CALL TO ORDER The regular meeting of the Crystal Planning Commission convened at 7:00 pm with. the following present: Sears, Nystrom, VonRueden, Hester, Brennan, and Strand. Also present were the following: City Planner Sutter, Zoning Administrator Zimmermann and Recording Secretary Matthews. B. APPROVAL OF MINUTES Moved by Commissioner VonRueden and seconded by Commissioner Nystrom to approve the minutes of the January 9, 2006 regular meeting. Motion carried. C. PUBLIC HEARINGS 1. Consider Application 2005-14 for Rezoning of 3249 Douglas Drive North from R-1 Low Density Residential to R-2 Medium Density Residential. Zoning Administrator Zimmermann summarized the staff report, and outlined the ten conditions that are listed in the staff report as part of the conditions of approval. Commissioner Strand asked how high the fence would be. Zoning Administrator Zimmermann stated that the fence would be three feet high. Commissioner Nystrom asked for clarification regarding the condition that tobacco smoke would not interfere. Zoning Administrator Zimmermann stated that smoke must not enter the restaurant from the patio via the doors. Commissioner Brennan asked how that would be enforced. Zoning Administrator Zimmermann stated that it would be enforced on a complaint basis by the Environmental Health Specialist. Public Hearing opened. Public Hearing closed. Moved by Commissioner VonRueden, seconded by Commissioner Brennan, to recommend to City Council at the March 21, 2006 meeting to approve Application 2006-01 for a Conditional Use Permit for Fieldhouse Sports Tavern and Grill to establish a patio seating area for outdoor food and beverage service at 5632 West Broadway. Findings of fact are as outlined in the staff report. Motion carried. 2. Consider Application 2006-02 for a Preliminary Plat to divide 5817 36th Avenue North into two lots for two new single family homes. Planner Sutter summarized the staff report, and stated that staff recommends approval of the plat. Scott Buchheit of 5902 36th Avenue North asked where sewer and water connections would be located. Planner Sutter answered that the existing sewer stub is in 36th and the water is in Zane, and the new sewer and water stubs would both be installed in Zane. Commissioner Nystrom asked if there was going to be any road work on Zane Avenue. Planner Sutter replied that Zane and 36th Avenue are both relatively new streets so there should be no road construction. Scott Buchheit of 5905 36th Avenue North asked about drainage problems around the 36th and Zane Avenue intersection. Commissioner Hester asked if Zane had curb and gutter and if the water went over the curb. Buchheit stated that it does have curb and gutter and that the water does not exceed the curd. Buchheit continued to explain the history of the drainage issue with the area, and the property that is being re -platted by the city. Discussion continued amongst the Planning Commission members. It was determined by that this was an issue that would need to be addressed by the City Engineer, and possibly Bruchheit's elected officials if need be. Public hearing opened. Public hearing closed. Pro Tem Sears asked Planner Sutter for clarification on the setbacks for the proposed plat. Planner Sutter clarified the setbacks. Moved by Commissioner Nystrom and seconded by Commissioner Brennan to recommend to City Council at the March 21St, 2006 meeting to approve Application 2006-02 for a Preliminary Plat to divide 5817 36th Avenue North into two lots for two new single family homes. Findings of fact are as stated in the staff report. Motion carried D. OLD BUSINESS E. NEW BUSINESS F. GENERAL INFORMATION Planner Sutter stated that he was not aware of any items for the next meeting at this time. Planner Sutter stated that staff was hoping that the vacant Planning Commission seat would get filled soon so the city could hold the work session with the attorney. Planner Sutter also mentioned that in May staff was hoping to have the preliminary plat done for the redevelopment of the Thorson School site. G. OPEN FORUM H. Consider Application 2006-04 for Lot Division to detach the East 3 feet from a new lot at 3556 Zane Avenue North (formerly part of 5817 36th Avenue North) and add it to the adjacent parcel at 5813 36th Avenue North. A. BACKGROUND In January 2006 the Economic Development Authority of the City of Crystal ("the EDA") acquired 5817 36th Avenue North to be demolished and replatted into two lots for new house construction. The new plat is entitled Crystal Economic Development Authority Second Addition; the preliminary plat was approved by the City Council on March 21, 2006; approval of the final plat is pending. The proposed addresses for the two new house lots are 3548 Zane (Lot 1) and 3556 Zane (Lot 2). The houses adjacent to the EDA property, 3540 Zane to the south and 5813 36th to the east, are non -conforming with respect to their setback from EDA property. Specifically, the house on each property is only 2-3 feet from the side lot line. The minimum side setback is 5 feet. If the EDA would sell a 3 foot strip of each lot for combination with the respective adjacent property, then the existing side setback nonconformity would be eliminated. The EDA authorized these sales at its April 4, 2006 meeting. The next step is for the Planning Commission to hold a public hearing prior to the City Council approval of the lot splits. Notice of the public hearing was published in the Sun Post on March 30, 2006 and mailed to all property owners within 350 feet. At the April 10, 2006 meeting, the Planning Commission will hold the public hearing and make a recommendation for the Council to consider at its March 21, 2006 meeting. Pending Final Plat showing proposed new lot lines. D. Site sketch showing buildable areas remaining on the two EDA lots. B. STAFF COMMENTS Proposed division of 3548 Zane (Lot 1). As platted, 3548 Zane is 75 feet wide and 106 feet deep with an area of 7,954 sq. ft. (0.18 acres). The EDA would sell the south 3 feet to the owner of 3540 Zane for combination with that property. This realignment of the lot line would correct the side setback nonconformity at 3540 Zane. The remaining EDA lot at 3548 Zane would be 72 feet wide and 106 feet deep, with an area of 7,636 sq. ft. 2. Proposed division of 3556 Zane (Lot 2). As platted, 3556 Zane is 90.7 feet wide and 106 feet deep with an area of 9,629 sq. ft. (0.22 acres). The EDA would sell the east 3 feet to the owner of 5813 36th for combination with that property. This realignment of the lot line would correct the side setback nonconformity at 5813 36th. The remaining EDA lot at 3556 Zane would be 90.7 feet wide and 103 feet deep, with an area of 9,357 sq. ft. C. RECOMMENDATION Staff recommends Planning Commission approval of Applications 2006-03 and 2006- 04. Planning Commission action on each application should be in the form of a separate motion. The City Council will consider the proposed lot divisions at its April 18, 2006 meeting. Approved a preliminary plat to divide an EDA -owned property at 5817 36" into two lots for new single family houses. The Council's actions on these items were consistent with the Planning Commission's recommendations. CITY OF CRYSTAL Development Status Report March 31, 2006 PLANNING COMMISSION AND CITY COUNCIL - STATUS OF PREVIOUSLY APPROVED SPECIAL LAND USE APPLICATIONS: Brunswick Villas (3148 Douglas). On December 6, 2004, the City Council approved Brunswick Villas, a privately -initiated, 18 -unit townhouse project being built by SML Land Development on the south side of 32nd between Douglas and Brunswick. During summer 2005, the developer installed geo-piers (to deal with the poor soils on the site) and the site improvements including water, sewer and private drives. Construction is underway on the first six dwelling units; they will probably be completed by spring 2006. Each unit will have three bedrooms, two bathrooms and 1,928 sq. ft. of finished space; a front door and small porch facing north; and an attached two -car garage facing south. The developer has indicated that each unit will probably sell for around $250,000. For more information call Mike Thomas of SML Land Development at (763) 238-3282. 2. Crystal Aquatic Center (4800 Douglas). On June 21, 2005, the City Council approved a site plan and conditional use permit for a full renovation of the city's municipal pool and related structures. Construction is underway. The goal is for the facility to be completed and re -opened in summer 2006. 3. Prescription Landscape (3231 Nevada & 7331 33rd). On August 16, 2005, the City Council approved a conditional use permit to allow outdoor storage as part of a proposed landscaping business, subject to submittal of a site improvement plan that must be reviewed and approved by city staff prior to commencement of outdoor storage. A permit for the new parking lot and related site improvements was issued on November 7, 2005 but work is not yet complete. 4. 5330 Perry. On January 17, 2006, the City Council approved a variance for this single family house with public streets on three sides. The variance modified the setback requirements so they now match those in effect when the house was built in 1965. 5. 3249 Douglas. On February 7, 2006, the City Council approved rezoning from R-1 Low Density Residential to R-2 Medium Density Residential. Living Works Ventures is planning to demolish the existing house and construct a two -unit supportive housing facility. It would be similar to their facility at 3200 Douglas. Living Works Ventures is required to submit detailed site and building plans for Planning Commission review and City Council approval before a building permit for the facility is issued. 6. CPRR property west of Douglas. On February 7, 2006, the City Council approved a Comprehensive Plan Amendment to modify the Future Land Use map and create a Special Area Plan for unaddressed Canadian Pacific Railroad property north of H:IDeve/opmentStatusReports12006-1st quarter.doc Page 1 of 3 the railroad tracks and west of Douglas Drive. While this does not allow immediate redevelopment of the property, it does set the stage for a private developer to come up with a more detailed plan for cleaning up and improving the property. 7. Fieldhouse (5632 West Broadway) On March 21, 2006, the City Council approved a conditional use permit for a patio seating area and outdoor food/beverage service. 8. 5817361h . On March 21, 2006, the City Council approved a preliminary plat to divide this EDA -owned property into two lots for new single family houses. (See item #11 below for more information about the EDA project.) ECONOMIC DEVELOPMENT AUTHORITY REDEVELOPMENT ACTIVITIES 9. Brunswick Fields. In the second half of 2003, the EDA purchased 4120, 4130 and 4140 Brunswick, each of which had a 1 00'wide lot. In the spring and summer of 2004, the EDA demolished the existing structures and then replatted the site into four lots for new house construction. Two of the new lots are 78' wide and two are 72' wide. In fall 2004, the EDA sold the property to Al Stobbe Homes for $340,000, or $85,000 per lot. 1. 4142 Brunswick: Lot is 78'x 135'; house is a 2 -story with 3,877 sq. ft. (2,303 finished), 4 bedrooms, 2%2 baths, and an attached 2 -car garage. The house sold for $435,600 in January 2006. 2. 4134 Brunswick: Lot is 72' x 135'; house is a 2 -story with 3,335 sq. ft. (2,164 finished), 3 bedrooms, 2'/ baths, and an attached 2 -car garage. The house sold for $379,900 in June 2005. 3. 4126 Brunswick: Lot is 78' x 135'; house is a 1'/2 -story with 4,482 sq. ft. (2,682 finished), 3 bedrooms, 2%2 baths, and an attached 3 -car garage. The house sold for $440,000 in May 2005. 4. 4118 Brunswick: Lot is 72' x 135'; house is a 2 -story with 3,880 sq. ft. (2,538 finished), 3 bedrooms, 2'/2 baths, and an attached 3 -car garage. The house sold for $434,500 in September 2005. 10. 4700 Hampshire. In August 2005, the EDA purchased this property for $100,000. The existing house was demolished in October 2005. The EDA sold the lot to Feyereisen Construction in November 2005. They are building a 2 -story house with 4,084 sq. ft. (2,349 finished), 3 bedrooms, 2%2 baths, and an attached 3 -car garage. Construction of the new house is expected to begin in spring 2006 and must be completed by August 2006. 11. 4424 Adair. In September 2005, the EDA purchased this property for $104,160. The existing house was demolished in November 2005. The EDA sold the lot to Al Stobbe Homes in December 2005. They are building a 2 -story house with 3,051 sq. ft. (2,597 finished), 4 bedrooms, 3'/2 baths, and a detached 2 -car garage. Construction of the new house is underway and completion is expected by summer 2006. H:lDevelopmentStatusReportsl2006-1st quarter.doc Page 2 of 3 12. 4300 Xenia. In December 2005, the EDA purchased this property for $115,000. The existing house will be demolished by spring 2006. The EDA expects to seek proposals from builders in April 2006; select a builder in May 2006; and close on the sale of the lot to the builder in June 2006. Construction of the new house is expected to begin in summer 2006 and must be completed by spring 2007. 13. 581736 th . The EDA has entered into a purchase agreement for this house located on an oversized lot that can be divided into two lots. Closing is expected in January 2006, followed by demolition and lot division by spring 2006. The EDA would seek proposals from builders in April 2006; select a builder in May 2006; and close on the sale of the lots to the builder in June 2006. Construction of the new house is expected to begin in summer 2006 and must be completed by spring 2007. 14. 43xx Zane. Over the last several years, the EDA has acquired and demolished four houses on the `Yates Alley' block between 43`d and 44th Avenues. The EDA -owned properties are 4306, 4310, 4326 and 4330 Zane. All are being land banked for future redevelopment. The City Engineer will prepare an alley paving feasibility study for this block in April 2006. Depending on the outcome of that study, the City Council may decide to order the alley paving project. If it does, then the EDA may decide to move forward with the sale of these lots in summer 2006 for construction of new single family houses. 15. Thorson (7323 58th). In October 2005, the EDA purchased the former Thorson Elementary School from Robbinsdale Area Schools. Abatement of asbestos and other hazardous materials occurred from December 2005 through March 2006. General demolition is expected to begin in April 2006 and be completed by June. The EDA intends to redevelop the 6 acre site for new single family houses. It would build a new street (Oregon Court) south from 58th and ending in a cul-de-sac. The lot sizes will be approximately 10,000 sq. ft. or larger. The new houses will be market -rate, not subsidized housing. Given regional market conditions and the demand for move -up houses in Crystal, the value of the new houses will likely be greater than $300,000. The EDA has hired the engineering firm of Schoell & Madsen to prepare the preliminary plat and infrastructure design, including street, water, sewer and other utilities. The Planning Commission is expected to hold a public hearing regarding the plat on May 8th followed by City Council action on May 16th. The EDA expects to install the infrastructure and begin marketing the lots this summer. Lot sales would be completed in fall 2006, and new house construction could begin at that time. 16. Highway 100 land use (excess right-of-way). In October 2004, the City Council amended the Comprehensive Plan to designate appropriate land uses on parcels of excess right-of-way adjacent to the new Hwy 100 freeway. In January 2005, the city's Economic Development Authority made a formal redevelopment request to MnDOT to get the parcels surveyed and appraised for possible purchase by the EDA. MnDOT says it has nearly completed processing the request. The next step would be for the property to be appraised and a price negotiated between MnDOT and the EDA. Acquisition of some or all of the excess right-of-way parcels may occur later in 2006.
