CRYSTAL PLANNING CONLMISSION MINUTES
JANUARY 10, 1983
The regular meeting of the Crystal Planning Commission convened at
7:30 p.m. with the following present: Elsen, Herron, Leppa, Magnu-
son, Melich, PZooney, Peters and Thorne; the following were absent:
Feyereisen; also present were Building Inspector Peterson, City
Engineer Sherburne and Recording Secretary Borrell.
Moved by Commissioner Thorne and seconded by Commissioner Magnuson
to approve the minutes of the December 13, 1982 meeting.
Motion carried.
1. Dick Kauffmann of Village Builders, Inc. and Jim Merila appeared
regarding tentative approval of proposed plat Nevada Court
located at Nevada Ave. & Valley Place.
Moved by Commissioner PZooney and seconded by Commissioner Melich
to recommend to the City Council to grant tentative approval of
proposed plat Nevada Court, which is a replat of Lots 1 thru 8,
Block 1, PZorningside Estates 6th Addition.
Motion carried.
`?. Dick Kauffmann of Village Builders, Inc. and Jim Merila appeared
regarding Application #82-77 for a conditional use permit for
residential planned unit development in a R-3 district at Nevada
Ave. & Valley Place.
Moved by Commissioner Magnuson and seconded by Commissioner
Peters to set a public hearing before the Planning Commission
at 7:30 p.m., or as soon thereafter as the matter may be heard,
February 14, 1983, to consider the request of Village Builders,
Inc. for a conditional use permit for residential planned unit
development in a R-3 district at Nevada Ave. & Valley Place,
Lots 1 thru 8, Block 1, 4orningside Estates 6th Addition.

3. Bill Nicklow, Tony Nicklow and John Kosmas of KK Design
appeared regarding a building permit for an addition to the
existing restaurant at 3516 Lilac Drive.
Moved by Commissioner Peters and seconded by Commissioner
Thorne to recommend to the City Council to approve authori-
zation to issue building permit #4665 to Jim P4errill for a
12'x50' addition to the existing restaurant, including the
exit from the second floor, at 3516 Lilac Drive, subject to
standard procedure.

The findings of fact are: The variances for the narking
reauirements are too great; granting the variances and
subsequently building permit will intensify the use of
the site.

Moved by Commissioner Peters and seconded by Commissioner mhorne
to recommend to the City Council to grant tentative approval
of proposed plat Fairview Acres 4th Addition which is a replat
of Lot 11, Fairview Acres 2nd Unit.

7. Chairman Eisen declared that nominations were open for
officers to the Planning Commission consisting of Chairman,
Vice -Chairman and Secretary for the year ending December 31,
1983.
Moved by Commissioner Magnuson and seconded by Commissioner
Melich to nominate the existing slate of officers for the
year ending December 31, 1983 - Eisen, Chairman; Peters,
Vice -Chairman; and Thorne, Secretary.
Moved by Commissioner Magnuson and seconded by Commissioner
Melich that nominations be closed and that the Secretary be
instructed to cast a white ballot for Eisen, Chairman;
Peters, Vice -Chairman; and Thorne, Secretary, for the year
ending December 31, 1983.
Motion carried.
R. Three members of the Planning Commission were designated to
membership on the Long Range Planning Commission - Frank
Peters, Michael Mooney and Francis Feyereisen.

Magnuson that pursuant to Section 515.55 of the Crystal
City Code, to recommend to the City Council to vary or
modify the strict application of Section 515.13, Subd. 2 b)1),
to allow drive -up facilities to encroach 7' in the required
22' front yard setback (Kentucky Ave.) at the mini -bank
located at 7000 Bass Lake Road, Lot 1, Block 1, Crystal
State Bank Addition, as requested in Variance Application
#83-1 of Crystal State Bank.
The findings of fact are: The bank owns the property;
would not create any problems because it is not residential
area and conforms to the area proper.

4. Sol Fisher appeared regarding a building permit for an
addition to the existing restaurant at 5518 Lakeland Ave.
North.
Moved by Commissioner Magnuson and seconded by Commissioner
Herron to recommend to the City Council to approve authori-
zation to issue building permit #4677 to Fisher Enterprises,
Inc., for a 16'x16' addition to the existing restaurant at
5518 Lakeland Ave. North, subject to standard procedure.

5. Justin F. Anderson appeared regarding Variance Application
#83-2 for a fireplace which will encroach in the required.
5' side yard setback at 6920 46th Ave. North.
Moved by Commissioner Thorne and seconded by Commissioner
Leppa that pursuant to Section 515.55 of the Crystal City
Code, to recommend to the City Council to vary or modify the
strict application of Section 515.13, Subd. 3 a)1), to grant
a variance of 2' in the required 5' side yard setback to
allow a fireplace to be constructed at 6920 46th Ave. North,
as requested in Application #83-2 of Justin F. Anderson.
The findings of fact are: This is a desirable improvement
to house; is not a detriment to abutting property on the
west.
By roll call and voting aye: Herron, Leppa, Melich, Peters
and Thorne; voting no: Magnuson.

6. Consideration of a building permit for an airplane hangar
at the Crystal Airport as submitted by Ralph Nadeau.
Moved by Commissioner -Magnuson and seconded by Commissioner
Peters to recommend to the City Council to approve authori-
zation to issue building permit #4681 to Ralph Nadeau for a
401x70' airplane hangar on leased Lot 76-C, Crystal Airport,
subject to standard procedure.

Peters to recommend to the City Council to approve authori-

40'x70' airplane hangar on leased Lot 76-D, Crystal Airn_ort,
subject to standard procedure.

8. Charles Russell appeared regarding Application #83-3 for a
conditional use permit for an oil and lubrication service
for autos and trucks in a B-3 district at 5273 West Broadway.
Moved by Commissioner Magnuson and seconded by Commissioner
Melich to set a public hearing before the Planning Commission
at 7:30 p.m., or as soon thereafter as the matter may be heard,
March 14, 1983, to consider the request of Charles Russell
for a conditional use permit for an oil and lubrication service
in a B-3 district (Section 515.35, Subd. 4 c) at 5273 West
Broadway, Lot 1, Block 1, Phillips Petroleum Addition.

7:30 p.m. Gwen Besnett was sworn in as a member of the Planning
Commission. The following were present: Besnett, Elsen, Feyereisen,
Herron, Magnuson, Melich, Mooney, Peters and Thorne; the following
were absent: Leppa; also present were Building Inspector Peterson,
City Engineer Sherburne and Recording Secretary Borrell.
Moved by Commissioner Thorne and seconded by Commissioner Magnuson
to approve the minutes of the February 14, 1983 meeting.

mission for 7:30 p.m., or as soon thereafter as the matter
may be heard, April 11, 1983, to consider the request of
James Dunlop of CDP Enterprises, Inc., for a conditional
use permit to allow a convenience food establishment in a
B-4 district, Lot 1, Block 1, Bouchard's Addition, 6023 42nd
Ave. North.

S. Consideration of final approval of proposed plat Nevada Court,
as submitted by Village Builders, Inc., located at Nevada Ave.
& Valley Place. Ed Kauffmann was present.
Moved by Commissioner Thorne and seconded by Commissioner
Herron to recommend to the City Council to grant final approval
of proposed plat Nevada Court, which is a rep_lat of Lots 1 thru 8,
Block 1, Morningside Estates 6th Addition.

t Consideration of Application #83-8 requesting a variance of
the requirements to plat property within the City of Crystal
at 5008 50th Ave. North. This division took place some time
prior to 1951. A building permit was issued in December
1950, and the metes and bounds description has been used ever
since. Approval of this variance would clear a title defect.
Moved by Commissioner Peters and seconded by Commissioner
Thorne that pursuant to Section 515.55 of the Crystal City
Code to recommend. to the City Council to vary or modify the
strict application of Section 505.09, to approve the division
and conveyance of the East 1/2 of the South 1/2 of the East
138.94 feet of the West 208.34 feet of Lot 9, Schaefer's
Lakeside Grove, as set forth in Application #83-8 of Wallace
L. Goulet.
The findings of fact are: In view of the circumstances and
the time delay in this situation, this should be granted.

The regular meeting of the Crystal Planning Commission convened at
7:30 p.m. with the following present: Besnett, Elsen, Feyereisen,
Herron, Leppa, Magnuson, Melich, Mooney, Peters and Thorne; also
present were Building Inspector Peterson, City Engineer Sherburne
and Recording Secretary Borrell.
Moved by Commissioner. Thorne and seconded by Commissioner Feyereisen
to approve the minutes of the March 14, 1983 meeting.
Motion carried.
1. Chairman Elsen declared this was the time and the place as
advertised for a public hearing to consider Application #83-5,
as submitted by Crystal. HRA, to rezone from B-4 district (com-
munity commercial) to R-4 district (high density residential)
property located at 5428-5440 Douglas Drive. John T. Irving,
Executive Director of Crystal HRA, requested rezoning in order
to accommodate low and moderate income housing on the site.

Moved by Commissioner Feyereisen and seconded by Commissioner
Peters to recommend to the City Council to approve Application
#83-5, as submitted by Crystal HRA, to rezone from B-4 district
(community commercial) to R-4 district (high density residential)
that part of Lot 35, Auditor's Subdivision #328 lying east of
the west line of Section 4, Township 118, Range 21, 5428-5440
Douglas Drive.
The findings of fact are: Viable project and good prospects
for success.

advertised for a public hearing to consider.Application 483-6,
as submitted by C,NI7stal HRA, to rezone from R-4 district (com-
munity commercial) to R -O district (residential. -office) property
located at 5459 Douglas Drive. John T. Irving, Executive Director
of Crystal HRA, requested rezoning in order to accommodate senior
citizen housing on the site.
Moved by Commiss-loner Mooney and seconded by Commissioner Besnett
to recommend to the City Council to approve Application #83-6, as
submitted by Crystal HRA, to rezone from B-4 district (community
commercial) to R-0 district (residential -office) Lot 3, Block 1,
First Federal Ron Dopp 2nd Addition, 5459 Douglas Drive.
The findings of fact are: This would be a worthwhile improvement
to the City of Crystal.

as submitted by James Dunlop of CDP Enterprises, Inc., for a
conditional use permit to allow a convenience food establish-
ment in a B-4 district (Section 515.37, Subd. 4 i) at 6023 -42nd
Ave. North. Mr. Dunlop explained their plans for selling unbaked
fresh pizzas on the site.
Moved by Commissioner Peters and seconded by Commissioner
Thorne to recommend to the City Council to approve Application
#83-7, as submitted by James Dunlop of CDP Enterprises, Inc.,
for a conditional use permit to allow a convenience food
establishment in a B-4 district at 6023 42nd Ave. North, Lot 1,
Block 1, Bouchard's Addition.
The findings of fact are: Compatible use of the existing
property.

4. Consideration of tentative approval of proposed plat Crystal
Highlands 2nd Addition located at 7021 & 7011 Markwood Drive.
Moved by Commissioner Thorne and seconded by Commissioner Melich
to recommend to the City Council to grant tentative approval of
proposed plat Crystal Highlands 2nd Addition, as submitted by
Betty Kuettner and Marlys Adams, which is a replat of Lots
15 & 16, Block 7, Crystal Highlands Addition.

5. Charles Russell appeared regarding a building permit for
remodeling and alterations to the existing building at
5273 West Broadway.
Moved by Commissioner Magnuson and seconded by Commissioner
Feyereisen to recommend to the City Council to approve authori-
zation to issue building permit #4735 to Charles Russell for
remodeling and alterations to the existing building at 5273
West Broadway, Lot 1, Block 1, Phillips Petroleum Addition,
subject to standard procedure.

6. Paul Heins appeared regarding Variance Applications 483-9 &
#83-10 to allow a variance in the minimum lot area and rear
yard setback requirements at 5917 46th Ave. North.
Moved by Commissioner Magnuson and seconded by Commissioner
Besnett that pursuant to Section 515.55 of the Crystal City
Code, to recommend to the City Council to vary or modify the
strict application of Section 515.15, Subd. 2 d), to grant a
variance of 563 sq. ft. in lot area; and Section 515.13, Subd.
4 a), to grant a variance of 2.5' in the required 40' rear yard
setback, to allow an 11'x18' addition to the existing house
to be constructed at 5917 46th Ave. North, Lot 1, Block 1,
Wagner Garden Tracts, as requested in Applications 483-9 &
#83-10 of Elaine Pregent, owner.

Moved by Commissioner Peters and seconded by Commissioner
Besnett that pursuant to Section 515.55 of the Crystal City
Code to .recommend to the City Council to vary or modify the
strict application of Section 515.05, Subd. 2, to expand a
non. -conforming use; and. Section 515.13, Subd. 3 a), to grant a
variance cf_ 2'6" in the required 5' side: yard setback, to permit
an 181x29' attached garage to be constructed at 5011 Vera Cruz
Ave. North, Lot 4, Kirkwood's First Addition to Crystal Village,
as requested in Applications #83-12 & #83-13 of Michael_ Tanner.
The findings of fact are: The building was constructed with �
24" side yard setback; plenty of area in front.

8. Thomas VanHousen appeared regarding tentative approval of
