing
2. Request information as needed from the staff either at the meeting or to be

the front desk of City Hall between the hours of 8:00 a.m. – 4:30 p.m., Monday-
Friday.
•Delinquent balances not paid by 4:30 p.m. on Wednesday, November 25, 2020,
will be assessed against the property. This means that the delinquent balance
will be reported to Hennepin County, which will add it to the 2021 property tax
statement for the Service Address. Assessed amounts will accrue interest at an
annual rate of nine percent (9%) from November 1, 2020, through December 31,
2021.
•An owner may, at any time thereafter, pay to Hennepin County the entire amount
of the assessment remaining unpaid, with interest (9%) accrued to December 31
of the year in which such payment is made.
4. The Assessing Specialist will transmit a certified duplicate of the final assessment listing to Hennepin

Summary
Earlier this year, as part of the 2020 Mill and Overlay
project, Florida Ave south of 36th Ave was reconstructed. In
the planning for this project, City staff contacted the
property owner to the east to see if they wanted to
relocate their driveway from connecting to 36th Ave to
Florida Ave due to the traffic volumes and sight distance
challenges when entering 36th Ave. The property owner did
want to make this change and it was included in the
project.
This section of road has always been a challenge in the
winter due to it being a dead end and a hill down from 36th
Ave. Any vehicles parked on the street not only make
entering/exiting the driveways a challenge, but are also
potentially a hazard in the winter in the event vehicles
struggle to get up the hill or sliding down. In addition to the property owners’ access, large vehicles
such as trash trucks and snow plows have struggled on the hill (mainly in the winter). The restriction of
vehicle parking will improve ease of access for the property owners as well as improve operation for
large vehicles on the street.
This section of Florida Ave only serves two properties and both property owners are in support of the
restrictions.
Parking Summary
On street parking will be restricted on both sides of the street all day, every day.
Recommended Action
Motion to approve the resolution restricting parking on Florida Avenue North from 36th Ave south to
the dead end.

traffic; and
WHEREAS, all traffic control shall conform to the state manual and specifications for
traffic control devices; and
WHEREAS, the City has completed an engineering study of the corridor which
recommended the restriction of the on-street parking; and
WHEREAS, the two adjacent property have expressed their support for the restriction of
on-street parking;

A.INTRODUCTION
The City of Crystal is proposing to construct a police building addition to the existing city
hall at 4141 Douglas Drive North. The property is comprised of four separately platted
lots zoned Low Density Residential (R-1). Public buildings are a conditional use in the R-
1 district. The applicant is proposing to consolidate the lots into one parcel and rezone
the property to Planned Development (R1 - PD). Notice of the October 12 public hearing
was published in the Sun Post on October 1, mailed to property owners within 1000’ of
the property (see attachment A), posted in two locations on the site, and posted to all
Crystal neighborhoods on Nextdoor.
At the October 12th Planning Commission public hearing, the Commission unanimously
recommended approval of the rezoning. Two members of the public spoke at the hearing
and expressed support for the building addition with two comments:
➢The addition be made smaller so that additional trees could be saved.
Staff response: It was explained that trees do not often survive construction so
reducing the size of the building will not guarantee tree survival.
➢One of the residents asked that the number of tree species be increased.
Staff response: In consulting with the city’s architect for the project, it was
determined the proposed tree species were chosen to provide security around the
police building, such as having no evergreen trees in which persons could conceal
themselves. In addition having a defined number of tree species makes
maintenance easier since you don’t have to contend with the varied maintenance
needs that having greater numbers of species can bring.

B. BACKGROUND
Existing Use
The 3.4 acre (147, 429 SF) property contains two existing buildings, with an associated
surface parking lot:
• 4101 Douglas Dr N – The property contains an existing 6,533 square foot fire station
building constructed in 1975.
• 4141 Douglas Dr N - The property contains an existing 19,961 square foot city hall
and police building constructed in 1965.
Surrounding Land Uses
The following are the existing zoning districts and land uses surrounding the property:
▪ North: Across Douglas Drive north of the subject property are single-family homes
zoned R-1, as well as a vehicle repair shop zoned Commercial.
▪ East: Across Douglas Drive are single-family homes zoned R-1 and a veterinary clinic
zoned Commercial.
▪ West: To the west is another institutional use, the Hennepin County library, which is
zoned R-1.
▪ South – To the south are single-family homes zoned R-1.
C. PROPOSED POLICE BUILDING ADDITION
Proposed Use
The proposed use is to remove 4,800 SF from the north end of the existing city hall and
construct a 23,800 SF police building addition northwest of city hall. 14,700 SF of the
existing city hall would remain and continue to be used.

Site Plan Elements
• The properties included in the Planned Development consists of four platted lots.
The applicant will submit a lot consolidation application that will combine these lots
into one parcel. According to the UDC, a lot consolidation application is approved by
the City Council without the need for a public hearing. The following are the notable
site plan elements for the proposed building addition:
• Building setbacks. Since the property fronts on three public streets, the property is
defined in the UDC as a through corner lot. For these lots the front lot line is defined
as that street upon which the building faces. Since the building’s entrance faces the
west side of the property, which is not located along a public street, staff has
determined that for zoning purposes the front property line is the north property line.
This interpretation follows the UDC requirement that the shortest street side is the
front property line. Since the west property line is the only side not facing a public
street, that side is the interior side yard.
The following are the proposed setbacks for the building addition compared to the
setback requirements in the underlying R-1 district. The Planned Development
zoning classification allows for flexibility in zoning requirements.
▪ North (front) property line: 24’ (requirement is 30’).
In their review of the lot consolidation plat, the county has requested a 7-foot
wide easement for widened or relocated future sidewalk or trail along 42nd
Avenue and Douglas Drive. This reduces the building setback to 24’.
▪ East (corner side) property line: 114.4’ (requirement is 20’)
▪ South (rear) property line: 300+’ (requirement is 30’)
▪ West (interior side) property line: 7’ (requirement is 10’)
The proposed building addition is not located in an existing or proposed drainage or
utility easement.
• Parking.
▪ The property currently has 100 parking spaces: 8 in the existing police garage
and 92 in surface lots. At this time, the lower (secure) lot is used for both Police
Department and police employee vehicles. The upper lot is also used by Police
Department and police employee vehicles in addition to its use by the public.
▪ The site plan calls for removal of portions of the upper parking lot to
accommodate the building addition, and expansion of the lower lot into areas
occupied by the current police department wing of City Hall.
▪ After the project is complete, the property will have 117 parking spaces: 33 in
the new police garage and 84 in surface lots. Because Police Department
vehicles will all be parked in the new garage, and police employee vehicles will
be parked in the lower lot, fewer spaces will be needed in the upper lot when
compared to the current parking arrangement.

▪ The UDC does not require a specific number of spaces for public buildings , but
the overall number of spaces is greater than existing number and adequately
meets the needs of the facility.

• Stormwater management and erosion control measures. Due to the scope of the
project, the stormwater plan is subject to Shingle Creek Watershed Management
Commission standards.
▪ The project includes expansion of an existing stormwater infiltration tank
underneath the lower parking lot in the northeast corner of the property. The
existing infiltration basin in the northwest area of the property will be removed to
accommodate the building addition.
▪ The existing impervious surface covers 63.9% of the property, and this will
increase to 75% for this building project. The maximum coverage is 70% for the
R-1 district, but this requirement can be modified under PD zoning.
▪ Despite the increase in impervious surface, the project will result in slightly
reduced runoff due to stormwater management improvements to be installed.
For example, in a 100-year rainfall event, the runoff rate will be 33.88 cubic feet
per second vs. 35.02 CFS for the site as it exists today.
▪ During building construction, erosion control techniques to be used including silt
fences, sediment control logs, and erosion control blankets.
• Utilities. The proposed building addition will connect with existing water through City
Hall, but it is proposed that a new sanita ry sewer service connection be made to the
main under 42nd Ave. Existing overhead utilities are located along 42nd Avenue.
These utilities will be located in drainage and utility easements that are dedicated
with the new lot consolidation plat. If those lines are relocated or extended, then the
lines and extensions must be buried underground. New private utility services to the
proposed building, such as Xcel Energy, Century Link and Comcast, will be buried
underground.
• Access and circulation. The city’s Public Works department and the West Metro Fire
Rescue District staff have reviewed this traffic circulation plan and found it sufficient
to meet vehicle movement into and within the site, including fire trucks.
As a part of the building addition, driveway access will change for both the city
hall/police station and the adjacent Hennepin County library (6401 - 42nd Ave N):
▪ City hall/police station: The existing northwest driveway access to city hall off of
42nd Avenue will be permanently closed and the building addition will be
constructed in this area. Two existing accesses to the parking lot in the northeast

corner of the property will remain: one off of 42nd Avenue and the other off of
Douglas Drive, which will be slightly relocated to the south.
▪ Library: In 2019 the city and the county signed an agreement which provides
mutual access on each other’s property. It is planned to widen the existing library
driveway access off of 42nd Avenue to allow for east and west turning
movements for vehicles exiting the property. This access will continue to serve
as the library’s main entry point. An existing internal secondary access between
the city hall parking lot and the library parking lot will be relocated slightly
northward.
• Building elevations. The proposed major exterior building material is prefinished
aluminum panels, with brick, glass, and stone veneer as accent materials. These
materials meet the city’s requirements. A rending of the proposed building is
attachment E.
• Landscaping. The landscape plan shows 11 existing trees to be removed to
accommodate the proposed building addition. The plan calls for 24 new trees to be
planted. These trees are speckled alder, quaking aspen, American linden, and
Japanese tree lilac. The landscape plan also shows ten varieties of shrubs. The
entire length of the building foundation facing Douglas drive is not completely
screened with shrubs as required by the UDC, but the foundation is sufficiently
screened from street view by a combination of trees, shrubs, and a wrought iron
fence along both 42nd Avenue and Douglas Drive.
• Screening. The existing dumpster enclosure on the west side of the property will be
removed. A new enclosure will be installed near the fire station and will face inward
to the parking lot. A new electrical transformer on the north side of the building
addition will be screened by landscaping. A rooftop condenser unit will be located
over the garage entrance on the southwest part of the addition. This unit will be
screened by the same aluminum panel material used on the building’s exterior.
• Exterior Lighting. There are eleven existing light poles in the existing parking lots,
seven of which will be removed. Four new light poles will be installed in the new
parking areas. There will be three exterior lighting fixtures on the proposed building.
This lighting meets the city’s requirements.
• Pedestrian connections. There are existing sidewalks along 42nd Avenue and
Douglas Drive, as well as interior sidewalks throughout the property. The County
has requested that the city dedicate a 7-foot wide easement along 42nd and Douglas
for a future trail and sidewalk connection (see above). When the City Council
considers approval of the lot consolidation plat, the Council will also be asked to
approve the dedication of this easement.
• Signs. The applicant may install wall signs for the police building and must receive
sign permit approval before installing any building signage.

D. REZONING TO PLANNED DEVELOPMENT (R1 - PD)
The applicant is requesting that the consolidated properties be rezoned to Planned
Development (R1 - PD), which allows some flexibility in zoning requirements when
planning campus-type land uses. The underlying zoning for the property would be Low
Density Residential (R-1). The R1-PD zoning allows for the following differences from the
underlying zoning requirements:
• More than one principal building on the property. This is a reasonable use of the
property because it functions as a civic campus and already has multiple principal
buildings (city hall and fire station).
• Reduction of the west side building setback from 10 feet to 7 feet. This is necessary
due to the grade change and secure parking area located between the building
addition and Douglas Drive.
• Additional reduction in the setback required from any adjacent public road in the
event that an additional roadway easement or sidewalk/trail easement is
subsequently granted, declared or dedicated in the future. This is necessary to
accommodate potential future widening or relocation of sidewalk or trail facilities
along the adjacent county roads.
• Increase the amount of impervious surface to 75% of the property from the maximum
allowed of 70%. This is reasonable based on the enhanced stormwater treatment
systems proposed to be installed as part of the building addition project.
E. CONDITIONAL USE PERMIT CRITERIA
The following are the relevant criteria for approval of conditional use permits in city code
section 510.19:
(a) The proposed use has been approved as a conditional use in the zoning district for
which it is proposed.
Findings: Public buildings are a conditional use in the R-1 district.
(b) The conditional use will be in accordance with the general objectives, or with any
specific objective, of the city’s comprehensive plan and the unified development
code (UDC).
Findings: On the 2040 Planned Land Use map (attachment C), the
property is guided as Institutional, which includes “churches, schools,
cemeteries, and publicly-owned properties”. The existing police building
is in conformance with this land use designation.
(c) The conditional use will be designed, constructed, operated, and maintained so as
to be harmonious and appropriate in appearance with the existing or intended
character of the general vicinity and that such use wi ll not change the essential
character of the same area.

Findings: The property is located on the edge of a commercial area that
transitions into a residential area. An institutional building has existed at
this location since 1965, and the character of that use will not change.
(d) Impacts such as noise, hours of activity, and exterior lighting have been sufficiently
addressed to mitigate negative impacts on nearby uses.
Findings: The proposed building addition will not generate unusual noise
impacts. Hours of operation will continue to be the same as they have
been for many years. New exterior lighting meets the city’s requirements.
(e) Parking is adequately provided f or the proposed conditional use.
Findings: There are not specific parking requirements for public buildings.
As described in section C, above, parking is adequately provided for.
(f) In the approval of a conditional use permit, the City Council may impose such
conditions as it determines is necessary to make the use compatible with other us es
allowed in the same district zone or vicinity.
Findings: The proposed conditions of approval for the CUP and rezoning
to R1-PD are found in section F of this staff report.
F. REQUESTED ACTION
At the October 12, 2020 Planning Commission meeting, the Commission recommended
approval of the rezoning to Planned Development (R1 -PD) by a vote of 8 to 0 (one
member absent) with the following conditions of approval:
1. Site Plan. The development shall be constructed according to the site plan in
attachment E.
2. Lot consolidation. Prior to disturbing the site, the applicant shall receive approval by
the City Council of a lot consolidation application to combine the applicant’s four
properties into one parcel and provide new easements on the final plat document.
3. Overhead utilities. If utility lines are installed, relocated or extended, the lines shall
be buried underground. New private utilities, such as Xcel Energy, Center Point
Energy, or Comcast shall be buried underground.
4. Special provisions related to Planned Development rezoning. The rezoning to R1-
PD implements the following special provisions in place of the standard R -1
requirements:
a) More than one principal building on the property is permitted.
b) The west side setback is reduced from 10 feet to 7 feet.

c) On the north side the building addition will be 24 feet from a sidewalk/trail
easement that will be dedicated along that property line.
d) The maximum impervious surface coverage on the property is increased from
70% to 75%.
City Council first reading of the ordinance rezoning the property to R1-PD is requested.
If the Council approves first reading, then second reading of the rezoning ordinance
would be considered on November 17, 2020 in which the lot consolidation request will
also be considered.

safe passage from one building to another.

CRYSTAL POLICE BUILDING PROJECT
1
The City of Crystal is planning a new Crystal Police
Department building on the existing city hall municipal
campus at 4141 Douglas Dr. N. The site was chosen for
its cost savings and a desire to keep administrative and
police functions centrally located in the community.
The project includes a 23,800 sq. ft. police building
northwest of the existing city hall, east of the Rockford
Road library access road to 42nd Ave.
EXISTING BUILDING
The current city hall, which includes the police
department and city administration, was built in 1965, and
underwent a remodel in 1993. The police department
portion has significant structural issues, including fleet,
equipment and space inefficiencies. Technology
upgrades have been postponed, equipment storage and locker room space are inadequate; and gun storage and
the armory falls short of modern security standards. Also, the garage has structural issues and police vehicles are
stored outside. A recent state audit recommends upgrades to the jail, while interview rooms lack soundproofing
and the detention area needs security improvements.
NEW BUILDING FEATURES
The new police building will feature efficient, safe work spaces, including a secure, centralized evidence storage
area; secure indoor fleet storage; a dedicated space for K9 officer(s); and an up-to-date detention space and
expanded locker room space and capacity. Much of the current police department will be demolished, but some
will remain to be repurposed as an additional community meeting room for city hall.
Numerous energy efficiencies are included in the building's design.
As part of the project in cooperation with Hennepin County, the library access road to 42nd Ave. will be
reconstructed with a wider curb cut and right-turn lane, an existing city hall curb cut on 42nd will be removed, and
the internal access drive will be relocated with a pedestrian connection between the library and city hall.
PROJECT COST
The project will cost $16 million, including construction, fixtures and design fees. It will be paid for using cash from
the city's building fund and various other capital funds.
PROJECT TIMELINE
The design phase is expected to be complete in 2020, with project review by the planning commission and
approval by the city council in the 4th quarter of 2020. Construction would start in the spring of 2021. Occupancy
of new building is expected in early summer 2022.

CITY OF CRYSTAL
AN ORDINANCE AMENDING THE ZONING MAP TO REZONE PROPERTY FOR
THE CITY OF CRYSTAL LOCATED AT 4141 DOUGLAS DRIVE NORTH
FROM LOW DENSITY RESIDENTIAL (R-1)
TO LOW DENSITY RESIDENTIAL (R1) – PLANNED DEVELOPMENT
THE CITY OF CRYSTAL ORDAINS:
Section 1. Legislative Findings. The City Council of the City of Crystal hereby finds and
determines as follows:
(a)The City of Crystal (“Applicant”) has requested to rezone its property at 4141
Douglas Drive North (“Property”) to the planned development overlay district
as provided in Crystal city code, subsection 510.31; and
(b)The request would rezone the Property from Low Density Residential (R-1) to
Low Density Residential Planned Development (R1-PD); and
(c)The rezoning request is to allow the Applicant to construct an addition to its
police station, which involves the consolidation of the Applicant’s parcels into
a single platted parcel and approval of a site plan; and
(d)The Planning Commission held a public hearing on the rezoning request on
October 12, 2020 and voted to forward the requested rezoning to the City
Council with a recommendation that it be approved with certain conditions;
and
(e)The City Council determines the proposed rezoning of the Property complies
with the approval criteria in Crystal city code, subsections 510.29 and 510.31,
and other applicable provisions.
Section 2. Rezoning. Subject to the conditions in Section 3 of this ordinance, the Zoning
Map of Crystal, Minnesota is hereby amended as follows:
The zoning classification of the following legally described property addressed as
4141 Douglas Drive North, currently classified as Low Density Residential (R-1),
shall henceforth be classified as Low Density Residential – Planned Development
(R1-PD):
Lot 1, Block 1, Crystal City Hall Addition, Hennepin County, Minnesota.

Section 3. Conditions. The rezoning approved herein is conditioned on compliance with the
following:
1. Site Plan. The development shall be constructed according to the site plan in
attachment E of the City Council staff report dated October 1, 2020.
2. Lot consolidation. Prior to disturbing the site, the applicant shall receive
approval by the City Council of a lot consolidation application to combine
the applicant’s four properties into one parcel and provide new easements on
the final plat document.
3. Overhead utilities. If utility lines are installed, relocated or extended, the
lines shall be buried underground. New private utilities, such as Xcel
Energy, Center Point Energy, or Comcast shall be buried underground.
4. Special provisions related to Planned Development rezoning. The rezoning
to R1-PD implements the following special provisions in place of the
standard R-1 requirements:
a) More than one principal building on the property is permitted.
b) The west side setback is reduced from 10 feet to 7 feet.
c) If an additional roadway easement or sidewalk/trail easement is
subsequently granted, declared or dedicated along an abutting public
street or road, the minimum setback shall be automatically reduced by
the width of the easement.
d) The maximum impervious surface coverage on the property is
increased from 70% to 75%.
Section 4. Zoning Map Amendment. The zoning administrator is authorized and directed to
amend the Zoning Map in accordance with this ordinance and to take any such
other actions as may be required to effectuate this rezoning.
Section 5. Effective Date. This ordinance shall not be codified into the Crystal city code and
is effective in accordance with Crystal city code, subsection 110.11.
