Memorandum DATE: August 21, 2018 TO: City Council FROM: Mark Ray, PE, Director of Public Works SUBJECT: Winnekta Pond Project update Summary Design – No substantial changes in the design since the March work session. Still mostly a sediment removal project. Environmental Assessment Worksheet (EAW) - The Minnesota Environmental Quality Board has notified the City that an EAW is required for this project. This need had not been brought up previously. While this is an administrative process, the project team is working to minimize the impact on the overall project schedule. That said, due to the project having limited impact on residential properties, schedule flexibility, within reason, is not a major concern. Permitting - The United States Army Corps of Engineers (USACE) and Wetland Conservation Act (WCA) permits have been approved. The Minnesota Department of Natural Resources (MDNR) Work in Public Waters Permit is pending completion of the EAW and the City’s record of decision regarding the need for an Environmental Impact Statement. Easement – Staff has come to a verbal agreement with the property management staff of the adjacent apartment complex where they have agreed to pay 90% of the maintenance cost for the entire buffer area. City staff will administer the contract at no cost to the apartment complex. Both City and apartment complex staff are working to determine the best way to budget/plan for the expense within the agreement language. Cost • $771,705 (including engineering and 10% contingency) which is fully reimbursable by the Bassett Creek Watershed Management Commission • $25,000 for EAW-related activities which is fully reimbursable by the Bassett Creek Watershed Management Commission Schedule • October 23 City Council meeting to approve plans and authorize ad for bid • November 14 Bids due • November 20 City Council award contract • December 4 City Council meeting regarding Environmental Assessment Worksheet Construction window has not been established (will be done prior to October 23), may be allowed to occur winter 2019-2020 for better pricing. Public Hearings 6.1 The Mayor will open a public hearing to receive comment and consider a resolution vacating a platted drainage and utility easement to be supplanted by a larger easement in the plat of Bass Lake Addition. With the replatting of the property identified by PID 04-118-21-31-0022 to Bass Lake Addition (Agenda Item 7.3) with two residential lots, new utility easements will be defined, making the existing drainage and utility easement no longer necessary. After taking public comment on the proposed easement vacation, recommend adoption of the resolution vacating the existing easements. 6.2 The Mayor will open a public hearing to receive comment and consider a resolution approving the sale of 5618 and 5624 Welcome Ave. N. (PID 04-118-21-31-0022 being replatted) for new home construction. Earlier this year, the City Council determined that the property identified by PID 04-118- 21-31-0022 is surplus land and should be subdivided for two new residential lots. After taking public comment, the Council should adopt the resolution approving the sale of the two lots created by the plat of Bass Lake Addition (Agenda Item 7.3.) 6.3 The Mayor will open a public hearing to receive comment and consider a resolution approving the sale of 5006, 5012 and 5018 Vera Cruz Ave. N. (PID 09-118-21-13-0066 being replatted) for new home construction. Earlier this year, the City Council determined that the property at 5000 Vera Cruz Avenue North is surplus land and should be subdivided for three new residential lots. After taking public comment, the Council should adopt the resolution approving the sale of the three lots created by the plat of Cavanagh View Addition (Agenda Item 7.4.) (PID 19-118-21-42-0127) for new home construction. Earlier this year, the City Council determined that the property at 2949 Yukon Avenue North is surplus land and should be sold for single family home construction. After taking public comment, the Council should adopt the resolution approving the sale of 2949 Yukon Avenue North for new home construction. 7. Regular Agenda 7.1 The Council will consider approval of disbursements over $25,000 submitted by the finance department to the city council, a list that is on file in the office of the finance department. Recommend approval of disbursements over $25,000. 7.2 The Council will consider approval of the West Metro Fire-Rescue District 2019 budget. Article VIII, Section 3. a. of the Joint Powers Agreement (JPA) for the West Metro Fire- Rescue District (WMFRD) annual budget approval process requires the WMFRD Board approve the annual budget by July 31 and forward it to both city councils for their consideration prior to August 31. WMFRD Chief Larson reviewed the 2019 budget at the June 19 work session and the WMFRD Board approved the 2019 budget at its July 11 meeting. The total 2019 budget is $2,422,300, an increase of $126,450, over the 2018 budget. According to the funding formula, Crystal’s share of this is $1,206,268.82, an increase of $62,600.33 over 2018. 7.3 The Council will consider a resolution approving a preliminary and final plat for Bass Lake Addition. Earlier this year, the City Council determined that the property identified by PID 04-118-21- 31-0022 is surplus land and as such, should be subdivided for construction of two single family homes. At its August 13 meeting, the Planning Commission held a public hearing on the proposed plat of Bass Lake Addition and unanimously recommended approval of the plat. 7.4 The Council will consider a resolution approving a preliminary and final plat for Cavanagh View Addition. Earlier this year, the City Council determined that the property at 5000 Vera Cruz Avenue North is surplus land and as such, should be subdivided for construction of three single family homes. At its August 13 meeting, the Planning Commission held a public hearing on the proposed plat of Cavanagh View Addition and recommended approval of the plat. 7.5 The Council will consider a resolution approving dimensional and setback variances for Lot 3, Block 1, Cavanagh View Addition, 5018 Vera Cruz Ave. N. Crystal City Council Meeting Agenda Aug. 21, 2018 Page 4 of 4 One of the lots created in the plat of Cavanagh View Addition (Agenda Item 7.4) is a corner lot and an irregular shape. Because of these factors, the city requested variances for the east and west yard setbacks from 30 to 20 feet and a variance to reduce the lot depth requirement from 100’ to 65.5’ along the north side lot line (the depth along the south side lot line is 120’.) At its August 13 meeting, the Planning Commission held a public hearing on the proposed variances and recommended approval. 8. Announcements a. The City Council will hold a budget work session on Aug. 23 at 6:30 p.m. in the Community Room. b. City offices will be closed Monday, Sept. 3 in observance of the Labor Day holiday. c. The next City Council meeting is Tuesday, Sept. 4 at 7 p.m. in the Council Chambers at City Hall. d. The Crystal Business Association meets on Wednesday, Sept. 19, at a location to be determined. e. Girl and Boy Scout troops are invited to lead the pledge at City Council meetings. Troops who are interested may contact city staff for information. f. The MCES grant program funds available to participating municipalities totals $8,739,000. The program is setup to reimburse Cities for a percentage of the project cost to repair specific things related to I&I reduction. Discussion The City is budgeting to spend a significant amount of money in 2018-2019 on re-lining portions of the City’s sanitary sewer system. This work is eligible for consideration in the grant calculation. Any grant funding received will be put back into the sanitary sewer utility fund. RESOLUTION NO. 2018- _____ AUTHORIZING THE METROPOLITAN COUNCIL ENVIRONMENTAL SERVICES MUNICIPAL I/I GRANT PROGRAM WHEREAS, the Metropolitan Council Environmental Services (MCES) has identified the City of Crystal as one of the many metro cities have quantities of storm water and ground water, commonly referred to as Inflow and Infiltration (I&I), entering the public sanitary sewer system; and WHEREAS, in 2018 Minnesota Legislature appropriated $8,739,000 of state bond funds for an I/I cost share grant program. The purpose of this program is to assist eligible cities financially in an effort to mitigate inflow and infiltration into their sanitary sewer collection systems; and WHEREAS, the City has identified public sanitary sewer system components requiring rehabilitation to minimize or eliminate I&I; and WHEREAS, the City is planning on awarded contracts and completing projects that rehabilitated components of the sanitary sewer system to minimize or eliminate I&I in late 2018 and 2019. Discussion: Receivables that are included in the assessment are those that were delinquent on July 31, 2018. The total amounts due as shown on the resolution will be reduced by customer payments as they come in. In 2017, 30.4% of the August balance was collected prior to certification to Hennepin County in December. The resolution sets the public hearing for October 16, 2018 at 7:00 PM. This subdivision is located in a portion of North Bass Lake Park, addressed as 5625 Xenia Avenue North, which is being replatted as the proposed location of two new single-family homes (see agenda item 7.3). Attachment: A. Resolution B. PROPOSED EASEMENT VACATION Drainage and utility easements were dedicated on the Les Brown Addition plat when it was approved by the City Council in 1973. This property is now being replatted as the Bass Lake Addition, which splits the parcel into two new single-family lots. New drainage and utility easements are dedicated on the Bass Lake Addition plat so the existing easements in the Les Brown Addition plat are no longer needed. Notice of the August 21 public hearing was published in the Sun Post on August 2, and mailed to four utility companies: Comcast, CenterPoint Energy, Xcel Energy, and CenturyLink. All four companies have responded by saying they have no objection to the easements being vacated. . C. The following are the notable design features of this subdivision: 1. Zoning Requirements  Building setbacks – Any proposed homes on these two proposed properties will meet the setbacks required for the R-1 district, which are 30 feet for the front and rear property lines. Side setbacks will be controlled by the five foot drainage and utility easements. N o part of the homes, including eaves, may be located within a drainage and utility easement.  Lot size and area – The proposed lots meets the minimum lot area (6,000 sq. ft.), width (50’), and depth (100’) requirements of the R-1 district. 2. Pedestrian and Street Access  Pedestrian connections – There is not a sidewalk accessing these lots and none planned.  Street access – The two lots will be accessed from new curb cuts to be installed on Welcome Avenue North. 3. Utilities The proposed new homes will connect with existing water and sanitary sewer mains. The city will install these service connections in fall 2018 prior to the BASS LAKE ADDITION – SUBDIVISION APPLICATION PAGE 3 OF 3 lots being sold. There are no existing overhead private utility lines on the property, but new drainage and utility easements are dedicated with this new plat. Existing easements on the property will be vacated and replaced with the new easements. New private utility services to the new homes, such as Xcel Energy, Century Link and Comcast, will be buried underground. 4. Grading, Drainage and Erosion Control – The city does not require a grading, drainage and erosion control plan for parcels under one acre in size. However during home construction, the city will require erosion control techniques to be used on-site including silt fences and inlet protection. 5. Landscaping – Existing trees on the two lots are shown on the preliminary plat. It is possible that trees will be removed from the property to accommodate the new homes. As part of the sale of the properties, the city will require the builder to install new trees. 6. Park dedication – Because net revenue from the lot sales will go into the Parks Capital Fund, and park dedication fees are deposited into the same fund, the park dedication requirement is already being met. C. FINAL PLAT In addition to preliminary plat approval for the Bass Lake Addition subdivision, the applicant is also requesting final plat approval. According to city code section 510.11, Planning Commission review of the final plat is not required. The final plat is in conformance to the preliminary plat. D. REQUESTED ACTION At the August 13, 2018 Planning Commission meeting, the Commission recommended by a vote of seven to zero (two members were absent) that the City Council approve the Preliminary Plat of the Bass Lake Addition subdivision. City Council motion to approve the proposed resolution (Attachment F) is requested. If the plat is approved, the lot sales will likely close in September 2018 and the new homes completed by spring 2019. BACKGROUND On June 5, 2018 the City Council de termined that PID #09-118-21-13-0066 is surplus land and that it should be subdivided and sold for construction of three new single-family homes. Proceeds from the sale of the lots will be used to fund park improvements. The plat creating these lots is named Cavanagh View Addition and the site is zoned Low Density Residential (R-1). Notice of the August 13 public hearing was published in the Sun Post on August 2 and mailed to owners within 500 feet (see attachment B). Attachments: A. Site location map B. PROPOSED PROPERTY SUBDIVISION Existing use The site is a vacant parcel previously identified as Schutz Park and addressed as 5000 Vera Cruz Avenue North. Parcel Area Details 43,542 sq. ft. (1.0 acre) Total area to be replatted - 19,037 sq. ft. (0.4 acre) Right-of-way for Vera Cruz and 50th Avenues = 24,505 sq. ft. (0.2 acre) Lot 3 (new 5018 Vera Cruz) Subdivision design features The proposed plat would be named Cavanagh View Addition. Since the subdivision abuts a county roadway (Bottineau Boulevard), Hennepin County staff has reviewed this subdivision request and finds it acceptable. The following are the notable design features of this subdivision: 1. Zoning Requirements  Building setbacks – Except for lot 3, for which setback variances are requested (see agenda item 3c), a ny proposed homes on these proposed properties will meet the setbacks required for the R -1 district, which are 30 feet for the front and rear property lines. Side setbacks will be controlled by the five or ten foot drainage and utility easements . No part of the homes, including eaves, may be located within a drainage and utility easement.  Lot size and area – Except for lot 3, for which a variance is requested to lot depth (see agenda item 3c), the proposed lots meets the minimum lot area (6,000 sq. ft.), width (50’), and depth (100’) requirements of the R-1 district. 2. Pedestrian and Street Access  Pedestrian connections – There is an existing sidewalk along Vera Cruz Avenue. Directly north of Lot 3, the sidewalk connects to an existing local bituminous trail on the west side of Bottineau Boulevard. The Crystal Lake Regional Trail is located on the east side of Bottineau Boulevard.  Street access – The three lots will be accessed from new curb cuts to be installed on Vera Cruz Avenue North. CAVANAGH VIEW ADDITION – PRELIMINARY PLAT APPLICATION PAGE 3 OF 3 3. Utilities The proposed new homes will connect with existing water and sanitary sewer mains. The city will install these service connections in fall 2018 prior to the lots being sold. Existing overhead utility lines are located along Vera Cruz Avenue. These utilities will be located in drainage and utility easements that are dedicated with this new plat. If those lines are relocated or extended, then the lines and extensions must be buried underground. New private utility services to the new homes, such as Xcel Energy, Century Link and Comcast, will be buried underground. 4. Grading, Drainage and Erosion Control – The city does not require a grading, drainage and erosion control plan for parcels under one acre in size. However during home construction, the city will require erosion control techniques to be used on-site including silt fences and inlet protection. 5. Landscaping – Existing trees on the three lots are shown on the preliminary plat. It is possible that trees will be removed from the property to accommodate the new homes. As part of the sale of the properties, the city will require the builder to install new trees. 6. Park dedication – Since the city is the applicant for this subdivision request, new revenue from the lot sales will go into the Parks Capital Fund, and since park dedication fees are deposited into the same fund, the park dedication requirement is already being met. C. FINAL PLAT In addition to preliminary plat approval for the Cavanagh View Addition subdivision, the applicant is also requesting final plat approval. According to city code section 510.11, Planning Commission review of the final plat is not required. The final plat is in conformance to the preliminary plat. D. REQUESTED ACTION At the August 13, 2018 Planning Commission meeting, the Commis sion recommended by a vote of six to one (two members were absent) that the City Council approve the Preliminary Plat of the Cavanagh View Addition subdivision. City Council motion to approve the proposed resolution (Attachment F) is requested. If the plat is approved, the lot sales will likely close in September 2018 and the new homes completed by spring 2019. BACKGROUND The subject property is part of a city-owned parcel (PID 19-118-21-13-0066) at 5000 Vera Cruz Avenue North being replatted into three lots for new home construction . Before selling the lot at 5018 Vera Cruz Avenue, the city is requesting variances to the setback and lot depth requirements. The property is zoned Low Density Residential (R-1). Notice of the August 13 public hearing was published in the Sun Post on August 2 and mailed to owners within 500 feet (see attachment B). To date staff has not received any comments on this proposal. VARIANCES The proposed lot is defined as a “corner through lot” in the city’s unified development code (UDC) because it fronts on more than two roadways. As such, the west side of the property is defined as the front yard, the east side as the rear yard, the north side as the corner side yard, and the south side as the interior side yard (see attachment D). Due to the unusual trapezoid shape of the lot and the location of the lot facing three roadwa ys, the city is requesting the following variances for a proposed new home: COUNCIL STAFF REPORT Variance for 5018 Vera Cruz Avenue North 5 018 VERA CRUZ AVENUE NORTH – VARIANCE APPLICATION PAGE 2 OF 3 o Variances to reduce the required east and west yard setbacks from 30 to 20 feet. The home will face Vera Cruz on the west side. If the new home’s garage door faces north, then the setback from that lot line would automatically increase from 10 to 20 feet. o Variance to reduce the lot depth requirement from 100’ to 65.25’. The variance is only necessary along the north side lot line, as the lot depth along the south side lot line is 120.44 feet. The following are the relevant approval criteria for this variance as outlined in city code section 510.33, followed by staff response: a) Variances shall only be permitted when they are in harmony with the general purposes and intent of the official control and when the terms of the variances are consistent with the comprehensive plan. Response: The intent of the city’s zoning ordinance is to provide for regulations to promote orderly development that allows for adequate access to light, air, and convenient access to property. The approval of a home that is closer to the west and east property lines, and that does not meet the lot depth requirement, will not impede access to adequate light or air for adjacent properties or for the proposed home. If the variance is approved, the home will be in conformance with the Comprehensive Plan’s Low Density Residential future land use designation. b) Variances shall only be permitted when the City Council finds that strict enforcement of specific provisions of this section would create practical difficulties due to circumstances unique to a particular property under consideration. Practical difficulties, as used in connection with the granting of a variance, means that the property owner: 1) proposes to use the property in a reasonable manner not permitted by an official control; and 2) the plight of the landowner is due to circumstances unique to the property not created by the landowner; and 3) the variance, if granted, will not alter the essential character of the locality. Response: The use of the subject property for a single-family home is a reasonable use permitted by the city’s zoning regulations. The parcel was originally platted in 1911 as a standard rectangle, but after 100 years of road realignments and easement acquisitions, the property is now a trapezoid fronting three streets, one of which is a busy arterial roadway with approximately 30,000 vehicle trips per day and a busy signalized intersection north of the property. The setback variance is 5 018 VERA CRUZ AVENUE NORTH – VARIANCE APPLICATION PAGE 3 OF 3 necessary to ensure that a house can be placed on the lot in a way which provides the best possible residential use and enjoyment of the property. The lot depth variance is necessary because the lot is half as deep on the north property line as it is on the south property line, and the lot is otherwise oversized relative to minimum dimensional requirements. The essential character of this area will not change if the variance is approved:  With front and rear setbacks reduced from 30 to 20 feet, the new home can be optimally placed on the lot to minimize the impact of adjacent roadways.  The new home will be at least 10 feet from the proposed home to the south at 5012 Vera Cruz Avenue – this is equal to the typical separation between homes in Crystal. c) Economic considerations alone do not constitute practical difficulties. Response: A new home could be built on the lot without the variance, but with the variance the new home can be located in a way that better fits the character of the surrounding streets. Therefore economic considerations alone are not the sole reason for requesting this variance. C. REQUESTED ACTION At the August 13, 2018 Planning Commission meeting, the Commissio n recommended by a vote of six to one (two members wer e absent) that the City Council approve the variance application to establish minimum setbacks of 20 feet from the west and east lot lines at 5018 Vera Cruz Avenue North, and to allow a minimum lot depth of 65.25 feet measured along the north side lot line . City Council motion to approve the proposed resolution (Attachment E) is requested.
