Approval of Agenda The Council will consider approval of the agenda.* 3. Appearances 3.1 The Mayor will swear in Police Officer Steven Parker. 4. Consent Agenda The Council will consider the following items, which are routine and non-controversial in nature, in a single motion: 4.1 Approval of the minutes from the following meetings: a. The regular City Council meeting on April 4, 2017. b. The regular City Council work sessions on April 4, 2017. c. The regular City Council work session on April 13, 2017. 4.2 Approval of the list of license applications submitted by the city clerk to the City Council, a list that is on file in the office of the city clerk. 4.3 Approval of a resolution accepting the following donations: a. $1,000 from Maxwell Aircraft Service, Inc. for Crystal Airport Open House. b. $3,282 from VFW Post 494 for Crystal K-9 Unit. 5. Open Forum (The City Council appreciates hearing from citizens about items of concern and desires to set aside time during each meeting for Open Forum. To provide ample opportunity for all, speaking time is limited to three minutes and topic discussion is limited to ten minutes. The Mayor may, as presiding officer, extend the total time allowed for a topic. By rule, no action may be taken on any item brought before the Council during Open Forum. Public Hearing 6.1 The Mayor will open a public hearing to receive comment for Phase 16 street reconstruction special assessments and consider a resolution to adopt assessments. Last month the Council called for a public hearing to hear comments on the proposed special assessments (and project) for Phase 16 (Skyway neighborhood) of street reconstruction. The City Council should hold the public hearing and take comments. After the public hearing, recommend approval of the resolution adopting the special assessments for Phase 16. 7. Regular Agenda 7.1 The Council will consider approval of disbursements over $25,000 submitted by the finance department to the city council, a list that is on file in the office of the finance department. Recommend approval of disbursements over $25,000. 7.2 The Council will consider a resolution for a variance for a detached garage at 5809 Rhode Island Ave. N. The owner of the property at 5809 Rhode Island Avenue North is requesting a variance to construct a detached garage that is closer to Winnetka Avenue North than the existing home. The property is zoned Low Density Residential (R-1). The Planning Commission held a hearing on the application on April 10 and recommended approval of the variance subject to the findings outlined in the staff report. 7.3 The Council will consider approval of State of Minnesota Joint Powers Agreement between the City of Crystal on behalf of its prosecuting attorney. In order to utilize the Bureau of Criminal Apprehension’s (BCA) communications network, CJDN, a joint powers agreement (JPA) between the BCA and city is required. Additionally, for our prosecuting attorney (Peter MacMillan) to have access to that network and Crystal’s data, this JPA is also required. Recommend authorizing the Mayor and city manager to execute the JPA with the BCA for these purposes. 7.4 The Council will consider a resolution authorizing the Phase 16 Joint Powers Agreement with Brooklyn Park. Crystal City Council Meeting Agenda April 19, 2017 Page 3 of 6 Part of the Phase 16 project impacts local streets in Brooklyn Park. As with previous street reconstruction projects where other jurisdictions are impacted, a joint powers agreement is executed outlining the costs of the project and responsibilities of the cities. Recommend authorizing execution of the joint powers agreement with the city of Brooklyn Park for Phase 16 of street reconstruction. 7.5 The Council will consider bids and a resolution awarding the contract for the Phase 16 street reconstruction project. Three bids were received last month for Phase 16 of street reconstruction and the bids, project financing and assessments were reviewed at the April 4 work session. Recommend approval of resolution awarding the construction contract to Palda and Sons Inc. for Phase 16 of street reconstruction. 7.6 The Council will consider a resolution awarding the construction services contract for the Phase 16 street reconstruction project. Recommend approval of the resolution awarding the construction services contract for Phase 16 to SEH. 7.7 The Council will consider a resolution awarding the materials testing contract for Phase 16 street reconstruction and 2017 alley construction projects. Three quotes were obtained for Phase 16 and alley materials testing. Recommend approval of the resolution awarding the materials testing contract to ITCO Allied Engineering Co. 7.8 The Council will consider bids and a resolution awarding the contract for the 2017 alley reconstruction project. Three bids were received for this year’s alley reconstruction project. Recommend approval of the resolution awarding the contract for 2017 alley reconstruction to CS McCrossan. 7.9 The Council will consider civil penalties for violation of liquor license regulations by Tremolo LLC d/b/a Crystal Wine and Spirits located at 4920 West Broadway. On December 23, 2016 alcohol compliance checks were conducted by Crystal Police Department at licensed liquor establishments in Crystal. Crystal Wine and Spirits Crystal City Council Meeting Agenda April 19, 2017 Page 4 of 6 did not pass this compliance check. An employee of the business has since pled guilty in court to the sale of alcohol to a minor. This is the second liquor violation for this licensee within the past 24 months. After hearing comments from the business, recommend imposing civil penalties for this violation, consistent with provisions of the City Code, of a three-day license suspension and civil fine of $1,500 with the city clerk determining the dates of the license suspension and payment date of the fine. 7.10 The Council will consider civil penalties for violation of liquor license regulations by Blazin Wings, Inc. d/b/a Buffalo Wild Wings #69 located at 5590 West Broadway. On December 23, 2016 alcohol compliance checks were conducted by Crystal Police Department at licensed liquor establishments in Crystal. Buffalo Wild Wings did not pass this compliance check. An employee of the business has since pled guilty in court to the sale of alcohol to a minor. This is considered the first liquor violation for this licensee. After hearing comments from the business, recommend imposing civil penalties for this violation, consistent with provisions of the City Code, of a one day license suspension and civil fine of $750 with the clerk determining the dates of the license suspension and payment date of the fine. 7.11 The Council will consider civil penalties for violation of liquor license regulations by Chipotle Mexican Grill of Colorado LLC d/b/a Chipotle Mexican Grill #764 located at 5608 West Broadway. On December 23, 2016 alcohol compliance checks were conducted by Crystal Police Department at licensed liquor establishments in Crystal. Chipotle Mexican Grill did not pass this compliance check. An employee of the business has since pled guilty in court to the sale of alcohol to a minor. This is considered the first liquor violation for this licensee. After hearing comments from the business, recommend imposing civil penalties for this violation, consistent with provisions of the City Code, of a one day license suspension and civil fine of $750 with the city clerk determining the date of the license suspension and payment date of the fine. 7.12 The Council will consider civil penalties for violation of liquor license regulations by El Pajaro, Inc. d/b/a El Loro Mexican Restaurant located at 99 Willow Bend. On December 23, 2016 alcohol compliance checks were conducted by Crystal Police Department at licensed liquor establishments in Crystal. El Loro did not pass this compliance check. An employee of the business has since pled guilty in court to the sale of alcohol to a minor. This is considered the first liquor violation for this licensee. After hearing comments from the business, recommend imposing civil Crystal City Council Meeting Agenda April 19, 2017 Page 5 of 6 penalties for this violation, consistent with provisions of the City Code, of a one day license suspension and civil fine of $750 with the city clerk determining the date of the license suspension and payment date of the fine. 7.13 The Council will consider civil penalties for violation of liquor license regulations by Liquor Liquidator 3, Inc. d/b/a Liquor Liquidator 3 located at 5120 56th Ave. N. On December 23, 2016 alcohol compliance checks were conducted by Crystal Police Department at licensed liquor establishments in Crystal. Liquor Liquidator 3 did not pass this compliance check. An employee of the business has since pled guilty in court to the sale of alcohol to a minor. This is considered the first liquor violation for this licensee. After hearing comments from the business, recommend imposing civil penalties for this violation, consistent with provisions of the City Code, of a one day license suspension and civil fine of $750 with the city clerk determining the date of the license suspension and payment date of the fine. 7.14 The Council will consider civil penalties for violation of liquor license regulations by Best Buy Beverage International LLC, d/b/a MGM Liquor Warehouse/Crystal located at 6200 56th Ave. N. On December 23, 2016 alcohol compliance checks were conducted by Crystal Police Department at licensed liquor establishments in Crystal. MGM Liquor Warehouse did not pass this compliance check. An employee of the business has since pled guilty in court to the sale of alcohol to a minor. This is considered the first liquor violation for this licensee. After hearing comments from the business, recommend imposing civil penalties for this violation, consistent with provisions of the City Code, of a one day license suspension and civil fine of $750 with the city clerk determining the date of the license suspension and payment date of the fine. 8. Announcements a. The Crystal Business Association is partnering with the Crystal Little League’s Burger Bash to hold its Business Expo, Saturday, April 22, 10 a.m. – 2 p.m., at the Crystal Community Center. b. The next city council meeting is Tuesday, May 2 at 7 p.m. in the Council Chambers at City Hall. c. The Parks & Recreation Commission will host the annual Arbor Day Celebration and Neighborhood picnic on Wednesday, May 3 at 6 p.m. at Yunkers Park, 8617 31st Avenue North. Crystal Business Association meets on Wednesday, May 17, at 8:30 a.m. at City Hall. g. Crystal Fund for Community Progress Plant Sale, Saturday, May 20, 9 a.m. – 2 p.m., Community Center. h. Girl and Boy Scout troops are invited to lead the pledge at City Council meetings. Troops that are interested may contact city staff for information. i.
