Commissioners Buck, Whitenack, and VonRueden all agreed with the proposed 2 vehicle limit. Consideration of page 95, assembly as an accessory use in C-1 conditional use permit, included comments from Commissioner Johnson who felt that the hours of operation was sufficient to restrict the use of a property and questioned whether it is in the city's purview to dictate the number of people who may assemble. Commissioner Buck said the "hours" and "adequate parking" regulation would not control the number of people. Chair Whitenack asked for clarification on the accessory function of the property. Planner Sutter noted that any institutional use GAPLANNINGTIanning Commission12012102.131minutes.doex unapprovea minuies or the r eoruary i.s, Luiz riannmg Lomtnzssion Meeting page 2 of 2 like a community center or church is already required to have a conditional use permit. The commissioners were asked to contemplate at what point the gathering might encroach upon the neighborhood. Commissioner VonRueden asked when it becomes an accessory use. Mr. Sutter stated that would occur when the property or a portion the property is leased or rented out. Commissioner Whitenack noted that the city would rely on the applicant being honest about the use of the property and if they are not and it becomes problematic, how can the city deal with the issues. Commissioner VonRueden asked if the city should be concerned with the frequency of the assembly. Planner Sutter suggested more specific languaregarding the impacts on the neighborhood be included as a tool to re,ond possible complaints. Commissioner VonRueden added that using a P J ber to rict the assembly would give the city a reasonable tool to control tJmpact n the neighborhoods.
