1981 PC Meeting MinutesJANUARY 12, 1981 The regular meeting of the Crystal Planning Commission convened at 7:30 p.m. with the following members present: Elsen, Magnuson, Melich, Neubarth, Nystrom, Peters and Ryan; the following were absent: Feyereisen and Schmidt; also present were Building Inspector Peterson; City Engineer Sherburne; and Recording Secretary Borrell. - Moved by Commissioner Peters and seconded by Commissioner Magnuson to approve the minutes of the December 8, 1980 meeting. Motion carried. 1. Byron McCullagh appeared regarding tentative approval of proposed plat Beelen Addition located at 3836 and 3838 Douglas Drive. Mr. McCullagh requested to table consideration of this request at the November 10th meeting until the January 12th meeting. Moved by Commissioner Peters and seconded by Commissioner Neubarth to recommend to the City Council to grant tentative apProval sof proposed plat Seelen Addition which is the North 140' of the west 1,/2 of the North 3/'4 of the West 1/2 of the SA of the SWh of Section 16, Township 118, Ranee 21, subject to street easements over the West 33' and East 30' thereof. Motion carried. 2. Richard Zejdlik appeared regarding Variance Application 80-86 for a greenhouse to be added to the existing dwelling which will encroach in the 30' front yard setback at 3932 Edgewood Ave. N. This request was tabled for further study at the December 10th meeting to enable the applicant to appear and explain his plans. Moved by Commissioner Peters and seconded by Commissioner Melich that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.13, Subd. 2 a) to allow a 6110"x16'3" greenhouse to he added to the existing dwelling which will encroach 3' in the required 301 front yard setback at 3932 Edgewood Ave. N., T-ot 12, Block 1, Gaulke's 4th Addition, as requested in Variance Application #80-86 of Richard Zejdlik. The findings of fact are: constitute an improvement; in keeping with neighborhood; similar in nature to entry. Motion carried. 3. Consideration of Variance Application #80-87 as submitted by Gary J. Bates for a detached garage which will encroach upon the front half of lot at 5221 Scott: Ave. N. Bates. "1'he findings of fact are: Would allow him to build a c3uragi without a long driveway; north side of property is open because of Soo Line Railroad right-of-way. Motion carried. 4, Rochelle Kroohn appeared regarding Variance Application #80-88 to expand a non -conforming use, said non -conformity being created because of the zoning (property being used as a double bungalow in a B-4 commercial district) at 5027-5029 West Broadway. Moved by Commissioner Magnuson and seconded by Commissioner Peters that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.05, Subd. 2, to allow the expansion of a non -conforming use to permit a 10'x23' existing porch to be enclosed at 5027-5029 Gest Broadway, Plat #54109, Parcel #6524, as requested in Variance Application #80-88 of Rochelle Kroohn. The findings of fact are: an improvement and upgrading of property. Motion carried. 5. Dick Krier of Westwood Planning & Engineering Co. appeared regarding final approval of proposed plat Villages in Crystal located north of Soo Line Railroad between Quail & Vera Cruz Ave. Moved by Commissioner Neubarth and seconded by Commissioner Nystrom to recommend to the City Council to grant final approval of proposed plat Villages in Crystal which is unplatted property located north of Soo Line Railroad between Quail & Vera Cruz Ave., Plat #54109, Parcel #321. Consideration of proposed plat Trinity Covenant Church located at 3733 Vera Cruz Ave. North. Moved by Commissioner Neubarth and seconded by Commissioner Feyereisen to recommend to the City Council to grant tentative approval of proposed plat Trinity Covenant Church which is a replat of Lots 1, 2, 18, 19 & 20, Block 2, L. B. Berglund's Addition and adjoining vacated alley, 3733 Vera Cruz Ave. North. Motion carried. 2. Bruce Hubbard of Minnesota Mini Storage appeared regarding Application #8I-1 to rezone: from B--4 District (community commercial) to I-1 District (warehousing and light industrial) property located at 5440 Douglas Drive. Moved by Commissioner Feyereisen and seconded by Commissioner Peters to set a public hearing before the Planning Commission at 7:30 p.m., or as soon thereafter as the matter may be heard, March 9, 1981, to consider the request of Minnesota 14ini Storage in Application #81-1 to rezone from B-4 .District (community commercial) to I-1 District (warehousing and light industrial) that part of Lot 35, Auditor's Subdivision No. 128 lying East of the West line of Section 4, Township 118, Range 21, 5440 Douglas Drive. Angela Kusunoki appeared regarding a building permit for remodeling the interior of the existing building (Hennepin County Rockford Road Library) at 6401 42nd Ave. North Moved by Commissioner Peters and seconded by Commissioner Magnuson to recommend to the City Council to approve author .- zation to issue building permit #3002 to Knutson Construction Co. for remodeling the interior of the existing building at 6401 42nd Ave. North, Plat #54310, Parcel #4717, subject to standard procedure. Motion carried. February 9, 1981 - continued 4. Don Slough appeared regarding Variance Application #81-2 submitted by Conservation Systems Inc. to allow a vestibule entrance to encroach in the front yard setback at 5241 West Broadway. Moved by Commissioner Schmidt and seconded by Commissioner Peters that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.13, Subd. 2 b), to grant a variance of. 5' in the required 22' front yard setback, for a 9'9"x6'6" vestibule entrance at 5241 West Broadway, Plat 054109, Parcel #2.115, as requested in Application #81--2 of Conservation Systems, Inc. Moved by Commissioner Feyer isen and seconded by Commissioner Nystrom to set a public h8aring before the Planning Commission at 7:30 p.m., or as soon thereafter as the matter may be heard, March 9, 1981, to consider Application #81-3 of Crystal Shopping Center Associates for a conditional use permit to allow enclosed indoor storage as ars accessory use in a B-4 District (Section 515.37, Su.bd. 4 q), at 123A Willow Bead., Lot 1, Block 1, Crystal Shopping Center Addition. Bruce Hubbard of Minnesota Mini Storage appeared regarding a variance to the Interim Zoning Ordinance at 5440 Douglas Drive. The following persons were present and asked questions regarding the moratorium: Stan Zieska, 5518 Douglas Drive; Arne Estabrooks, representinq Phelps Drake Co., Don Rowe, Independent Business Machines; Lois Degendorfer, 6309 Brentwood Ave. Moved by Commissioner Mooney and seconded by Commissioner Neubarth that pursuant to Section 515.55 of the Crystal City Code, to recommend to the City Council to waive the moratorium of the Interim Zoning Ordinance, and consider rezoning of property from B-4 to I-1 at 5440 Douglas Drive, as requested in Variance Application #81-5 of Minnesota Mini Storage. The findings of fact are: It is unclear to Planning Commission members what the intent of the moratorium is at the present time; question whether public funds for acquisition will be available when moratorium is over. Moved by Commissioner Mconey and seconded by Commissioner Neubarth to recommend to the City Council to approve Application #81-1 as submitted by Minnesota Mini Storage to rezone from B-4 District. (community comi_icicial) to I-1 District (warehoi_ising and light industrial) that part of Lot 35, Auditor's Subdivision No. 328 lying East of the West line of Section 4, Township 118, Range 21, 5440 Douglas Drive. The findings of fact are: good development for area; should be an asset for redevelopment for entire area. Motion carried. March 9, 1981 - continued 3. Chairman Elsen declared this was the time and the place as adver- tised for a public hearing to consider Application #81-3 as sub- mitted by Crystal Shopping Center Associates for a conditional use permit to allow enclosed indoor storage as an accessory use in a B-4 District at 123A Willow Bend (former Red Owl :basement). The following persons were present: Doug Sinclair representing Crystal Shopping Center Associates; Stan Zieska, 5518 Douglas Drive. Moved by Commissioner Magnuson and seconded by Commissioner Nystrom to recommend to the City Council to approve Application #81-3 as submitted by Crystal Shopping Center Associates for a conditional use permit to allow enclosed indoor storage as an accessory use in a B-4 District (Section 515.37, Subd. 4 g), at 123A Willow Bend, Lot 1, Block 1, Crystal Shopping Center Addition. The findings of fact are: It is a good use for storage and no apparent problem will be created. Motion carried 4. Gary Meyer of McDonald's Corporation appeared regarding a variance to the Interim Zoning Ordinance at 5400 West Broadway. Moved by Commissioner Neubarth and seconded by Commissioner Magnuson that pursuant to Section 515.55 of the Crystal City Code, to recommend to the City Council to waive the moratorium of the Interim Zoning Ordinance, and consider a building permit to construct two vestibules at 5400 West Broadway, as requested in Variance Application #81-4 of McDonald's Corporation. The findings of fact are: improvement for energy saving; more comfortable for their customers and employees. Motion carried. 5. Gary Meyer of McDonald's Corporation appeared regarding a building permit to construct two vestibules at 5400 West Broadway. Moved by Commissioner Neubarth and seconded by Commissioner Magnuson to recommend to the City Council to approve authorization to issue building permit #3209 to Elview Construction Co. for the construction of two vestibules at 5400 West Broadway, Lot 1, Block 1, McDonald's 2nd Addition, subject to standard procedure. Motion carried. 6. Consideration of tentative approval of proposed plat Harold Herman Addition located at the southwest quadrant of 36th Ave. & Douglas Drive. Moved by Commissioner Nystrom and seconded by Commissioner Magnuson to recommend to the City Council to grant tentative approval of Harold Herman Addition which is a replat of Lots 1 thru 6, Block 1, Gardendale Acres. Motion carried. ff March 9, 1981 - continued 7. Wayne & Lois Degendorfer appeared regarding a variance to the Interim Zoning Ordinance at 6309 Brentwood Ave. North. Moved by Commissioner Magnuson and seconded by Commissioner Nystrom that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to waive the moratorium of the Interim Zoning Ordinance, and consider a building permit for the installation of a fireplace at 6309 Brentwood Ave. North, as requested in Variance Application #81-6 of Wayne Degendorfer. The findings of fact are: It is an improvement to their home; the moratorium is the only reason they are here asking for the variance. Motion carried. 8. Consideration of final approval of proposed plat Beelen Addition located at 3836 & 3838 Douglas Drive. Moved by Commissioner Nystrom and seconded by Commissioner Neubarth to recommend to the City Council to grant final approval of proposed plat Beelen Addition which is the North 140' of the West 1/2 of the North 3/4 of the West 1/2 of the SW4 of the SW4 of Section 16, Township 118, Range 21, subject to street easements over the West 33' and the East 30' thereof. Motion carried. 9. George Timmerman of Modern Tool Inc. appeared regarding tentative approval of proposed plat Woolstons 10th Addition located at 52nd & Hanson Court. Moved by Commissioner Nystrom and seconded by Commissioner Neubarth to recommend to the City Council to grant tentative approval of proposed plat Woolstons 10th Addition which is a replat of Lot 2, Block 1, Carlson Strom Addition and Lot 1, Block 1, Woolston's 9th Addition. Motion carried. 10. George Timmerman of Modern Tool Inc. appeared regarding Application #81-7 for a variance in the required number of parking stalls at 5217 Hanson Court. The required number is 132; the available parking on the site is 121 stalls. Moved by Commissioner Magnuson and seconded Commissioner Nystrom that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict appli- cation of Section 515.09, Subd. 8 aa), to grant a variance of 11 parking stalls at 5217 Hanson Court, proposed Lot 1, Block 1, Woolston's 10th Addition. The findings of fact are: The 11 parking stalls that they are short will probably not be any problem for the building; there is on -street parking; they do have adequate number of stalls for present employees; they do have a split shift. Moved by Commissioner Neubarth and seconded by Commissioner Magnuson to recommend to the City Council to approve authorization to issue building permit #3226 to Benson -Orth Assoc., Inc. for a 301x72' addition to the existing building at 5217 Hanson Court, proposed Lot 1, Block 1, Woolstons 10th Addition, subject to standard procedure. Motion carried. 12. John Duffy appeared regarding Application #81-8 to vary the requirements of the distance of the driveway from street inter- section (minimum of 50') at 7301 32nd Ave. North. Moved by Commissioner Neubarth and seconded by Commissioner Nystrom that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.09, Subd. 4 h)4), to grant a variance of 35' in the requirement to locate a driveway 50' from the lot corner at a street intersection at 7301 32nd Ave. North, Lot 6, Robbins - dale Gardens, except the Wly 105' thereof, as requested in Appli- cation #81-8 of R. Johnson Construction & Development Inc. The findings of fact are: This is a harmless request; it would give owner a better exit from property with semi trucks. Motion carried. 11_�. Allen Evenson appeared regarding Application #81-9 for a variance to expand a non -conforming use, said non -conformity being the exist- ing house encroaches approximately 12' in the required 17.26' side street side yard setback at 6101 47th Ave. North. Moved by Commissioner Magnuson and seconded by Commissioner Melich that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.05, Subd. 2, to allow the expansion of a non -conforming use to permit a 24'x28' detached garage to be constructed at 6101 47th Ave. North, Lot 1, Brunswick Addition, as requested in Application #81-9 of Allen Evenson. Moved by Commissioner Mooney and seconded by Commissioner Nystrom that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.05, Subd. 2, to allow the expansion of a non -conforming use to permit a 12'x18' deck to be constructed at 3148 Utah Ave. North, Lot 1, Block 3, West Winnetka Terrace, as requested in Application #81-10 of Howard Olson. The findings of fact are: Non -conformity existed prior and the City has not suffered. Motion carried. 16. Harry C. Ervin appeared regarding a building permit for an airplane hangar on leased Lot 80-A, Crystal Airport. Moved by Commissioner Melich and seconded by Commissioner Mooney to recommend to the City Council to approve authorization to issue building permit #3230 to Lyman Lumber Co. for a 401x176' airplane hangar on leased Lot 80-A, Crystal Airport, subject to standard procedure. Motion carried. .,. Phil Johnson, Architect, and Donald W. Rowe of Independent Business Machines appeared regarding a variance to the Interim Zoning Ordinance at 5353 West Broadway. Moved by Commissioner Nystrom and seconded by Commissioner Magnuson that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to waive the moratorium of the Interim Zoning Ordinance, and consider a building permit for a retail office building at 5353 West Broadway, as requested in Variance Application #81-11 of Independent Business Machines. The findings of fact are: The improvement is beyond the limits of the immediate study area; the improvement will upgrade the area. Motion carried. Ifl. Phil Johnson, Architect, and Donald W. Rowe of Independent Business Machines appeared regarding a building permit for a retail office building at 5353 West Broadway. Moved by Commissioner Nystrom and seconded by Commissioner Melich to recommend to the City Council to approve authorization to issue building permit #3229 to Independent Business Machines for the construction of a 401x38' retail office building at 5353 West Broadway, Lot 7 and part of Lot 1, Becker's Addition, subject to standard procedure. Consideration of final approval of proposed plat Pugh Addition located at 6504 46th Ave. North Moved by Commissioner Neubarth and seconded by Commissioner Nystrom to recommend to the City Council to grant final approval of proposed plat Pugh Addition which is a replat of Lot 9, Klatke's Addition. Motion carried. 20. Paul Trimbo appeared regarding Variance Applications #81-13 & #81-14 to expand a non -conforming use, said non -conformity being the existing house and garage encroach 5' into the required 25' side street side yard setback, to allow the construction of an addition to the existing dwelling which will encroach approximately 6' into the required 25' side street side yard setback at 5000 54th Ave. North. Moved by Commissioner Mooney and seconded by Commissioner Neubarth that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.05, Subd. 2, to allow the expansion of a non -conforming use, and Section 515.13, Subd. 3 a)ii), to grant a variance of approximately 6' in the required 25' side street side yard setback to allow the construction of a 7'x142' addition to the existing dwelling at 5000 54th Ave. North, Lot 1, Block 4, Hiawatha Manor, as requested in Variance Applications #81-13 & #81-14 of Paul Trimbo. The findings of fact are: Because of 1976 change in the applicable ordinance, the current structure is not in conformance; this addition will only increase it by l' or less. Motion carried. :',.I.. Johnson appeared regarding Variance Application #81-15 to expand a non -conforming use, said non -conformity being the existing dwelling encroaches 9.3' into the required 30' side street side yard setback, at 2701 Kentucky Ave. North. Moved by Commissioner Feyereisen and seconded by Commissioner Mooney that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.05, Subd. 2, to allow the expansion of a non -conforming use to permit an 18'x14' deck to be constructed at 2701 Kentucky Ave. North, Lot 2, Block 1, Lane's Addition, as requested in Application #81-15 of Lawrence W. Johnson. The findings of fact are: The expansion is away from the non- conformity; it is a harmless expansion of the non -conforming use. Motion carried. 3. Craig Lemma appeared regarding Variance Application #81-16 to expand a non -conforming use, said non -conformity being the existing detached garage encroaches 2.67' in the required 25' side street side yard setback at 5800 Oregon Ave. North. Moved by Commissioner Feyereisen and seconded by Commissioner Magnuson that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.05, Subd. 2, to allow the expansion of a non -conforming use to permit a 81x9' addition to the dwelling at 5800 Oregon Ave. North, Lot 9, Block 4, Murray Lane Addition, as requested in Application #81-16 of Craig Lemma. Moved by Commissioner Ryan and seconded by Commissioner Peters that pursuant to Section 515.55 of the Crystal City Code to recommend to the City Council to vary or modify the strict application of Section 515.15, Subd. 2 a), to grant a variance of 20' in the required lot width, to build a single family dwelling at 4245 Vera Cruz Ave. North, Lot 6, Block 6, Robbinsdale Gardens 2nd Addition, as requested in Application #81-17 of William Staye. The findings of fact are: it is an improvement to the housing conditions that exist at present; brings house into -alignment with other houses in the block; raise property taxes so the City will benefit. Motion carried. 5, Roger Evans appeared regarding Variance Application #81-18 to expand a non -conforming use, said non -conformity being the existing carriage house encroaches 4.51± in the required 5' side yard setback at 5603 32nd Ave. North. Chairman Elsen declared that nominations were open for officers to the Planning Commission consisting of Chairman, Vice -Chairman and Secretary for the year ending December 31, 1982. Moved by Commissioner Feyereisen and seconded by Commissioner Mooney to nominate Herman Elsen, Chairman; Frank Peters, Vice - Chairman; and Joe Thorne, Secretary. Moved by Commissioner Feyereisen and seconded by Commissioner Mooney that nominations be closed and that the Secretary be instructed to cast a unanimous ballot for Herman Elsen, Chairman; Frank Peters, Vice -Chairman; and Joe Thorne, Secretary, for the year ending December 31, 1982.
