like a community center or church is already required to have a conditional use
permit. The commissioners were asked to contemplate at what point the gathering
might encroach upon the neighborhood. Commissioner VonRueden asked when it
becomes an accessory use. Mr. Sutter stated that would occur when the property or
a portion the property is leased or rented out. Commissioner Whitenack noted that
the city would rely on the applicant being honest about the use of the property and if
they are not and it becomes problematic, how can the city deal with the issues.
Commissioner VonRueden asked if the city should be concerned with the frequency
of the assembly. Planner Sutter suggested more specific languaregarding the
impacts on the neighborhood be included as a tool to re,ond possible

SUBJECT: Public hearing on proposed revisions to the Zoning Ordinance
Staff has completed the proposed revisions to the zoning ordinance and made them available
on the Planning & Zoning page of the city's website, www,crystalmn.gov, and also at the
Administration desk at City Hall. Notice of the March 12, 2012 public hearing is being
published in the Sun Post on March 1, 2012.
To update the previous draft you received, please replace pages 95-96, 103-106 and 119-122
with the enclosed new pages. As before, red bold type indicates additional items since the
January meeting. Blue bold type indicates additional items since the February meeting.
The City Council will discuss the proposed zoning ordinance revisions at a work session on
March 8, 2012. Staff will present the Council's comments to the Planning Commission at the
March 12, 2012 public hearing.
Council action would tentatively be as follows:
March 21, 2012 First reading
April 3, 2012 Second reading and adoption
April 12, 2012 Ordinance publication
May 12, 2012 Effective date of new zoning ordinance
