CALL TO ORDER The regular meeting of the Crystal Planning Commission convened at 7:00 p.m. with the following present: Sears, Nystrom, Whitenack, VonRueden, Krueger, Hester, and Strand. Also present were the following: Planner Sutter and Recording Secretary Matthews. B. APPROVAL OF MINUTES Moved by Commissioner Nystrom and seconded by Commissioner VonRueden to approve the minutes of the August 8, 2005 regular meeting and work session. Motion carried. C. PUBLIC HEARINGS 1. Consider Application 2005-12 for a Variance at 4532 Douglas Dr N to reduce the rear setback to match the location of the existing house. Planner Sutter summarized the staff report. Staff recommends approval as outlined in the staff report. Public Hearing opened. Public Hearing closed. Moved by Commissioner Nystrom, seconded by Commissioner Hester to recommend to City Council at the October 17, 2005 meeting to approve Application 2005-12 for a Variance at 4532 Douglas Drive N to reduce the rear setback to match the location of the existing house. Commissioner Nystrom stated that the findings of fact are as outlined in the staff report. Motion carried. D. OLD BUSINESS E. NEW BUSINESS Mayor Bowman's discussion will be tentatively postponed until the November meeting. F. GENERAL INFORMATION 1. Developmental Status Report. Commissioner Sears asked how many properties are like 4532 Douglas in Crystal. Planner Sutter replied that there is no way of knowing, but it seems relatively rare. Typically the city is made aware of situations like this when the owner comes forward with a building project. Commissioner Strand asked what is the status of Brunswick Villas. Plamler Sutter stated that this project is moving along slowly, and the builder doesn't seem to have intentions of moving the project along quicker. The city is referring inquiries on the properties to the builder. The city does not know if any of the buildings have sold. Commissioner Kruger asked about the Carpet King business. Planner Sutter replied that they have changed their plans, and will be staying in the existing building, and redoing the landscaping. Commissioner Kruger asked about the Highway 100 properties. Planner Sutter replied that a memo had been sent to MNDOT, and that he would be checking back with them in December regarding the turnback properties. Commissioner Kruger asked what the potential was for businesses on the highway 100 properties. Planner Sutter replied that the only potential location that would be usable for a commercial property would be the small triangle shaped property next to the Cub lot. However the city would like to maintain site control of that property. 2. City Council actions on recent Planning Commission items. 3. The meeting adjourned at 7:20 p.m. Vice Chair Kruger Secretary Strand M E M O R A N D U M DATE: November 7, 2005 TO: Planning Commission (November 14th meeting) FROM: ohn Sutter, Planner and Redevelopment Coordinator SUBJECT: Public Hearing: Consider Application 2005-13 for Lot Division at 4047 Douglas Drive North to detach the west 88 feet of the property and incorporate it into the adjacent Hagemeister Pond Park. A. BACKGROUND The City of Crystal is gradually acquiring property for Hagemeister Pond Park. The property at 4047 Douglas Drive North is approximately 83 feet wide and 295 feet deep, with an area of 24,558 sq. ft. (0.56 acres). The city has determined that it would be desirable for the part of the lot more than 5 feet west of the garage, hereinafter called the "subject property", to be added to the park. The subject property is 83 feet wide and 88 feet deep, with an area of 7,316 sq. ft. (0.17 acres). The current owner, Denise Seth, has agreed to sell the subject property to the city. The following Exhibits are attached: A. Map from the Hagemeister Pond Park planning process. B. Hennepin County aerial photo and plat map showing the proposed acquisition. C. Detailed contour map showing the proposed acquisition. D. Survey showing the proposed acquisition. B. STAFF COMMENTS The parcel remaining with the house at 4047 Douglas would be 83 feet wide and 207 feet deep, or 17,242 sq. ft. in area (0.40 acre). The existing house, garage and site improvements would remain on the downsized 4047 Douglas parcel and would easily comply with setbacks and other requirements of Crystal City Code. The new park parcel would be combined with the existing adjacent park property. The proposed lot division would be in full compliance with city code. Staff can foresee no negative impacts resulting from lot division. C. RECOMMENDATION Staff recommends approval of Application 2005-13 for Lot Division at 4047 Douglas Drive North. Planning Commission action is requested.
