Crystal Economic Development Authority
Regular Meeting
May 7, 2013
President Hoffmann called the regular meeting of the Crystal Economic Development Authority
to order at 6:30 p.m.
Upon call of the roll, the following members were present: Jim Adams, John Budziszewski, Julie
Deshler, Mark Hoffmann, Laura Libby, Casey Peak and Joe Selton.
The following staff members were present: Anne Norris, Executive Director; Patrick Peters,
Deputy Executive Director; John Sutter, City Planner/Assistant Community Development
Director; and Mike Norton, City Attorney.
President Hoffmann acknowledged the addition of the following item to the meeting agenda:
Consider tentative acceptance of proposals and approval of option agreements with MT Builders
for purchase of lots at 4343 and 4349 Xenia Avenue North for construction of new houses.
Motion by Commissioner Selton (Adams) to approve the minutes from the April 16, 2013,
special meeting.
Motion carried.
The EDA held a Public Hearing to consider a resolution authorizing the sale of the lot at 5548
Yates Avenue North to Novak -Fleck for construction of a new house.
No one appeared at the hearing, and President Hoffmann closed the hearing.
Motion by Commissioner Budziszewski (Peak) to approve Resolution #2013-06 authorizing the
sale of the lot at 5548 Yates Avenue North to Novak -Fleck for construction of a new house.
Motion carried.
The EDA held a Public Hearing to consider a resolution authorizing the sale of the lot at 4553
Yates Avenue North to Berger Built Construction for construction of a new house.
President Hoffmann opened the hearing, and staff requested continuance of the hearing to May
21, 2013.
It was the consensus of the Commissioners that the agreement negotiated with Berger Built
Construction would not apply to subsequent builders for the sale of the lot at 4553 Yates Avenue
North should Berger not proceed with the lot purchase.
Motion by President Hoffmatm (Sefton) to continue the Public Hearing on the sale of the lot at
4553 Yates Avenue North to May 21, 2013.
Motion carried.
The EDA considered tentative acceptance of proposals and approval of option agreements with
MT Builders for purchase of lots at 4343 and 4349 Xenia Avenue North for construction of new
houses.
Motion by Commissioner Selton (Deshler) to tentatively accept proposals and authorize option
agreements with MT Builders for 4343 and 4349 Xenia Avenue North.
Motion carried.
The EDA considered a resolution amending the 2013 EDA and TIF Housing District Budgets.
Motion by President Hoffmann (Selton) to approve Resolution #2013-07 amending the 2013
budgets of Housing Replacement District 41, Housing Replacement District #2 and the
Economic Development Authority.
Motion carried.
Motion by Commissioner Budziszewski (Peak) to adjourn the regular meeting.
Motion carried.

Yates Avenue North to Berger Built Construction for construction of a new
house — continued from May 7 meeting
At its April 16 meeting the EDA accepted a proposal from Berger Built Construction to
purchase the lot at 4553 Yates Avenue North, with a lot price of $40,000 and the EDA
completing the curb cut relocation and removal of one tree. The house was to be custom-built
for a specific homebuyer but they subsequently decided to not proceed with the new house.
Berger has decided to proceed with purchasing the lot and building a spec home. Lot sale
closing and construction start are anticipated in June with house completion by fall 2013.
Berger has a Minnesota Residential Building Contractor license with no enforcement actions.
Staff has confirmed Berger's experience building new homes in Minnesota (see Exhibit B).
The house would be a modified two story with an attached two car garage. The upper floor
would have three bedrooms, two bathrooms and a laundry. (Note: Based on the floor plan's
dimensions, the upper floor would have 724 sq. ft. but the plans say it's 767.) The main floor
would have 812 sq. ft, with a living room, dining room, kitchen and 1/. bathroom. The basement
would have 780 unfinished sq. ft. with at least one egress window and a roughed -in bathroom
for future finishing. Windows would be added to the side walls of the house per EDA
guidelines, with the exact number, size and location to be worked out by staff and the builder
before detailed plans are submitted for the building permit.
Changes from the April 16 preliminary proposal are as follows:
• The main floor is significantly larger (812 sq. ft. instead of 716)
• The basement is slightly larger (780 sq. ft. instead of 716)
• The 16 foot wide, cantilevered living room bump -out and front porch both extend into the
30 foot front setback, as permitted by the zoning ordinance
• The north side setback has been increased from the ordinance minimum of 10 feet to 12
• The south side setback has been decreased from 8.91 feet to 6.91 feet (the ordinance
minimum is 5 feet)

WHEREAS, the Economic Development Authority of the City of Crystal ("the EDA") is the
owner of 4553 Yates Avenue North, legally described as Lot 1, Block 4, West Lilac Terrace
Third Unit, Hennepin County, Minnesota ('the Property"); and
WHEREAS, the EDA has solicited proposals from builders who desire to purchase the
Property from the EDA and construct thereon a new single family house; and
WHEREAS, the EDA has reviewed and accepted the proposal from Berger Built Construction
Company.
NOW, THEREFORE, BE IT RESOLVED that the EDA authorizes the sale of the Property to
Berger Built Construction Company.
BE IT FURTHER RESOLVED that the sale shall be completed in accordance with the terms of
the Purchase and Redevelopment Agreement in substantially the form on file in City Hall, and
that the President and Executive Director are hereby authorized to sign said Agreement and
other documents required to complete the sale of the Property to Berger Built Construction
Company.

SUBJECT: Consider tentative acceptance of a proposal from MT Builders to purchase
a lot at 4330 Zane Avenue North for construction of a new house
We have received a proposal from MT Builders to purchase the lot at 4330 Zane Avenue
North for $40,000. MT Builders has a Minnesota Residential Building Contractor license with
no enforcement actions.
This would be custom-built for a specific homebuyer. The house would be essentially the
same as the house at 4306 Zane: A two story with 780 sq. ft. on the first floor (living, dining,
kitchen, laundry and 1/2 bathroom) and 801 sq. ft. on the second floor (three bedrooms and two
bathrooms). The house would also have an unfinished basement set up for a future family
room, bedroom and'/ bathroom. There would be a detached three car garage along the alley.
The proposal meets city code including zoning, and also is in full conformance with the EDA's
lot sale guidelines.
I have attached a 2012 aerial photo and the builder's proposal, site sketch and preliminary
house plan.
The builder's offer of $40,000 is $5,000 less than the EDA's list price of $45,000. As the EDA
discussed when deciding to list this property in January 2013, the lot price reduction is
reasonable and justifiable due to the presence of the small, oddly positioned rental house at
4336 Zane, directly north of the subject property.
REQUESTED EDA ACTION: Tentative acceptance of this proposal subject to EDA
consideration of a resolution authorizing the lot sale at a public hearing on June 4, 2013. The
EDA discussion and motion should be specific about whether to accept the builder's proposal
for a lot price of $40,000 instead of the $45,000 list price.

North — REQUESTED ADDITIONAL AGENDA ITEM
Novak -Fleck has submitted proposals for purchase options on the EDA lots at 3548 and 3556
Welcome Avenue North. Each option will cost the builder $500 for six months, is renewable for
an additional 6 months for another $500, and during the option period the builder is required to
list the property for sale on the MLS as a "to be built" house. Each proposal is attached
including a 2012 aerial photo, preliminary site plan and general house plan. 3548 Welcome
would be a custom build; 3556 Welcome would be a spec home with a final plan to be
determined later depending on market conditions and homebuyer interest.
Considerations:
1. These lots are being sold together, so if the builder wants to exercise the option to
purchase 3548 they will also need to purchase 3556. However, the EDA can change this —
it may instead choose to make these lots available individually, and accept one option
proposal but not the other.
2. EDA approval of the options would serve as tentative acceptance of the builder's
proposals, so that at whatever time the builder exercises the options, staff would schedule
the public hearing for final EDA consideration of the lot sales.
3. The preliminary house plans are as follows:
— 3548 would be a split entry with 1,204 sq. ft. on the upper level and 1,144 sq. ft. on the
lower level. The upper level would have an open living -dining -kitchen area, three
bedrooms and two bathrooms. The lower level would be unfinished with a
laundry/mechanical room and space for a family room, bathroom and two bedrooms to
be finished in the future.

- 3556 would be a split entry with 972 sq. ft. on the upper level and 912 sq. ft. on the
lower level. The upper level would have an open living -dining -kitchen area, two
bedrooms and one bathroom. The lower level would have one bedroom and one
bathroom finished now plus a laundry/mechanical room and space for a combination of
additional bedrooms and/or a family room to be finished later.
- Each house would have an attached three -car garage.
4. The EDA's list price is $55,000 for each lot. The builder is offering $50,000.
- For 3548, the lot price reduction could be justified by the proximity of Hwy 100 and the
proposed house being a larger, custom build.
- For 3556, the lot price reduction could be justified by the proximity of Hwy 100 and
(especially) 36 Avenue. However, the lot's generous size (17,200± sq. ft.) is a major
mitigating factor as it provides space for extraordinary screening and buffering for the
homeowner if they so choose. Also, please note (based on the preliminary site plan)
that after completing the house at 3556 and satisfying the EDA's requirements, the
builder or future homeowner could subdivide the north 9,000± sq. ft. for another house
(3564 Welcome?). This theoretical lot's value would be significantly impacted by the
proximity of 36" Avenue, and the builder/homeowner would need to add a curb cut and
water/sewer stubs, so it is not clear how likely this is to occur.
REQUESTED EDA ACTION: EDA approval of a motion authorizing option agreements with
Novak -Fleck for 3548 and 3556 Welcome Avenue North.
• The EDA motion should indicate the lot price for each lot ($55,000 list price or $50,000
proposed by the builder).
• If it desires, the EDA may accept a price reduction on one lot but not the other.
• The EDA may also decide to make these lots available individually, and thus accept one
option proposal but not the other.

Builders may purchase a 6 -month option on a lot for $500, renewable for an additional 6 months for an additional $500.
The option provides the builder with exclusive rights to purchase the lot and build a house subject to the normal EDA
process, requirements and guidelines. As a condition of the option, the builder must list the lot with a to -be -built house on
the MLS for the duration of the option. The number of options is limited: No builder may have options on more than 10%
of the EDA's lots, and no more than 50% of the EDA's lots may be under option at any time.

SUBJECT: Informational Item: Novak -Fleck planning to build a larger house on the lot
at 5548 Yates Avenue North — REQUESTED ADDITIONAL AGENDA ITEM
On May 7 the EDA held a public hearing and authorized the sale of the lot at 5548 Yates
Avenue North to Novak -Fleck for $50,000. The approved plan was a split entry with 972 sq. ft.
on the upper level and 912 sq. ft. on the lower level and an attached three -car garage.
Based on discussions with several interested buyers since May 7, the builder has concluded
that the market will support a somewhat larger house. On May 20 Novak -Fleck informed staff
that they would like to build a house with 3 bedrooms and two bathrooms on the upper level
(instead of 2BR-1 BA) and 1,204 sq. ft on the upper level (instead of 972). The lower level
would be unfinished, with a laundry/mechanical room and space for a family room, bathroom
and two bedrooms to be finished in the future. The attached three -car garage and its
setbacks would not change, but the house would be two feet deeper across the back, two feet
wider on the south side and four feet wider on the north side. The north side setback would
decrease from 20 to 16 feet but this is still well above the required 5 foot minimum.
No EDA action is required unless you desire to hold the builder to the smaller house plan
approved on May 7.
