B. APPROVAL OF MINUTES * Moved by Commissioner Strand and seconded by Commissioner Buck to approve the minutes of the March 10, 2008 regular meeting. Motion carried. C. PUBLIC HEARINGS 1. Consider Application 2008-03 for a Variance to reduce the east setback at 5629 West Broadway. Staff member, Jason Zimmermann, summarized the staff report recommending denial of the Application for a variance to reduce the setback from 30 feet to 16 feet. Mr. Zimmermann also stated the new site plan was presented earlier in the day to city staff showing the non -conforming structure. Arby's representatives brought poster board copies of the new site plans for display in Council Chambers. The public hearing was opened by Commissioner Whitenack. Steve Lazenby, Arby's representative from Kansas City, Missouri, presented the Commission with a handout including statistics for the Crystal Arby's, the new site plan, a current photo of the store and the proposed new look for the store. Mr. Lazenby stated that Arby's corporate staff looked at the restaurants that need updating. They felt the Crystal store was in a vibrant area with strong demographics, but it had suffered its 4th consecutive yearly sales decrease. They feel it would be a benefit to G:\PLANNING\PLANCOMM\2008\04.14\minutes.doc Page 2 of 3 the city to improve the physical appearance of the store resulting in increased sales by an anticipated 15-20%, which translates into increased sales property taxes for the city. i Currently there is an overhang on the front of the building. A variance would be required in order to add columns to the front along with the new pinnacle style fagade. Mr. Lazenby also stated that the original Exhibit C has what appears to be an addition to the rear of the building, but actually there is a cooler and a dumpster outside of the rear of the building that is accessed by going outside. This area is surrounded by a fence. They are not planning on any additions to the rear of the building. Mr. Lazenby noted that three of the Arby's restaurants in the Twin Cities are being considered for updating, of the three, two would require variances. Commissioner Whitenack questioned Mr. Lazenby as to whether the current owner owned the property when the previous remodels had occurred. Mr. Lazenby indicated prior to 2001 the restaurant was a privately owned franchise, since then it has become a corporate store. All previous remodels were done prior to corporate ownership. Mr. Whitenack inquired as to the shaded area on the site plan Mr. Lazenby indicated it was the footprint of the building not including the overhang, and acknowledged that the footprint does fall in the setback that was in place at the time. Mr. Sutter explained that the city code applies the setback to the building not the overhang or eve. However, Arby's proposal would include columns that would take the roofline down to the ground, encroaching further into the setback. Commissioner Buck questioned as to whether the project could be redesigned without the columns. Mr. Lazenby said that the columns could be taken off the plan. Commissioner Buck asked of staff whether the other changes, without the columns, would be allowed. Jason Zimmermann responded that the pinnacle and columns would not be allowed. Mr. Lazenby said the columns could be taken off the design. Hearing no other comments, Commissioner Whitenack closed the public hearing. Planning Commission discussion was opened. Commissioner Davis commented that the building was built into the 22 foot setback and is already non -conforming. If original plans would have been followed, the current request would be less of an issue. He questioned whether this variance would meet the criteria required to grant a variance as outlined in the staff report. Commissioner Whitenack stated that he felt it was unfair that the owners would not even be able to add on to the rear of the building if the variance was not granted; such changes would modernize the building. Commissioner Sears said the owners feel that the pinnacle design may be important as a signature for the Arby's restaurant including the columns; however future utilities work, etc. may be difficult if the property owners are allowed to encroach any further by adding the pinnacle and columns. There may also be issues with the driveway that circles in front of the building if the columns are added. G:\PLANNING\PLANCOMM\2008\04.14\minutes.doc Page 3 of 3 Mr. Sutter stated that reducing the set back to nineteen feet would allow them to proceed with the pinnacle but without the columns. Commissioner Whitenack said he felt the sixteen foot set -back would fail the three criteria required to grant the variance, but he felt that a case could be made for the nineteen foot set -back and allowing them to move forward with the pinnacle design without the columns. Commissioner Hester stated that he did not feel the request met the three criteria for a variance. Commissioner Nystrom agreed with Commissioner Hester. Moved by Commissioner Whitenack and seconded by Commissioner Davis to recommend to the City Council to reduce the front (east) setback to 5629 West Broadway from 30 feet to 19 feet. Motion passed 6 to 3 with Commissioners Davis, Whitenack, VonRueden, Buck, Strand and Sears voting aye and Commissioners Scheibe, Nystrom and Hester voting nay. Motion carried. D. The meeting adjourned at 7:35 p.m. G:\PLANNfNG\PLANCOMM\2008\04.14\minutes.doc ME M OR AND U M DATE: May 8, 2008 TO: Planning Commission (May 12th meeting) FROM: Jason Zimmermann, Code Enforcement and Zoning Administrator SUBJECT: Public Hearing: Consider Application 2008-04 for a Conditional Use Permit including Site Plan Review for parking lot reconfiguration and other site improvements at the former Cavanagh Elementary School, 5400 Corvallis Avenue North. A. BACKGROUND The subject property is a 8.7 acre site owned by Independent School District #281 a.k.a. Robbinsdale Area Schools ("the district"). The east half of the property is used for park purposes. The west half of property contains the former Cavanagh Elementary School built in 1958. In addition to the building, the facility includes two parking lots, play areas, and related facilities. The building is currently used for a variety of educational uses including: Early Childhood Family Education offices and programs; Early Childhood Special Education; Creative Play Preschool; and Highview Alternative Program (High School). The facility ceased operating as an elementary school in 1976. Since then, the district has used the facility for a variety of programs and activities, including leasing it to Intermediate District 287 for a time. From a zoning standpoint, only its original use as an elementary school would be considered lawfully nonconforming, and even that is questionable because that particular use ended nearly 30 years ago. The property is guided low density residential and zoned R-1. A Conditional Use Permit ("CUP") is required for schools and related facilities in the R-1 district. On September 21, 2004, the City Council approved an interim, temporary Conditional Use Permit (CUP) allowing the Highview Alternative Program to move into Cavanagh School. At that time, Robbinsdale Area Schools was engaged in long-term facilities planning and was unsure of future uses at many of its facilities, including Cavanagh. The interim CUP expires on September 30, 2008. Because the preliminary design and land acquisition impacts of Hennepin County's proposed reconstruction of CSAH 81 (Bottineau Boulevard) and the adjacent frontage road (Lakeland Avenue) are now known, and also because the final design of the city's street reconstruction project has been approved, the district has prepared plans to bring the site improvements into compliance with city code and is seeking a permanent approval for the Highview Alternative Program and other uses in the facility. CONDITIONAL USE PERMIT - FORMER CAVANAGH ELEMENTARY SCHOOL (5400 CORVALLIS) PAGE 1 OF 6 The site improvements will be done in two Phases. Phase I will include all improvements to the north and east parking lots. Phase II improvements are to be performed on the site in the area west of the building in 2010 in conjunction with the scheduled Hennepin County 81 project. These will include an area for drop off/pick up short term parking. In 2010, the west playground area will undergo some layout adjustments and relocation as a result of the impacts of the County 81 project on the site. Also, the existing sign will be replaced in 2010 with a new monument sign. The monument sign will be located on the north side of the building adjacent to 51St Avenue. Notice of the public hearing was mailed to property owners within 700 feet of the property and published in the Sun Post on May 1, 2008. At the May 12, 2008 meeting, the Planning Commission will hold the public hearing and may make a recommendation for the City Council to consider at its May 20, 2008 meeting. Parking space dimension corrections required. B. STAFF COMMENTS Land use and zoning — generally. The Zoning Ordinance requires that the facility be served by arterial, collector or Municipal State Aid ("MSA") streets sufficient to handle the traffic generated by the facility. The facility is served by County Road 81 and as part of the Phase 9 Street Reconstruction Project, that portion of 51St Avenue serving the north and east parking lots will be built to MSA standards. 2. Traffic patterns on 51St Avenue. In March and April of 2006, the city conducted week-long traffic counts on 51S Avenue between Cavanagh and Bottineau Blvd (CSAR 81). One was done with school in session. The other with school not in session. • With school in session during the week, the number of vehicle trips per day ranged from 1,604 to 1,711, yielding an average of 1,669 per day during the week. Saturday had 822 trips and Sunday had 717 trips yielding an average of 770 per day during the weekend. The difference in average daily trips during the week versus the weekends was 659. • With school not in session, the number of vehicle trips per day ranged from 740 to 998, yielding and average of 816 per day during the week. Saturday had 667 trips and Sunday had 622 trips yielding an average of 645 per day CONDITIONAL USE PERMIT - FORMER CAVANAGH ELEMENTARY SCHOOL (5400 CORVALLIS) PAGE 2OF6 during the weekend. The difference in average daily trips during the week versus the weekends was 171 trips. The traffic numbers on 51St suggest that it could justifiably be designated an MSA street. However, MnDOT rules do not permit the city to designate MSA streets unless they connect to an arterial or other MSA street. Even though the street cannot be designated an MSA street, 51 St Avenue will be built to MSA standards to accommodate the traffic generated by the facility. 3. Planned street reconstruction proiect as it relates to the Cavanagh facility. Staff's preference is to keep traffic concentrated on 51st Avenue between Bottineau Blvd and the east parking lot, rather than attempting to disperse the facility's traffic throughout the neighborhood. The city will construct 51St Avenue to MSA standards to better handle the traffic generated by the facility, even if 51St Avenue cannot be designated MSA. Such streets are typically 32' wide (instead of 30'), are striped for one lane in each direction plus a parking lane on one side of the street, and have a sidewalk directly behind the curb on one side of the street. Upon reconstruction of 51St Avenue to MSA standards, the city may eliminate the "No Parking 8-5 M -F" restriction on the north side of 51St Avenue. This restriction was put into place because parking was also allowed on the south side of.the street and having parking on both sides poses traffic and safety problems. Now that the street will be reconstructed and striped in a manner appropriate for its traffic level, meaning that no parking will be allowed on the south side of the street and there will be a dedicated parking lane along the north side of the street, the weekday parking restriction of the north side of 51s Avenue is no longer necessary. 4. Traffic generated by the Cavanagh facility. Based on the district's staff and student counts, the facility generated an estimated 836 car trips and 72 bus trips per day in the 2003-2004 school year (before Highview). In the 2004-2005 school year (after Highview), the estimate was 652 car trips and 86 bus trips. In the 2005-2006 school year, the district moved 13 Early Childhood Special Education staff from Cavanagh to the former New Hope Elementary, resulting in an estimate of 624 car trips and 86 bus trips. Car trips appear to have been greatly reduced (-212) but bus trips have slightly increased (+14). Staff opinion is that this is an acceptable trade-off if trips on local streets are minimized to the extent possible. Parking lot aisles have been sized sufficiently to accommodate bus traffic and staging in the Cavanagh School parking lot. Proposed bus route changes will enable school buses to enter the parking lot from County Road 81 via 51St Ave and return to County Road 81 via 51St Ave beginning September 2008. Buses will no longer unload and load students on Corvallis Avenue effective September 2008. 5. Estimated parking demand versus supply. Based on the district's staff and student counts, the facility needed an estimated 155 parking spaces in the 2003-2004 school year (before Highview). In the 2004-2005 school year (after Highview), the estimate was 205 parking spaces needed. In the 2005-2006 school year, the district CONDITIONAL USE PERMIT - FORMER CAVANAGH ELEMENTARY SCHOOL (5400 CORVALLIS) PAGE 3OF6 moved 13 Early Childhood Special Education staff from Cavanagh to the former New Hope Elementary. The estimate for 2005-2006 and 2006-2007 is 191 parking spaces needed. The proposed plan shows 156 spaces and an additional 9 short-term spaces to be added in 2010. This is an increase of 25 spaces from the current number of 140. Additional parking can be installed east of the east parking lot (Exhibit H) if the district finds more parking is needed. As requested by the Planning Commission and Council, a five day study of the parking practices at the facility conducted in May 2006 indicates far less vehicle parking at the site than was estimated. The study was conducted on each week day at three different times each day; twice in the morning and once in the afternoon. The study counted all vehicles parked in the north and east parking lots of the building as well as those parked on 51St Ave N and Corvallis Ave N. • The average number of vehicles parked at the site on Monday was 123, with an average of 102 vehicles in the parking lots and 21 on the public streets. • The average number of vehicles parked at the site on Tuesday was 111, with an average of 95 vehicles in the parking lots. • The average number of vehicles parked at the site on Wednesday was 99, with an average of 85 vehicles in the parking lots. • The average number of vehicles parked at the site on Thursday was 105, with an average of 95 vehicles in the parking lots. • The average number of vehicles parked at the site on Friday was 96, with and average of 83 in the parking lots. _ It is important to note that these are averages, not peaks. Staff's conclusion is that the additional parking proposed by the district is adequate to meet the needs of the facility. If the mix or character of uses change, then additional parking may be needed. 6. Site Imarovements. Site improvements required to bring the site into compliance are shown on the proposed site plan. These include: ■ Install additional off-street parking and loading areas as deemed necessary by the city, including sufficient space for all vehicles to maneuver on-site so that the only local street they use is 51St Avenue from the east parking lot to Bottineau Blvd. Parking dimensions must meet city code section 515.17 (See Exhibit J). ■ Install standard b6-12 concrete curb & gutter around perimeter of all parking lots where not previously installed. ■ Restore/install turf or other acceptable landscape material in all disturbed areas. ■ Ensure parking lot compliance with design standards in city code, including the minimum 5' setback from any lot line (for example, on the north side of the north parking lot). CONDITIONAL USE PERMIT - FORMER CAVANAGH ELEMENTARY SCHOOL (5400 CORVALLIS) PAGE 4 OF 6 ■ Construct a trash enclosure to code. ■ Remove the commercial -style pylon sign upon Bottineau Boulevard (CSAH 81) reconstruction and replace it with a residential -style monument sign. ■ Construct sidewalks on the property to provide pedestrian access to, from and around the building. In addition to the above improvements, the wood light pole and overhead wire shall be removed from the middle of the east parking lot. Ten additional shade trees shall be planted in those areas denoted in Exhibit I. They shall be large species deciduous shade trees. Specific species, size and location shall be reviewed and approved by the City Forester prior to planting. C. RECOMMENDATION Staff recommends approval of the requested Conditional Use Permit including site plan approval, for the former Cavanagh Elementary School, subject to the following conditions: The wood light pole and overhead wire shall be removed from the middle of the east parking lot. 2. Ten large species deciduous shade trees shall be planted in those areas denoted in Exhibit I of the staff report. Specific species, size and location shall be reviewed and approved by the City Forester prior to planting. 3. If the city determines that parking is not being accommodated on-site, the city may require the district to add additional parking adjacent to the east parking lot as shown in Exhibit H. 4. The district will enter into a site improvement agreement with the city to guarantee completion of the site improvements. Financial surety of $50,000 is required, and would be released as follows: • $19,000 upon completion of Phase 1 improvements. ■ $1,000 one year after planting of five trees in Phase 1 improvement area, as shown in Exhibit I. • $29,000 upon completion of Phase 2 improvements. ® $1,000 one year after planting of five trees in Phase 2 improvement area, as shown in Exhibit I. 5. It is strongly recommended, although not required, that the address of the building be changed from 5400 Corvallis to a 51St Avenue address in the 5301- 5401 range. This will reflect the way the building is actually accessed and used today rather than how it was originally configured in 1958. Crystal, Minnesota 55422 Re: Application for Conditional Use Permit at Cavanagh School Dear Planning Staff: Enclosed you will find the submitted documents for consideration of a Conditional Use Permit (CUP) at Cavanagh School. The existing facility currently serves early childhood education programs and the Highview Alternative Program for Robbinsdale Area Schools. The Highview Alternative Program began using the Cavanagh facility in the fall of 2004, the 2004-2005 school year, and is currently operating under a temporary CUP. Future City and County roadway improvement projects were given consideration during development of the revised site plan. The proposed site plan and the proposed school busing operation adjustments address several issues associated with the school district's Cavanagh School and Highview Alternative Program. School district busing operation changes will include moving Cavanagh and Highview Program student bus loading and unloading activity to the Cavanagh site parking lot area with access from 51St Avenue. Cavanagh and Highview program school bus staging for student unloading and loading will be removed from the north side of Corvallis Avenue where some school bus staging currently occurs. PHASE 1 PLAN The proposed site plan provides 9 additional parking spaces in the existing north parking lot and 9 additional parking spaces in the existing east parking lot. These additional parking spaces are expected to accommodate the routine daily Cavanagh/Highview Program overflow parking that currently occurs on 51St Avenue. Parking lot drive aisles are sized sufficiently to accommodate school bus movements and staging in the Cavanagh School parking lot. Proposed school bus route adjustments will enable school buses to enter the Cavanagh School parking lot from County Road 81 via 51' Avenue and return to County Road 81 via 51't Avenue beginning September 2008. It is proposed that school buses will no longer stage to unload and load Cavanagh students on Corvallis Avenue effective September 2008. EXHIBIT C April 18, 2008 Page 2 City of Crystal/Independent School District #281 The modifications proposed for the Cavanagh School north and east parking lots include installation of perimeter concrete curb and gutter, entrance drive revisions, construction of concrete pedestrian sidewalks, and construction of a trash enclosure consistent with city code. The north edge of the north parking lot will also be modified to comply with current property line setback requirements. The proposed site modifications in the north and east parking lot, if approved, would be constructed during the summer of 2008 and be completed prior to September 30, 2008. PHASE II PLAN Additional improvements are proposed to be performed on the site in the area west of the Cavanagh building in 2010 in conjunction with the scheduled Hennepin County 81 project. The proposed Phase II site improvements include a new parent drop-off/pick-up short term parking lot area in the southwest corner of the Cavanagh School property. This area will be utilized for short-term parking and provide parents with an area to drop-off/pick-up younger students that is separated from school bus loading zones. Construction of the proposed parent drop-off/pick-up area will need to be performed in conjunction with the County Road 81 project, which is currently projected to occur in 2010. In order to provide short-term parking in this area for 10 vehicles as shown, the alignment of Corvallis Avenue at the interface with the proposed CR 81 frontage road will require modification. Robbinsdale Area Schools has met with City and County staff to begin discussing the requirements for realigning Corvallis Avenue associated with this proposal. In 2010 the west playground equipment area will undergo some layout adjustments and relocation as a result of the impacts of the Hennepin County 81 project impacts on that area of the site.
