CALL TO ORDER The regular meeting of the Crystal Planning Commission convened at 7:00 pm with the following members present: Sears, Davis, Nystrom, Whitenack, VonRueden, Brennan, and Strand. Also present for the city were Council Liaison Joselyn, City Attorney Norton, and the following staff. Matthews, Peters, Sutter and Zimmermann. B. APPROVAL OF MINUTES Moved by Commissioner Nystrom and seconded by Commissioner Strand to approve the minutes of the March 13, 2006 regular meeting. Motion carried. C. PUBLIC HEARINGS 1. Consider Application 2006-03 for Lot Division to detach the South 3 feet from a new lot at 3548 Zane Avenue North (formerly part of 5817 36th Avenue North) and add it to the adjacent parcel at 3450 Zane Avenue North. 2. Consider Application 2006-04 for a Lot Division to detach the East 3 feet from a new lot at 3556 Zane Avenue North (formerly part of 5817 36th Ave North) and add it to the adjacent parcel at 5813 36th Avenue North. Mr. Sutter summarized the staff report for both items. Public Hearing opened. Public Hearing closed. Moved by Commissioner Nystrom and seconded by Commissioner Brennan to recommend to the City Council to approve Application 2006-03 for Lot Division to detach the South 3 feet from a new lot at 3548 Zane Avenue North (formerly part of 581736 1h Avenue North) and add it to the adjacent parcel at 3450 Zane Avenue North. Findings of fact area as outlined in the staff report. GENERAL INFORMATION Mr. Sutter commented that any discussion of the Development Status Report or City Council actions on recent Planning Commission items were included in the packet, and could be discussed in tonight's work session. He also stated that he was not aware of any items for the next meeting at this time, other than the Preliminary Plat for the Thorson site which would also be discussed in the work session. G. CALL TO ORDER The Crystal Planning Commission convened in work session at 7:15 pm with the following members present: Sears, Davis, Nystrom, Whitenack, VonRueden, Brennan, and Strand. Also present for the city were Council Liaison Joselyn, City Attorney Norton, and the following staff. Peters, Sutter and Zimmermann. B. DISCUSSION ITEMS Planning Commission members provided background information about themselves. Mr. Peters introduced Tim Buck, Ward 3 resident, member of Motor Vehicle Citizens Committee and possible candidate for the open seat on the Planning Commission. 2. Mr. Norton provided information regarding zoning law and the Planning Commission's role. Discussion followed regarding the standards for variances, timeliness requirements for zoning decisions, and related matters. 3. Mr. Sutter and Mr. Peters provided information regarding recent, current and possible future planning and development activities in the city. The main discussions items were the Thorson redevelopment site, the Crystal Airport, and a new Comprehensive Plan for the city to be prepared beginning in 2007. C. ADJOURNMENT The meeting adjourned at 9:05 p.m. Chair Davis Secretary Strand M E M O R A N D U M DATE: May 3, 2006 TO: Planning Commission (May 8th meeting) FROM: Jason Zimmermann, Code Enforcement and Zoning Administrator SUBJECT: Public Hearing: Consider Application 2006-05 for Site Plan Review for a new funeral home at 5125 West Broadway. A. BACKGROUND The subject property is a 84,538 sq. ft. (1.94 acre) site owned by Washburn-McReavy. The site is currently vacant and the applicant is proposing to build a new 9,223 sq. ft. funeral home. Site improvements would include new parking and drive areas, and landscaping. The property is zoned C-2 General Commercial. The funeral home use, not including cremation services, is permitted in the C-2 district. Site plan review is required for the new building and site improvements. Notice of the public hearing was published in the Star Tribune on April 29, 2006 and the Sun Post on May 4, 2006 and mailed to all property owners within 350 feet of the property. At the May 8, 2006 meeting, the Planning Commission will hold the public hearing and may make a recommendation for the City Council to consider at its May 16, 2006 meeting. Landscape plan. B. STAFF COMMENTS 1. Building. The building will be wood frame with a stone and stucco exterior. The main entrance would face northeast, towards West Broadway. There will also be an entrance to the chapel on the southeast side of the building. An overhead door and two service doors provide access for employees and vehicles on the southwest side of the building. SITE PLAN REVIEW - WASH BURN-MCREAVY (5125 WEST BROADWAY) PAGE 1 OF 4 Conditions recommended by staff: ■ Per plan, one hydrant supplying the minimum fire flow of 1500 gpm is acceptable. Ensure that the hydrant is free and clear of obstructions. The landscape plan shows bushes in the area. Minimum clearance of 3 feet shall be kept around the hydrant at all times. ■ Per West Metro Fire District policy, the hydrant provided shall be within 100 feet of the fire department connection. Show location of fire department connection on the final plans. ■ Show location of utilities throughout building such as fire sprinkler riser location, fire alarm panel, domestic water, electric, etc. on the final plans. ■ If direct access is not provided to sprinkler control valves, then outside control of sprinkler system shall be provided. The preferred method is a wall post indicator unless the sprinkler riser is to be below grade, which will require a PIV. ■ Ensure sprinkler contractor has approved plans and permit before any work is completed. ■ A fire department lock box shall be provided. Order information and mounting location will be provided by the Fire Inspector. Provide occupancy types and locations in the building for further review. ■ The building shall have address numbers at least 4 inches high and in a contrasting color and visible from West Broadway, 3. Parking, traffic and sidewalks. The Zoning Ordinance requires 83 parking spaces; 83 would be provided. Access would be from one 24' wide driveway on West Broadway and one 24' wide driveway from the cemetery property. The curb cut on West Broadway is currently 21' in width and would need to be widened as part of this project to provide an opening of at least 24'. City Code would allow a maximum curb cut width of 32' for this property. A Hennepin County permit is required prior to any work being performed on the curb cut. There is public sidewalk along the street frontage. 4. Signs. Sign plans were not submitted with the application. The site plan does show a new cemetery entrance sign along West Broadway. Permits are required prior to installation of signs. 5. Landscaping. The applicant would plant 12 shade trees, 5 evergreens and 82 shrubs and bushes of various varieties. The City Forester has reviewed the plans found them to be generally acceptable. SITE PLAN REVIEW - WASHBURN-MCREAVY (5125 WEST BROADWAY) PAGE 2 OF 4 Conditions recommended by staff: • Serbian Spruce shall be substituted for Colorado Blue Spruce (hardier and narrower). • Red Maple is ok, however the planting schedule must be changed to Acer rubrum, not Acer platanoides. • Back soil should not be isolated. Mix with native soil or else you will get "flower pot effect". • All landscape areas except for mulch or rock planting beds shall be sodded. • All landscape areas shall be irrigated. 6. Lighting. A lighting plan was not submitted with the application. Staff has discussed this with the applicant and a plan will be submitted. The plan must be received by the City and reviewed for approval by staff prior to the issuance of a building permit. 7. Drainage and Utilities. The proposed parking lot would slope down south to catch basins which would connect to the storm sewer system which runs into a retention pond at the south west corner of the property. City water is available from West Broadway. The applicant is proposing to install a new 8 inch supply line tapping into the main under West Broadway. The applicant is proposing a 6 inch sanitary sewer to be connected to the main under West Broadway. Electric and communications lines serving the new building shall be underground, in accordance with city code. 8. Surety required. City code requires financial surety for completion of the required site improvements. Typically, the amount of surety is determined based on all of the estimated landscaping cost plus a portion of estimated paving and utilities costs. Staff is recommending that the required surety be $138,400, with $99,900 to be released upon satisfactory completion of the site improvements and $38,500 to be released after at least one full year has passed since installation of the landscaping. As required by city code, the surety must be in the form of a cash escrow deposit or an irrevocable letter of credit in a form acceptable to the city. Conditions recommended by staff: ■ No building permit shall be issued until the required $138,400 -surety and an executed site improvement agreement are provided to the city. C. RECOMMENDATION SITE PLAN REVIEW - WASHBURN-MCREAVY (5125 WEST BROADWAY) PAGE 3 OF 4 Staff recommends approval of the submitted plans for construction of a new funeral home at 5125 West Broadway, subject to the following conditions: 1. The curb cut on West Broadway must be widened to a minimum 24 feet in width. A Hennepin County permit is required prior to any work being performed on the curb cut. 2. Fire sprinkling is required. The sprinkler system will be required to be supervised by a monitoring system. A permit is required; sprinkler plans shall be submitted to the city for review. 3 4 5 6 I. - All conditions listed under Staff Comments #1 Building must be met. A sign permit is required prior to installing any signs. All conditions listed under Staff Comments # 5 Landscaping must be met. All utilities serving the new building, including electrical and communications, shall be located underground. No building permit shall be issued until the required $138,400 surety and an executed site improvement agreement are provided to the city. A lighting plan must be submitted for review and approval by staff prior to the issuance of a building permit. The suggested findings of fact are that the proposed use would be consistent with the Comprehensive Plan and city code, provided the recommended conditions are met. Planning Commission action is requested. The City Council would consider the Planning Commission's recommendation at its next meeting on May 16, 2006. A. BACKGROUND The Economic Development Authority of the City of Crystal (EDA) has acquired the former Thora Thorson Elementary School site for infill redevelopment: The EDA is proposing to plat the six (6) acre site for 17 lots to be used for new single family homes. The lot sizes will be 10,000 square feet or larger. A new street would be constructed (Oregon Court) extending south from 58th Ave N and ending in a cul-de- sac. The EDA plans to demolish the existing structure and sell the 17 newly platted lots to a builder for construction of new single family houses. The following Exhibits are attached: A. Project Narrative. B. General area map. C. Aerial photo of area (prior to demolition of school). D. Aerial photo showing platted area. E. Color rendering of the preliminary plat. F. 2005 survey. G. Preliminary plat. H. Preliminary grading plan. I. Preliminary utility plan. J. Proposed addresses. K. Proposed street light locations. Notice of Public Hearing was published on April 29, 2006 in the Star Tribune and May 4, 2006 in the Sun Post. It was also mailed to all property owners within 700 feet of the subject property, as well as to the city of New Hope for notification to owners of nearby property in their city. The mailed notice included a copy of the proposed preliminary plat and grading plan. At the May 8, 2006 meeting, the Planning Commission will hold the public hearing and may make a recommendation for the City Council to consider at its May 16, 2006 meeting. PRELIMINARY PLAT - THORA THORSON ADDITION (7323 58TH AVE N) PAGE 1 OF 2 B. STAFF COMMENTS The area is guided Low Density Residential and zoned R-1. This allows single family subdivisions of single family detached homes at densities not to exceed 5 units per gross acre. The density of the proposed subdivision will be 2.83 units per gross acre. All of the proposed lots meet the city's minimum width (60'), depth (100') and area (7,500 sq. ft.) requirements. The plat includes the following easement dedications: ■ 10' drainage and utility easements along all front lot lines. ■ 5' drainage and utility easements along all interior and side street lot lines. ■ 20' drainage and utility easements along all rear lot lines. The new homes will be accessed from the newly constructed Oregon Court. The street will be constructed with new concrete curb & gutter. There will not be sidewalks along the street. The EDA expects to install three street lights. New water and sanitary sewer mains will be built under the new street. Because this plat would result in 17 units on the site, a SAC fee in the amount of $26,350 would be paid by the EDA, less any SAC credits for demolition of the school building. Drainage will be accommodated with a combination of swales, dry ponds and storm sewer. Shingle Creek Watershed review is not required for this project. Centerpoint Energy will install a new gas main in the boulevard along the new street. Xcel (electric), Qwest (telephone) and Comcast (CATV) will either install new main lines in a joint trench with Centerpoint Energy, or rely on existing overhead main lines along the rear lot lines of the new lots. In either case, the services to the new homes will be underground. The City's standard park dedication requirement is $1,000 per new residential unit. Because this plat would result in a net gain of 17 units, park dedication in the amount of $17,000 is required. The EDA would transfer this amount to the appropriate parks capital improvement fund prior to recording the final plat. Demolition of the existing structure will be completed by June. The lots for the 17 new houses would be sold this fall, and new house construction would begin in late 2006 or early 2007. C. RECOMMENDATION Staff recommends that the Planning Commission recommend approval of Application 2006-06 for Preliminary Plat of Thora Thorson Addition. Suggested findings of fact are as follows: ■ The proposed Preliminary Plat is consistent with the requirements of city code. PRELIMINARY PLAT - THORA THORSON ADDITION (7323 58T" AVE N) PAGE 2 OF 2 THORA THORSON ADDITION Project Narrative In October 2005, the Economic Development Authority of the City of Crystal ("the EDA") purchased the former Thorson Elementary School, 7323 58th Avenue North (P.I.D 05-118-21- 31-0004) from Robbinsdale Area Schools. Abatement of asbestos and other hazardous materials occurred from December 2005 through March 2006. General demolition began in April 2006 and is expected to be completed no later than June 19, 2006. The EDA plans to redevelop the 6 acre site for new single family houses. It would build a new street (Oregon Court) extending south from 58th Avenue and ending in a cul-de-sac. 17 lots will be platted on the new street. The lot sizes will be 10,000 sq. ft. or larger. The EDA has hired the engineering firm of Schoell & Madsen to prepare the preliminary plat for Planning Commission review and City Council approval. The EDA would then hire contractors to complete the site grading and install the infrastructure (street, water, sewer, etc.) during summer 2006.
