CALL TO ORDER The regular meeting of the Crystal Planning Commission convened at 7:00 pm with the following members present: Sears, Davis, Nystrom, Whitenack, VonRueden, Buck, Hester, Schiebe and Strand. Also present were city staff members Matthews, Sutter, Zimmermann, and Council Liaison Anderson. B. APPROVAL OF MINUTES Moved by Commissioner Nystrom and seconded by Commissioner Schiebe to approve the minutes of the February 12, 2007 regular meeting. Motion carried. C. PUBLIC HEARINGS 1. Consider Application 2007-02 for a one year extension of a previously issued interim temporary Conditional Use Permit for the Highview Alternative Program at the former Cavanaugh Elementary School, 5400 Corvallis Avenue North. Mr. Zimmermann summarized the staff report. Chair Whitenack stated that he thought that the last time this extension was granted was the last time it would be allowed. Mr. Zimmermann clarified that the school district had made another application for an extension because of the delay in the county's project. Mr. Sutter added that, since the 2004 CUP approval, the county has delayed the highway project, and the city is now considering doing the neighborhood street project first. Commissioner Schiebe asked how the projects would affect the facility. Mr. Sutter clarified that the projects would not affect the entire facility, just the west end; and that the school has indicated it desires long term use of this particular facility. Public Hearing opened. Public Hearing closed. Moved by Commissioner Davis and seconded by Commissioner VonRueden to recommend to the City Council to approve Application 2007-02 for a one year extension of a previously issued interim, temporary Conditional Use Permit for Highview Alternative Program at the former Cavanaugh Elementary School 5400 Corvallis North. Findings of fact are as stated in the staff report, with conditions 1-5 as stated. Motion carried. D. OLD BUSINESS 1. Consider rescinding a previously approved Comprehensive Plan Amendment related to the future land use designation for part of 3420 Nevada Avenue North. Mr. Sutter summarized the staff report. Chair Whitenack asked if this motion was just running the land back to its original Low Density use. Mr. Sutter clarified that it would. Chair Whitenack stated that if it returned to Low Density what affect would that have on the property in the future. Mr Sutter stated that it returns it to its originally intended land use, and that any new zoning applications would start the whole process over. Commissioner Davis stated that, with the process of reviewing the Comprehensive Plan underway that this particular parcel of land be reviewed as part of that process. Commissioner Strand stated that her concern was that rescinding this parcel of land now would take away from the credibility of the commission. Chair Whitenack agreed. Mr. Sutter stated that the Comprehensive Land Use designation is specific to this site, but that the text amendment for the height setback requirement applied throughout the city. Discussion continued amongst the Commissioners and Mr. Sutter for more clarification on the issue. Public hearing opened. Public Hearing closed. Moved by Commissioner Davis and seconded by Commissioner Sears to recommend to the City Council to deny rescinding a previously approved Comprehensive Plan Amendment related to the future land use designation for part of 3420 Nevada Avenue North. Motion failed 4 to 5 with Sears, Davis, Buck and Schiebe voting aye and Nystrom, Whitenack, VonRueden, Hester, and Strand voting nay. Moved by Commissioner VonRueden and seconded by Commissioner Hester to recommend to City Council to approve rescinding the previously approved Comprehensive Plan Amendment related to the future land use designation for part of 3240 Nevada Avenue North. Motion carried 6 to 3 with Nystrom, Whitenack, VonRueden, Buck, Hester, and Strand voting aye and Sears, Davis, and Scheibe voting nay. E. NEW BUSINESS F. GENERAL INFORMATION In response to questions from the Commission, Mr. Sutter stated that the Task Force assigned to review the Comprehensive Plan should feel free to spend extra time determining the recommended future land use in areas of special concern. Commissioner VonRueden asked about the status of the Gaulke property. Mr. Sutter stated that the family is marketing the property and it is guided as low density. Commissioners Sears asked about 5710 & 5720 32"d Avenue North. Mr. Sutter gave the commission an update that the EDA is waiting for the frost to be out before the grading started. Commissioner Davis left at 7:45 pm. Commissioner Hester asked about the Thorson Addition's seventeen lots that have been sold but only 6 building permits issued. Mr. Sutter clarified that the EDA has been paid for all seventeen lots, and that there are 4 more building permits that have been submitted for plan review. G. OPEN FORUM H. The meeting adjourned at 7:47 p.m. Chair Whitenack Secretary Hester M E M O R A N D U M DATE: May 8, 2007 TO: Planning Commission (May 14th meeting) FROM: Jason Zimmermann, Code Enforcement and Zoning Administrator SUBJECT: Public Hearing: Consider Application 2007-03 for Preliminary Plat and Site Plan Review for a new retail building at 4921 West Broadway. A. BACKGROUND The subject property is a 38,188 sq. ft. (.87 acre). The site is currently vacant and the applicant is proposing to build a 6,600 sq. ft. auto parts store. Site improvements would include new parking and drive areas, and landscaping. The applicant has also submitted a Preliminary Plat to combine the 3 existing lots and provide a 7 foot right-of- way dedication for County Road 8. The property is zoned C-2 General Commercial. Retail sales are permitted in the C-2 district. Site plan review is required for the new building and site improvements. Notice of the public hearing was published in the Sun Post on May 3, 2007 and mailed to all property owners within 350 feet of the property. At the May 14, 2007 meeting, the Planning Commission will hold the public hearing and may make a recommendation for the City Council to consider at its June 5, 2007 meeting. Exterior materials will consist of pre-engineered metal building panels. The entrance will face West Broadway. Comments from West Metro Fire District and City Staff: • A floor plan and layout must be submitted for review and approval prior to the issuance of a building permit. • The building shall be sprinkled per Minnesota State Building Code, Chapter 1306. Any M occupancy that is over 2000 square feet shall be sprinkled. • There shall be a separate water main going into the building for the sprinkler system. The main shall be large enough to accommodate the sprinkler system. A meter shall be required on the sprinkler riser. • The sprinkler system shall be monitored by a fire alarm company. There shall be horn(s)/strobe(s) located on the interior/exterior of the building for a water flow alarm per Minnesota State Fire Code and West Metro Fire - Rescue District. • Address numbers shall be located large enough to see from street and of a contrasting color on the street side of the building. • All doors leading to mechanical, electrical, roof access and sprinkler riser rooms shall have signage per Minnesota State Fire Code, Section 510. • A fire department lock box shall be located on the building by the fire department sprinkler connection. • There shall be a fire hydrant within 100 feet of the fire department connection per West Metro Fire -Rescue District. West Metro will verify that the proper number of hydrants are available. PRELIMINARY PLAT AND SITE PLAN REVIEW - O'REILLY'S (4905 WEST BROADWAY) PAGE 2 OF 6 2. Parking, traffic and sidewalks. The Zoning Ordinance requires 27 parking spaces; 31 would be provided. Access would be from one 32' wide driveway on West Broadway. A Hennepin County permit is required prior to any work being performed on the curb cut. Sidewalks will be installed along West Broadway and Xenia Ave N. 136-12 curb and gutter is required around perimeter of parking lot. This includes the sidewalk adjacent to the building. The site plan shows an exit to the alley which leads to Xenia Ave N. The applicant has indicated that a rear entry is needed for delivery trucks to exit the site. Staff feels the exit to the alley is more of a convenience then a necessity and does not feel there should be any access to Xenia Ave N from the proposed retail store. Xenia Ave N is designated as a Local Road and staff does not want the proposed retail store to generate cut -through traffic through this residential neighborhood. We are especially concerned because the access would be 24 feet wide, enough for two-way traffic despite the proposed "do not enter" signs. West Broadway is a Major Collector and all customer and delivery traffic should use this street. The site plan can be amended to allow for a turnaround for the delivery trucks so they can safely exit via West Broadway. If the Planning Commission decides to allow an exit to the alley, staff recommends it be designed as shown on Exhibit O. This would be an exit only and "Do Not Enter" signs must be placed on the applicant's property at the exit to deter traffic from entering the site from the alley. (The site plan shows the signs at the entrance to the alley within the public right-of-way.) 3. Signs. Sign plans were not submitted with the application. The site plan does show a new pole sign near the West Broadway entrance. Permits are required prior to installation of signs. 4. Landscaping. Per staffs request, instead of the fence originally proposed by the applicant, a landscape berm with plantings would be installed along Xenia Ave N to provide screening from the adjacent homes along Xenia Ave N. Additional plantings are shown within parking lot islands and other landscaped areas. PRELIMINARY PLAT AND SITE PLAN REVIEW - O'REILLY'S (4905 WEST BROADWAY) PAGE 3 OF 6 The City Forester does see a problem with planting Pagoda Dogwoods in the parking lot islands. Dogwoods should be placed in cooler areas where moisture is abundant. Staff recommends replacing the Dogwoods with "Ivory Silk" tree lilacs. 5. Lighting. A site photometrics plan was submitted and is in compliance with City Code. 6. Drainage and Utilities. The proposed parking lot would drain north to a dry pond and where a detention outlet would be installed. This detention outlet would then drain to the existing inlet at West Broadway and Fairview Ave N. City water is available from West Broadway. The applicant is proposing a 4 inch sanitary sewer to be connected to the main under the alley. Electric and communications lines serving the new building shall be underground, in accordance with city code. 7. Surety required. City code requires financial surety for completion of the required site improvements. Typically, the amount of surety is determined based on all of the estimated landscaping cost plus a portion of estimated paving and utilities costs. Staff is recommending that the required surety be $50,000, with $45,000 to be released upon satisfactory completion of the site improvements and $5,000 to be released after at least one full year has passed since installation of the landscaping. As required by city code, the surety must be in the form of a cash escrow deposit or an irrevocable letter of credit in a form acceptable to the city. C. STAFF COMMENTS — PLAT 1. Lot Area. The proposed plat, to be titled "O'Reilly Addition", would consist of one lot: PRELIMINARY PLAT AND SITE PLAN REVIEW - O'REILLY'S (4905 WEST BROADWAY) PAGE 4 OF 6 Lot One, Block One would have a proposed address of 4921 West Broadway and consist of 34,805 square feet. The property is zoned C-2, General Commercial. Section 515.49 Subd. 5 requires a minimum area of 20,000 sq. ft. The lot would meet this requirement. 2. Easements. The first seven (7) feet of the property abutting West Broadway (County Road 8) is dedicated to the County as public -right-of-way. There is a 10 foot utility and drainage easement that covers the area within 10 feet of this right- of-way line. Staff recommends requiring this along any lot lines abutting a street or alley. The easements will facilitate utility installation and maintenance as well as space for grading and swales for drainage purposes. There is also an existing sanitary sewer easement running from the alley to Xenia Ave N. that extends across a potion of the rear of the property. No portion of any building shall be placed as to encroach into this easement. 3. Setbacks. The parcel requires a minimum 30 foot setback from all lot lines abutting a public street. The setback from West Broadway shall be measured from the newly dedicated County right-of-way line. 10 foot setbacks are required from the alley and commercial property to the south. D. RECOMMENDATION Staff recommends approval of the submitted plans for preliminary plat and the construction of a new auto parts retail store at 4921 West Broadway, subject to the following conditions: 1. A Hennepin County permit is required prior to any work being performed within the West Broadway (County Road 8) right-of-way. 2. All items listed under Staff Comments B. #1 Building must be met. 3. A sign permit is required prior to installing any signs. 4. Pagoda Dogwoods not permitted in parking lot islands. All utilities serving the new building, including electrical and communications, shall be located underground. 6. No building permit shall be issued until the required $50,000 surety and an executed site improvement agreement are provided to the city. 7. There shall be no access to the alley. The applicant shall submit a revised site plan with this change. The suggested findings of fact are that the proposed use would be consistent with the Comprehensive Plan and city code, provided the recommended conditions are met. Planning Commission action is requested. The City Council would consider the Planning Commission's recommendation at its meeting on June 5, 2007. Whitenack, 43, of d` Crystal received the American Institute of Architects (AIA) Minnesota 2006 Young Architects Award in December 2006. Paul Whitenack Tim Carl, the commit- tee chair of the jury that selected Whitenack for the award, said he is among the "Renaissance" architects. "They can do everything," he said. The Young Architects Award is given to an AIA Minnesota member who has been licensed for less than 10 years and demonstrates leadership in the profes- sion, the community, design, planning and/or education. "He was kind of a poster child for this award," Carl said. "Doing such an excep- tional job leading projects from the heart of it." Whitenack said architecture gives him the chance "to be every man." "You get a glimpse behind the scenes of almost anything you can imagine.... It's a real kick to see something you've thought of and designed come to life - to become a building," he said. Whitenack said he told his wife, Rhonda, that his legacy would be that their. daughter, Vanessa, 6, could someday take her children to buildings he worked on. r Wes ar "They [buildings] last a long time - that's a kick," he said. Whitenack understands the impor- tance of time, ' having been diagnosed -with testicular cancer his senior year at the University of Wisconsin - Oshkosh. "I started thinking about what I real- ly wanted to do with my career," he said. Whitenack received a bachelor of fine arts from Oshkosh, and worked as a graphic designer for a few years before deciding to become an architect. He went back to school and received a master of architecture and urban plan- ning from the University of Wisconsin - Milwaukee. Surviving cancer, Whitenack said, taught him two major lessons. "We should ... try to take every day as a gift and something to be enjoyed and savored," he said. "Every day has the brilliant opportunity to achieve some- thing significant." Whitenack is in his seventh year as a project architect with RSP Architects in Minneapolis. He has worked on the Grain Belt Brewhouse, Pierre Bottineau Library, additions to the Minneapolis Institute of Arts and the Children's Theatre Company. The award is given to architects who are members of AIA Minnesota, have been licensed for less than 10 years, and have shown exceptional leadership in service to the profession, the community, design, planning and/or education. The submissions included letters of recommendation from AIA Minnesota member architects and the candidates' clients; project summaries highlighting the architects' particular contributions; photos and drawings; and documentation of other achievements. The jury consisted of Awards Committee Chair E. Tim Carl, AIA; Award Committee Members: Nancy Blankfard, AIA, Francis Bulbulian, AIA, Raymond Dehn, Assoc. Paul Whitenack, AIA Paul has been a major contributor to award-winning renovations and major additions to some of Minnesota's best-known cultural and architectural landmarks including the Grain Belt Brewhouse, winner of the 2005 National Historic Preservation Trust Award; the Pierre Bottineau Library and additions to the Minneapolis Institute of Arts and the Children's Theatre Company. From his Master of Architecture and Urban Planning degree from the University of Wisconsin -Milwaukee to his nearly seven years with Minneapolis firm RSP Architects, he has been guided by a dedication to preservation, sustainability and planning. The jury could see a passion for preservation early in this architect's career with his purchase of an original waterworks facility in Hartland, Wisconsin, and his three years personally reconstructing the building for office use. They commented, "Paul shows a very believable commitment to restoration and adaptive reuse. Even at the onset of his career, he was mature enough to choose a direction and see it through to completion." As Paul has advanced over the years, his leadership abilities, intense focus and sensitivity to detail have allowed him to play the unheralded role of project architect so well. "It's a role absolutely critical to the success of a project," noted the jury. One nominator said, "Paul possesses all of the critical skills of an excellent architect, with a vast technical understanding of building systems, materials and elegant details." The jury was equally impressed with his ability to successfully carry out diverse and balanced roles as a project architect, design collaborator, planner, construction administrator and owner's representative with a passion for sustainability (LEED accredited in 2005), preservation and community. This year's Young Architects Award winners will be recognized at the annual AIA Minnesota Awards Celebration on Friday, December 1, 2006. AIA Minnesota Young Architects Award winners are encouraged to submit their work for the national award, as well. Since the AIA Young Architect Award's inception in 1993, AIA Minnesota architects have dominated the winners at a national level.
