Site plan review request from Adams French Property LLC for a new self-storage facility at 5702 West Broadway Avenue (Application Number 2018-08) Planner Olson presented a brief summary of the staff report and noted that staff is recommending approval of the site plan as submitted with one condition: 1. The development shall be constructed according to the site plan in attachment H. Prior to disturbing the site, the applicant shall sign a site improvement agreement with the city to guarantee installation of the parking lot and landscaping plan. Commission member Strand asked about the traffic patterns on the site. Planner Olson and Nick Stein explained the proposed traffic patterns on the site, including where trucks will load and unload. One way traffic patterns are proposed in case the proof of parking is constructed. Unapproved Planning Commission Minutes October 8, 2018 Commission member Heigel asked if truck size or height is limited. Mr. Stein stated that the doors will accommodate the typical trucks used by tenants to drop-off their goods. Commission member Maristany asked if drainage will impact the neighboring residential properties. Steve Oliver explained that the location of catch basins along the north curb line that will take water to the underground system. The current infiltration basin at times spills over on to the neighboring properties. Maristany asked if the interior lights will be lit on off-hours. Mr. Stein stated that the lights will be dimmed during those times when the facility is closed. Olson stated that there are not windows on the north side of the building. Commission member Strand asked about operating hours. Mr. Stein stated that tenants will be able to access the building from 7 AM until 7 PM, with more limited office hours. Some businesses who use the facility, such as electrical contractors, will be able to have additional access. Maristany asked if the exterior lighting will create light pollution, including vehicle headlights. Olson stated that the city does not regulate vehicle lights. Mr. Stein stated that light poles will be dimmed when the site is not open. Chair Johnson asked if anyone from the public wanted to speak. Seeing no one, the public hearing was closed. Moved by Daly and seconded by Buck to recommend that the City Council approve the site plan for a self-storage facility at 5702 West Broadway by Adams French Property LLC. The meeting adjourned at 7:50 p.m. PLANNING COMMISSION STAFF REPORT Variance for 5224 Hanson Court North _______________________________________________________________ FROM: Dan Olson, City Planner ____________________________________________________________________ TO: Planning Commission (for November 19 Meeting) DATE: November 13, 2018 RE: PUBLIC HEARING - Variance request from Mike Gilbertson for a building addition at 5224 Hanson Court North (Application Number 2018-13) A. BACKGROUND Mike Gilbertson, owner of the commercial property at 5224 Hanson Court, is requesting a variance to the setback requirements to construct an addition to his existing building. The property is zoned Industrial (I). Notice of the November 19 public hearing was published in the Sun Post on November 8 and mailed to owners within 500 feet (see attachment A). To date staff has not received any comments on this proposal. Attachments: A. Site location map showing public hearing notification area B. Existing zoning map C. Photos of existing property D. Project Narrative E. Site plan (2 sheets) B. VARIANCE REQUEST The existing building was constructed in 1959 and does not meet front and (north) side setback requirements. Therefore the building is considered legally nonconforming. The applicant is requesting a variance to the required (south) side setback to construct a 330 square feet addition to the existing building. The addition would be used as a loading area for the business, which manufactures various soap products. The addition does not meet the required 10 foot setback, being 3 feet to the property line. If approved the building addition would restrict access to the rear of the property as a potential parking area. Currently the property has adequate parking in front of the building for use by the 5224 HANSON COURT NORTH VARIANCE APPLICATION PAGE 1 OF 3 -time and one part-time employees. According to the applicant, customers do not come to the property. There is a concern that if the business expands to include more employees or if the property is sold, parking in the front would not be adequate. Therefore staff recommends a condition of approval for the variance that if parking is needed, the property owner will provide permanent access to the rear parking area by either removing the addition or leaving the overhead doors open and unlocked during business hours and leave an unobstructed pathway for vehicles. This parking area would be paved according to the requirements found in the unified development code (UDC). The following are the relevant approval criteria for this variance as outlined in city code section 510.33, followed by staff response: a) Variances shall only be permitted when they are in harmony with the general purposes and intent of the official control and when the terms of the variances are consistent with the comprehensive plan. Response: The intent of the czoning ordinance is to provide for regulations to promote orderly development that allows for adequate access to light, air, and convenient access to property. The approval of a building addition that is closer to the south property line will not impede access to adequate light or air for adjacent properties or for the existing building. If the variance is approved, the building will continue to be in Industrial future land use designation. b) Variances shall only be permitted when the City Council finds that strict enforcement of specific provisions of this section would create practical difficulties due to circumstances unique to a particular property under consideration. Practical difficulties, as used in connection with the granting of a variance, means that the property owner: 1) proposes to use the property in a reasonable manner not permitted by an official control; and 2) the plight of the landowner is due to circumstances unique to the property not created by the landowner; and 3) the variance, if granted, will not alter the essential character of the locality. Response: The use of the subject property to include a loading area for the business is a reasonable use permitted by the czoning regulations. Because of the loading facility could be constructed the south side of the building. The setback variance is necessary to ensure that the loading area addition can be placed on the lot in a way which provides the best possible 5224 HANSON COURT NORTH VARIANCE APPLICATION PAGE 2 OF 3 commercial use of the property without negatively impacting other properties. The essential character of this area will not change if the variance is approved since the proposed addition will be set back approximately 52 feet from the front of the building. c) Economic considerations alone do not constitute practical difficulties. Response: The applicant has indicated that a loading dock area is needed for deliveries to the property. Currently deliveries are conducted in front of the building, which can create situations where the delivery truck infringes upon the public street. Therefore economic considerations alone are not the sole reason for requesting this variance. C.REQUESTED ACTION The Planning Commission is being asked to make a recommendation to the City Council to either deny or approve the variance application to establish a minimum setback of 3 feet from the south property line for a building addition at 5224 Hanson Court North. This recommendation should include findings of fact either for or against the proposal. The Commission may reference the findings for approval in Section B, above. Staff recommends approval of the variance request with the following condition: 1. If city staff determines that the parking area behind the building is needed to a. Provide permanent access to the rear parking area along the south side of the property. The following are acceptable means of meeting this requirement: i. Remove the loading area addition; or ii. Open and unlock the front and rear overhead doors during business hours and leave an unobstructed pathway for vehicles to the rear parking area. b. Pave the rear parking area and install curb and gutter according to the requirements of city code section 520.15. It would be used for shipping and receiving. This area would make it so semi-trailer trucks that come to our business will be kept off of Hanson Court and not blocking traffic. The new shipping area will have a garage door on each end so that cars and small trucks can park or service the back yard. Shipping and receiving hours are 8:00am to 3:30pm Mon-Fri. Our company has three have been in business for 35 years. Business will continue for another generation with my two sons who are taking over the business.
