APPROVAL OF MINUTES Moved by Commissioner Nystrom and seconded by Commissioner Sears to approve the minutes of the November 12, 2007 regular meeting with no exceptions. Motion carried. D. PUBLIC HEARINGS Consider Application 2007-15 for Zoning Ordinance text amendments in Sections 515.13 and 515.17 to move certain provisions regulating curb cuts and driveways within the public right-of-way to Section 800 (Streets, Alleys and Public Ways); and in Sections 515.17, 515.33, 515.37 and 515.41 to delete provisions regulating motor vehicles and recreational vehicles and equipment which are now regulated by Section 1330. Mr. Zimmermann summarized the staff report. Commissioner Whitenack asked if this was a closing of "loop holes". Mr. Zimmermann indicated that right-of-way regulations were being put into the proper part of the code. Mr. Sutter added that this change would have very little practical effect, it is more a matter of the legal definition, putting the issues that are not really zoning into another, more appropriate section of the code. Commissioner Whitenack opened the Public Hearing. As none were heard the public hearing was closed. Planning Commission discussion was opened. Commissioner Sears inquired as to whether curb cut variances would still be coming to the Planning Commission and has there been publicity in the Sun Post for this change. Mr. Zimmermann explained that curb cuts would not come through the Planning Commission and the public hearing notice for this zoning amendment has been published in the Sun Post for two weeks. Mr. Sutter added that the City Engineer will be dealing with curb cuts since they are in the city right-of-way. The Findings of Fact are as follows: the text amendment changes as noted will not have a substantial affect on city code. Motion carried. F. NEW BUSINESS None discussed. G. GENERAL INFORMATION 1. City Council actions on recent Planning Commission items No questions from Commission. 2. Development Status Report for quarter ending December 31, 2007 *. Report summarized by Mr. Sutter. With the evidence of correction of the real estate market, it has also had an affect on non-residential projects that had been approved by the Planning Commission. As noted, some of the projects have not moved forward. 3. Staff preview of likely agenda items for February 11, 2008 meeting. Staff reported that no applications have been received as of this date for the February meeting agenda. Should nothing be received by the deadline date of January 18, 2008, the commission will be informed of the cancellation of the scheduled February 11, 2008 Planning Commission meeting. One item know for the March 10, 2008 meeting: EDA plat to split lot at 6622 Hampshire Ave N. H. OPEN FORUM Commissioner Strand asked of staff the status of the former Marathon station at 34th and Douglas, questioning its allowed hours of operation. Mr. Sutter stated that the business is a legally non -conforming use that may continue as it was used before, but the use cannot be more intense. Mr. Zimmermann indicated that today there was report of excessive vehicles located on the property, and he will check the allowed business hours. Mr. Sutter asked Commissioner Strand what the hours for the previous business were. Commissioner Strand stated it would close at 6:00 p.m. with no weekend work. She asked if it could go back to a gas station. Commissioner Davis stated he believes the gas tanks were dug out of the adjoining parking lot. Mr. Sutter indicated that gas station cannot be re-established since that use has been removed. A. BACKGROUND The subject property at 3420 Nevada Ave N is currently occupied by Cornerstone Church and some smaller uses including Happy Time Pre -School, St. David's Early Childhood Development, and Calvin Christian School. The applicant is proposing to rent out a portion of the building to Lionsgate Academy, a public charter school. Calvin Christian School will be moving out of the facility by fall of this year. Lionsgate Academy would use the former Calvin classroom spaces plus some spaces currently used by the church such as the gymnasium and fellowship hall. They also intend to use additional church classroom space in the coming years. The subject property consists of 12.25 acres and is zoned R-1, Low Density Residential. Schools and churches require a conditional use permit under 515.33 Subd. 4 b) provided the following conditions are met: The facility is served by arterial, collector or municipal state aid (MSA) streets and such pedestrian facilities as are necessary to accommodate the traffic generated by the facility. The facility has access to both an MSA street (Nevada) and a non -MSA street (Louisiana). Both streets are adequate for existing and anticipated vehicular traffic, and no significant pedestrian traffic is anticipated. The City Council determines that all applicable requirements of subsection 515.05 subd. 3 a) and section 520 are considered and satisfactorily met. 515.05 Subd. 3 a): In addition to specific standards or criteria included in the applicable district regulations, the following criteria shall be applied in determining whether to approve a conditional use permit request: 1) The consistency of the proposed use with the comprehensive plan. 2) The characteristics of the subject property as they relate to the proposed use. 3) The impact of the proposed use on the surrounding area. As with all conditional use permits, a public hearing held by the Planning Commission must precede City Council action on the application. The public hearing notice was published in the Sun Post on February 28, 2008 and sent to those property owners within 350 feet of the subject property. The Planning Commission will hold the public hearing on March 10, 2008 and make a recommendation for the City Council to consider at its March 18, 2008 meeting. Aerial submitted by applicant indicating parking areas for various uses in building. B. STAFF COMMENTS 1. West Metro Fire District • Clothing and other personal articles shall not be stored in corridors unless the corridor is protected with an automatic sprinkler system or stored in metal lockers. • Provide panic hardware on the exit doors adjacent to room #'s 1 and 16. An alternative is to remove all dead -bolt locks from the doors so they are free - swinging. • Provide documentation that the building fire alarm system has received its required annual maintenance. • There shall be "no parking — fire lane" signs installed every 75 feet along the designated fire lane. This area may be used for bus loading/unloading only, but shall be clearly marked as a fire lane. 2. Parking In accordance with parking requirements in Section 515.17 the proposed use must provide at least 163 off-street parking spaces. Specifically: - 146 spaces are required for the church use (364 seats @ 1 space per 2.5 seats = 146 spaces) - 9 spaces are required for Lionsgate Academy (9 classrooms @ 1 space/classroom) - 4 spaces for St. David's Early Childhood Development (4 classrooms @ 1 space/classroom) - 4 spaces for Happy Time Pre-school (4 classrooms @ 1 space/classroom) There are 175 parking spaces on site. Lionsgate Academy has indicated that they will not allow students to bring vehicles to school. Their parking and drop off/pick up area will be the excess parking area along the north and west side of the building as shown in Exhibit E. • 8 spaces are currently designated for drop off/pick up for Happy Time and St. David's. These spaces shall remain in place. CONDITIONAL USE PERMIT - CORNERSTONE CHURCH- 3420 NEVADA AVE N 2 • All handicapped accessible spaces must be striped and signed in accordance with the Minnesota State Building Code. 3. Hours of operation • The church uses the facility throughout the week. However, attendance during the day does not approach the peak level on Sundays and Wednesday evenings (6:30 pm.) • Lionsgate Academy's hours will be from 8:30 or 9:00 am to 3:00 or 3:30 pm. • Happy Time Pre -School's hours are from 7:30 am to 5:00 pm. The peak time for drop-off is 9:00 am. The peak time for pick-up is 11:30 am. • St. David's hours are 7:00 am to 6:00 pm. The peak time for student drop-off is 9:00 am. There is a group of students who leave at noon and the balance of the students are picked up between 3:00 and 5:00 pm. 4. Future use of the building This conditional use permit encompasses all current users of the building, as well as Lionsgate Academy, which plans to occupy the building this fall. If a tenant vacates their space in the future, a similar use may occupy that space without the need for a new conditional use permit. However, a more intense use or a use that will use more space than what is approved as part of this conditional use permit would require a public hearing to amend the permit. A Business Information Form must be submitted to the City for all proposed tenants in the future, prior to them occupying any space within the building. This will allow staff to review the use and determine if a new conditional use permit is required. In addition, future expansion to the building will require a separate conditional use permit as well. However, we anticipate that most changes of use within the building will be handled administratively by staff without further review by the Planning Commission or City Council. C. RECOMMENDATION Staff recommends approval of the requested Conditional Use Permit for a public charter school to occupy a portion of a building owned and used by Cornerstone Church at 3420 Nevada Ave N, subject to the following conditions: 1. The spaces are to be used as indicated on the approved floor plan. The gymnasium, fellowship hall and room labeled "MP B" may be used by all tenants. City staff has the authority to review and approve similar church and school uses so that the mix of these uses within the building may change over time, provided that such changes comply with city code. 2. The applicant must submit a handicap accessible parking space striping plan to _ the Building Official for review and approval. Spaces must be striped and signed in accordance with the Minnesota State Building Code. The Building Official must inspect the striping and signage to see that it complies with the code prior to occupancy by Lionsgate Academy. Crystal, MN 55422 Jason, Cornerstone Church is currently considering the application to lease classroom and office facilities to Lionsgate Academy, a public Charter School. They are a school focused on providing a specialized learning environment for children with Autism. They are planning to open in the fall of 2008 and will be opening registration in the near future. Their plan is for an Enrollment of 50-60 students the first year. They would like to add a class per year over the next two years. We have reviewed the current classroom usage and are considering the following classrooms to be included in their lease: #3, 4, 5, 6, 7, 16, 17, and 18. Room #8 is an office and they would use it as their main office. Currently, rooms 3-8 are occupied by Calvin Christian School and they have not renewed their lease for next year. In addition, there would be provisions for shared usage of the Gymnasium, Multi-purpose room A (MP A) and the Fellowship Hall. It is our highest priority to meet the needs of our current tenant that will be remaining -St. David's — who also works with special needs children. Happy Time Preschool is our own program preschool program with no plans to expand. Our Church facilities are used throughout the week for our programs, however, there is never the attendance during the daytime that we expect on Sundays and for our Wednesday Night Program. Our Wednesday night program is attended by many local neighborhood children and does not begin until 6:30 PM.. It is well attended, and it is one of the only times we use the entire facility. We believe, based on their size, that a school of this nature would not significantly increase traffic nor will it create issues with parking. As mentioned in my conversation with Jason, we have begun to discuss the possibilities of additional parking along the East side of both the North and South wings of our facility, which would add approximately 40 additional parking spots. Thank You, Gene Ferrel Property Committee Chairman EXHIBIT C Organization & Purpose: Lionsgate Academy is a public charter school approved by the Minnesota Department of Education, after a rigorous two-year application process, to open in the fall of '08. The main facility requirement is a category "E" designation. Lionsgate Academy is a secondary school serving students from grades 6 through grade 12 with programs geared towards students with high -functioning autism. As a public school, it is open to all students regardless of gender, age, race or ability. The school anticipates all or most of its students will be identified on the autism spectrum. We plan to open with grades 6 through 10 with about 50 students, and add a class of about ten students per year for the next two years to grade 12. Hours: educational hours will be from 8:30 or 9:00 am to 3:00 or 3:30 pm, which will be the peak times for drop-off and pick-up Numbers of Enrollment: We will open the first year with 50-60 students and add a class a year for two years (10 to 15 students a class) through 12th grade. Transportation of Students: We may have a couple of bus routes to near by communities but we anticipate at least half to two-thirds of students will be transported to school by their parents Parking Areas: ????? It offers children an opportunity to grow in a rich environment. Each child is allowed to develop at his or her own pace and interest level in an atmosphere of nurturing and caring. Our developmentally appropriate classrooms are staffed by experienced personal to offer children time to experiment with a wide range of materials and equipment. Children are encouraged to creatively express themselves through using a variety of art and sensory materials, and play equipment. Purposes and Goals: Spiritual: To lead each child to know that he or she is uniquely created and loved by God. To teach children that he or she can put their trust in God. To expand each child's knowledge of God. Educational: To provide children with a richly varied and secure environment. To provide experiences and materials which stimulate curiosity and develop creative thinking and problem -solving skills. To enable children to experience successes at their individual levels of development. To create a climate of confidence in which children can learn readily. The program includes both a standard preschool which runs from 9-11 AM and an Extended care program which begins at 7:30 AM and ends at 5:00 PM. Hours: Their hours of operation are from 7:30 AM to 5:00 PM. The peak times for drop-off of students is 9:00 AM. The peak pick-up of students is at 11:30 AM. The pickup of students in the Extended Care program varies due to the families and is staggered throughout the schedule. Enrollment: They currently have an enrollment of 74 students. The program allows for enrollment for ages 33 mo to 6 years old. Many students do not participate in the full week program; some may be enrolled only in the Tuesday/Thursday, Monday -Wednesday -Friday or the all week sessions. In 2005, they opened their Early Childhood Development program at Cornerstone Church. St. David's Early Childhood Program is an early childhood education program that is accredited by the National Association for the Education of Young Children (NAEYC). St. David's Early Childhood Program is a developmentally appropriate program serving children ages 16 months to five years. Their school year corresponds with the public school year with minor variations. At the heart of St. David's approach to early childhood education is the belief that the preschool years provide a significant opportunity for educating and guiding young children in all areas of their development. Their enrollment includes children with special needs who are integrated in the classroom setting. This provides unique learning opportunities for all children. St. David's seeks to provide support, education, and the necessary tools to help strengthen families. They provide several Therapy services at this location. Hours: 7:00 AM to 6:00 PM. The peak time for student drop-off is at 9:00 AM. There is a group of student who are there only until noon when traffic spikes a little. The balance of the students are picked -up between 3,5 PM. Enrollment: 43 Transportation of Students: There is no transportation provided by the School. All students are dropped off and picked up by their families. There is a small bus from Cavenaugh School that picks up a few Special Education Students on MWTF at 8:30 and returns them in the afternoon after their classes at Cavenaugh. A. BACKGROUND 6622 46th Avenue North (P.I. D.08-118-21-44-0074) is located at the northeast corner of 46th and Hampshire Avenue North, The Economic Development Authority of the City of Crystal ("the EDA") purchased the property in November 2007 for its scattered site redevelopment program. The EDA is proposing to plat the property into two lots to be addressed as 4604 and 4612 Hampshire Ave N. The lots would be sold for construction of new single family houses on each lot. The following Exhibits are attached: A. Aerial photo showing the subject property (house and garage have since been demolished). B. Preliminary Plat of Crystal Economic Development Authority Fourth Addition C. Final Plat of Crystal Economic Development Authority Fourth Addition Prior to Council consideration of the Preliminary and Final Plat, the Planning Commission must hold a public hearing on the matter. Notice was published in the Sun Post on February 28, 2008 and mailed to all property owners within 350 feet. At the March 10, 2008 meeting, the Planning Commission will hold the public hearing and make a recommendation for the City Council to consider at its March 18, 2008 meeting. B. STAFF COMMENTS 1. Lot Dimensions. The proposed plat, to be titled "Crystal Economic Development Authority Fourth Addition", would have two lots: LOT PROPOSED LOT WIDTH LOT DEPTH LOT AREA # ADDRESS (approx.) (approx.) Section 515.33 Subd. 5 requires a minimum width of 60 feet, a minimum depth of 100 feet and a minimum area of 7,500 sq. ft. Both lots would meet these requirements. 2. Easements. Utility and drainage easements would cover the areas within 10 feet of a front lot lines and the side street lot line of Lot 1, and 5 feet of any side and rear lot line. The easements will facilitate utility installation and maintenance as well as space for grading and swales for drainage purposes. 3. Setbacks. Both parcels' front yards would face west towards Hampshire Avenue. Minimum setbacks are established in Section 515.33 Subd. 8: Front 30 feet; rear 30 feet; side 5 feet; side street (corner lots) 10 feet. Both lots could easily accommodate new houses in compliance with the minimum setbacks; Lot 1 would have a maximum building pad of approximately 65 feet wide and 62 feet deep. Lot 2 would have a maximum building pad of approximately 60 feet wide and 62 feet deep. Eaves would only be allowed to extend into the front and rear setbacks; they could not extend into the side setbacks because those setbacks are controlled by the platted easements which must be kept clear from ground to sky. Therefore the side setbacks are likely to be a foot or two greater than the drainage and utility easements. City code does allow limited exceptions from the front and rear setbacks; generally no more than a 4 foot projection for room bump -outs and an 8 foot projection for decks and unenclosed porches. 4. Infrastructure. a. Public utilities (water and sanitary sewer). The existing water and sewer stubs would be used for the new house on Lot 1. However, if the sewer stub needs to be replaced, the EDA will reimburse the contractor. The EDA needs to install new water and sewer stubs on Hampshire Avenue to serve Lot 2. b. Private utilities (electric, telephone and cable TV). The former house was served by overhead utilities directly from a utility pole at the northeast corner of the lot. To serve the new houses, the utilities and the builder will install underground service lines from the existing pole to the new houses. C. Driveways. Both of the new houses would be required to install driveways to Hampshire Avenue. Driveways would be installed by the builder. The EDA will install 22' wide curb cuts 8 feet south of each lot's north lot line. The EDA will remove the 46th Ave curb cut upon project completion. d. Drainage. The property is served by gutters and catch basins located on the adjacent streets. For the new houses, most runoff (i.e. 100% of PRELIMINARY PLAT - 6622 46T" AVE (TO BE 4604 AND 4612 HAMPSHIRE) PAGE 2 OF 3 driveway and approximately 50% of roof) would be directed to either street's gutters then into the nearest catch basin. A limited amount of runoff will either soak in or run down slope to the north and east, just as it does today. 5 Park Dedication Fee. Section 510 of City Code requires that a park dedication fee of $1,000 be paid for the net gain of one housing unit on the property. The EDA will pay this fee to the city's park improvement fund before the plat is recorded with Hennepin County. Park dedication fees are used to make capital improvements to the park and recreation system. 6. SAC charges. The EDA will pay the $1,825 Sewer Availability Charge levied by Metropolitan Council Environmental Services for the net gain of one housing unit of the property. C. RECOMMENDATION Staff recommends approval of Application 2008-02 for Preliminary and Final Plat entitled "Crystal Economic Development Authority Fourth Addition" to divide 6622 46th Avenue North into two lots for new single family houses. Finding of fact is that the proposed plat would be consistent with the requirements of Crystal City Code. The Planning Commission is asked to make a recommendation on the request for City Council consideration. The City Council would consider a resolution approving the Preliminary and Final Plat at its next regular meeting on March 18, 2008.
