CALL TO ORDER PAGE I OF 5 The regular meeting of the Crystal Planning Commission convened at 7:00 pm with the following members present: Sears, Nystrom, Whitenack, VonRueden, Buck, Hester, Schiebe and Strand. Also present were city staff members Sutter and Zimmermann, and Council Liaison Anderson. B. APPROVAL OF MINUTES Moved by Commissioner Nystrom and seconded by Commissioner Buck to approve the minutes of the April 9, 2007 regular meeting. Motion carried. C. PUBLIC HEARINGS 1. Consider Application 2007-03 for a Preliminary Plat and Site Plan Review for a retail building at 4921 West Broadway. Mr. Zimmermann summarized the staff report, and said that the only additional item not addressed in the staff report is that the proposed building exterior does have some blank walls and these are not permitted by code. Commissioner Sears asked about sign setbacks, and whether the sign would need to be brought back to the Planning Commission. Mr. Zimmermann said the setback is 10 feet from the lot line and plan review and permit issuance would be handled by staff. Chair Whitenack asked about the minimum trash enclosure setback; Mr. Zimmermann said it is 5 feet. Chair Whitenack asked about the metal building exterior and lack of ornamentation; Mr. Zimmermann said the metal exterior does meet our code requirements but Planning Commission may add conditions requiring specific ornamentation instead of blank walls. Commissioner Hester asked how merchandise is delivered to the site; Mr. Zimmermann said that question would best be answered by Mr. Wold from O'Reilly Auto Parts. Public hearing opened. Robert Hall (no address provided) spoke in opposition to the project with the following questions and comments: ■ Have there been any independent traffic studies showing the impact of the project? After "no" answers from Mr. Wold and Mr. Zimmermann, he said such studies should be done; there's already a speeding problem on Fairview and Zane PAGE 2 OF 5 due to cut -through traffic; what about cars stopping in traffic to turn from west Broadway into the O'Reilly parking lot? ■ How far away from the site did the city send the hearing notice? After a "350 -- feet" answer from Mr. Zimmermann, he said that's not far enough. ■ Is concerned about loud car stereos from the O'Reilly parking lot. ■ Is concerned about the presence of a liquor store across the street; he's in the auto business, knows that people drink while working on cars, and that they will drink and drive; there should be a study done about that. There should also be a study done regarding a pedestrian crossing between the liquor store and O'Reilly. ■ How many deliveries will the store make to its customers, and what sort of trucks will be used? And what about deliveries from the warehouse? ■ Absolutely there should be no access to the alley or Xenia Avenue. ■ How often are dumpsters picked up? It's noisy. ■ The building's metal walls will cause noise to echo. ■ Will there be compensation paid for devaluing adjacent houses? Will it be lump some or a recurring payment? ■ How high is the building, and what is the texture of the exterior? ■ Have they considered other locations in the area? Mr. Wold said there are no other options in the area. Chair Whitenack offered that many of Mr. Hall's questions could be answered by reviewing the materials in the Planning Commission packet. Mr. Zimmermann explained to Mr. Hall that the materials have been available for public review at City Hall. Commissioner Strand asked how high the berm along Xenia would be. Mr. Zimmermann said the plans show 5 feet but Chair Whitenack said based on the width of the berm it could only be about 3 feet high. Mark Wold representing O'Reilly Auto Parts addressed the Commission: ■ They agree with the staff recommendation except denial of access to the alley. When they first began researching this site, staff told them no access to Xenia, only to West Broadway and the alley. There is no way to turn a truck around on- site; that's why access to the alley is critical. They will not guarantee that there will never be an 18 -wheeler making a delivery to the site but occasionally there will be, perhaps once per day; and alley access is necessary for 18 -wheelers to exit the site. A 16 foot wide exit drive would be too narrow; they'd prefer 24 feet but 18 feet would work. ■ They are willing to skin the building with something like stucco or decorative metal panels, and will change the back wall so it's not blank, although they'd prefer not to put in windows for security reasons. ■ Half their business is delivery to dealers. ■ They discourage customers from doing work in the parking lot, and they don't sell car stereos. Public hearing closed. PAGE 3 OF 5 Commissioner Hester asked how deliveries would occur without a loading dock. Mr. Wold responded that trucks would stop in the drive aisle of the parking lot, drop their tailgate, unload, then drive out through the alley. Chair Whitenack asked about delivery times. Mr. Wold answered that there wouldn't be 18 -wheelers after 5:00 p.m. but other trucks would be anytime from 6:00 a.m. to 10:00 P.M. Commissioner Hester said he felt customer traffic might be more of a problem on Xenia than deliveries. Mr. Wold responded that they can restrict employees but not customers. Chair Whitenack asked if the proposed parking exceeds the city's requirements. Mr. Zimmermann answered they show 31 spaces but city requires minimum of 27. Chair Whitenack asked why not downsize the parking lot and use the available space to provide turn -around area for trucks? Mr. Wold said they want as many parking spaces as possible, not just the minimum required by the city. Commissioner Sears asked if 18 -wheelers are there only once per day why not have a gate on the alley exit and restrict its use only for the 18 -wheelers? Mr. Wold said a gate would be impractical plus trash hauler needs to do weekly pickup using alley. Chair Whitenack suggested re -aligning the drive aisles so it's not a straight shot from West Broadway to the alley, or replacing some parking stalls with landscape islands and install "Do Not Enter" signs to discourage customers from using the alley access. Mr. Wold said they could do that. Mr. Zimmermann suggested that any Planning Commission action on the application include specifics regarding the building exterior and traffic signage and access issues. Commissioner Sears asked if the road can handle an 18 -wheeler? Mr. Sutter answered that West Broadway could because it is a county road, but the City Engineer would probably object to such vehicles on Xenia. Mr. Sutter said tonight is the first time city staff has heard about 18 -wheelers so that has not previously been considered by staff including the City Engineer. Commissioner Nystrom asked about emergency vehicle access. Mr. Zimmermann responded that West Metro Fire Rescue District staff have reviewed and approved the project with changes included in the staff recommendation. Chair Whitenack said it's probably okay for trucks to exit the site using the alley and Xenia. Commissioner VonRueden said minimal truck traffic like 1 per day would be okay provided signage and a landscape island are added as suggested by commissioner Whitenack. PAGE 4 OF 5 Mr. Wold said the typical truck would be like a U -Haul or UPS truck but there will occasionally be 18 -wheelers. Mr. Sutter said that staff needs to discuss the issue of 18 -wheelers with the City Engineer, it is likely that the City Engineer won't approve the use of a residential street for 18 -wheelers exiting the site, businesses can operate without 18 -wheelers making deliveries directly to a retail store if merchandise is transferred to smaller trucks at a warehouse then delivered to the store, that's what many retail businesses do especially on smaller sites like the subject property. Moved by Commissioner Buck and seconded by Commissioner Nystrom to continue until June 11, 2007 the consideration of a Preliminary Plat and Site Plan Review for a retail building at 4921 West Broadway. Motion carried. D. OLD BUSINESS E. NEW BUSINESS F. GENERAL INFORMATION Planning Commissioners expressed their desire that the new staff report for Application 2007-03 (O'Reilly Auto Parts) for the June 11, 2007 meeting include specific items: _ ■ Chair Whitenack confirmed that staff would be preparing a new staff report and recommendation based on new information and discussion tonight. ■ Commissioner VonRueden asked that the staff report include specific improvement to the building exterior. ■ Commissioner Buck suggested they could plant bigger trees closer to the rear wall to improve appearance. Commissioner Sears suggested they could put some windows in the rear wall and design them so they don't create a security problem. G. OPEN FORUM Commissioner Hester asked about the content of the updated Housing Maintenance Code being adopted by the City Council and how it relates to the Comprehensive Plan update. Mr. Sutter said the new code is an implementation tool based on the current Comprehensive Plan's strategy for maintaining existing housing in the city, and that any Planning Commissioners wanting a copy of the new code or related materials could call staff to request it. PAGE 5 OF S The meeting adjourned at 8:08 p.m. Chair Whitenack Secretary Hester M E M O R A N D U M DATE: June 4, 2007 TO: Planning Commission (June 11th meeting) FROM: Jason Zimmermann, Code Enforcement and Zoning Administrator SUBJECT: CONTINUED FROM MAY 14, 2007 MEETING: Consider Application 2007-03 for Preliminary Plat and Site Plan Review for a new retail building at 4921 West Broadway. A. BACKGROUND The subject property is a 38,188 sq. ft. (.87 acre). The site is currently vacant and the applicant is proposing to build a 6,600 sq. ft. auto parts store. Site improvements would include new parking and drive areas, and landscaping. The applicant has also submitted a Preliminary Plat to combine the 3 existing lots and provide a 7 foot right-of- way dedication for County Road 8. The property is zoned C-2 General Commercial. Retail sales are permitted in the C-2 district. Site plan review is required for the new building and site improvements. Notice of the public hearing was published in the Sun Post on May 3, 2007 and mailed to all property owners within 350 feet of the property. At its May 14, 2007 meeting, the Planning Commission voted 9-0 to continue the request to its June 11, 2007 meeting due to architectural concerns with the building and the fact that more information was needed regarding the type of delivery trucks that would be delivering to the property. Narrative from applicant indicating type of delivery trucks and delivery times. B. STAFF COMMENTS — SITE PLAN 1. Building. The entrance will face West Broadway. Exterior materials will consist of a texture -cote wall panel system, a 4 foot brick fagade around the entire building, and two false windows on the back wall of the building. Comments from West Metro Fire District and City Staff: • A floor plan and layout must be submitted for review and approval prior to the issuance of a building permit. • The building shall be sprinkled per Minnesota State Building Code, Chapter 1306. Any M occupancy that is over 2000 square feet shall be sprinkled. • There shall be a separate water main going into the building for the sprinkler system. The main shall be large enough to accommodate the sprinkler system. A meter shall be required on the sprinkler riser. • The sprinkler system shall be monitored by a fire alarm company. There shall be horn(s)/strobe(s) located on the interior/exterior of the building for a water flow alarm per Minnesota State Fire Code and West Metro Fire - Rescue District. • Address numbers shall be located large enough to see from street and of a contrasting color on the street side of the building. • All doors leading to mechanical, electrical, roof access and sprinkler riser rooms shall have signage per Minnesota State Fire Code, Section 510. • A fire department lock box shall be located on the building by the fire department sprinkler connection. • There shall be a fire hydrant within 100 feet of the fire department PRELIMINARY PLAT AND SITE PLAN REVIEW - O'REILLY'S (4905 WEST BROADWAY) PAGE 2OF6 connection per West Metro Fire -Rescue District. West Metro will verify that the proper number of hydrants are available. 2. Parking, traffic and sidewalks. The Zoning Ordinance requires 27 parking spaces; 31 would be provided. Access would be from one 32' wide driveway on West Broadway. A Hennepin County permit is required prior to any work being performed on the curb cut. Sidewalks will be installed along West Broadway and Xenia Ave N. B6-12 curb and gutter is required around perimeter of parking lot. This includes the sidewalk adjacent to the building. The site plan shows an exit to the alley which leads to Xenia Ave N. The applicant has indicated that a rear entry is needed for delivery trucks to exit the site. Staff feels the exit to the alley is more of a convenience then a necessity and does not feel there should be any access to Xenia Ave N from the proposed retail store. Xenia Ave N is designated as a Local Road and staff does not want the proposed retail store to generate cut -through traffic through this residential neighborhood. West Broadway is a Major Collector and all customer and delivery traffic should use this street. The site plan can be amended to allow for a turnaround for the delivery trucks so they can safely exit via West Broadway. Since the last meeting, the applicant has provided staff with a narrative (Exhibit O) describing the size of their delivery trucks and the times of deliveries. 28 foot box trucks will be used. If the Planning Commission decides to allow the alley access despite the staff recommendation, then it should consider imposing a specific prohibition on vehicles exceeding 28 feet long or 30,000 pounds gross vehicle weight. 3. Signs. Sign plans were not submitted with the application. The site plan does show a new pole sign near the West Broadway entrance. Permits are required prior to installation of signs. 4. Landscaping. Per staff's request, instead of the fence originally proposed by the applicant, plantings would be installed along Xenia Ave N to provide screening from the adjacent homes along Xenia Ave N. Additional plantings are shown within PRELIMINARY PLAT AND SITE PLAN REVIEW - O'REILLY'S (4905 WEST BROADWAY) PAGE 3 OF 6 parking lot islands and other landscaped areas. There is not sufficient space between the parking lot and property line for a berm. To provide sufficient screening, staff recommends replacing "C -Dwarf Common Juniper" with Winged Eunymus (4' to 5') or October Glory (6' to 8'). The City Forester does see a problem with planting Pagoda Dogwoods in the parking lot islands. Dogwoods should be placed in cooler areas where moisture is abundant. Staff recommends replacing the Dogwoods with "Ivory Silk" tree lilacs. 5. Lighting. A site photometrics plan was submitted and is in compliance with City Code. 6. Drainage and Utilities. The proposed parking lot would drain north to a dry pond and where a detention outlet would be installed. This detention outlet would then drain to the existing inlet at West Broadway and Fairview Ave N. City water is available from West Broadway. The applicant is proposing a 4 inch sanitary sewer to be connected to the main under the alley. Electric and communications lines serving the new building shall be underground, in accordance with city code. 7. Surety required. City code requires financial surety for completion of the required site improvements. Typically, the amount of surety is determined based on all of the estimated landscaping cost plus a portion of estimated paving and utilities costs. Staff is recommending that the required surety be $50,000, with $45,000 to be released upon satisfactory completion of the site improvements and $5,000 to be released after at least one full year has passed since installation of the landscaping. As required by city code, the surety must be in the form of a cash escrow deposit or an irrevocable letter of credit in a form acceptable to the city. PRELIMINARY PLAT AND SITE PLAN REVIEW - O'REILLY'S (4905 WEST BROADWAY) PAGE 4OF6 C. STAFF COMMENTS — PLAT 1. Lot Area. The proposed plat, to be titled "O'Reilly Addition", would consist of one lot: Lot One, Block One would have a proposed address of 4921 West Broadway and consist of 34,805 square feet. The property is zoned C-2, General Commercial. Section 515.49 Subd. 5 requires a minimum area of 20,000 sq. ft. The lot would meet this requirement. 2. Easements. The first seven (7) feet of the property abutting West Broadway (County Road 8) is dedicated to the County as public -right-of-way. There is a 10 foot utility and drainage easement along all lot lines abutting a street or alley. The easements will facilitate utility installation and maintenance as well as space for grading and swales for drainage purposes. There is also an existing sanitary sewer easement running from the alley to Xenia Ave N. that extends across a potion of the rear of the property. 3. Setbacks. The parcel requires a minimum 30 foot setback from all lot lines abutting a public street. The setback from West Broadway shall be measured from the newly dedicated County right-of-way line. 10 foot setbacks are required from the alley and commercial property to the south. D. RECOMMENDATION Staff recommends approval of the submitted plans for preliminary plat and the construction of a new auto parts retail store at 4921 West Broadway, subject to the following conditions: 1. A Hennepin County permit is required prior to any work being performed within the West Broadway (County Road 8) right-of-way. 2. All items listed under Staff Comments B. #1 Building must be met. 3. Pagoda Dogwoods not permitted in parking lot islands. Clear alternate planting with City Forester before proceeding, unless they will be "ivory silk" tree lilacs which the Forester has pre -approved. "Ivory silk" tree lilacs shall be planted instead; or alternative planting approved by the City Forester prior to installation. 6. All utilities serving the new building, including electrical and communications, shall be located underground. 7. No building permit shall be issued until the required $50,000 surety and an executed site improvement agreement are provided to the city. 8. There shall be no access to the alley. The applicant shall submit a revised site plan for staff review with this change. Or; if alley access is approved by the Planning Commission, then no vehicles shall enter the site via the alley; and only vehicles not exceeding 28' in length and -- 30,000 lbs GVW may exit the site via the alley. The suggested findings of fact are that the proposed use would be consistent with the Comprehensive Plan and city code, provided the recommended conditions are met. Planning Commission action is requested. The City Council would consider the Planning Commission's recommendation at its meeting on June 19, 2007.
