2.7X JANUARY 9, 1967 The regular meeting of the Planning Commission convened at 7:30 P.M. with the fol- lowing members present: Malmberg, Johnson, Neubarth, Elsen, Pahos, Anderson, Dunn, Peters, Plasencia; the following were absent: Sawicki, Nystrom, Juday, Gilchrist; also present were planning consultants: Sherburne and Schmock. Moved by Commissioner Johnson and seconded by Commissioner Malmberg to approve the minutes of the December 12, 1966 meeting. Motion carried Richard Neslund and James W. Hawkes regarding rezoning application to rezone as per attached plan, Parcel 1 from C-1 to R-1; Parcel 2 from R-1 to C-1 and Parcel 3 from R-1 to R-4, the area lying north of 27th Avenue and approximately north to 30th Avenue extending from Zane to Douglas Drive. Moved by Commissioner Anderson and seconded by Commissioner Peters to hold a public hearing at 8:00 P.M. at 4141 Douglas Drive on February 13, 1967 to consider the rezoning from C-1 to R-1 the following: Starting at the SW corner of the SWk of Sec. 21, T-118, R-21, thence Ely. along S line of SWk of Sec. 21, a distance of 660'+, then Nly along the existing zoning line a distance of 30' to point of beginning, thence, Nly. along zoning line a distance of 400' thence Wly along existing zoning line a distance of 50', thence Sly a distance of 400' parallel to existing zoning line, thence Ely. a distance of 50' to point of beginning. Moved by Commissioner Neubarth and seconded by Commissioner Peters that pursuant to Sec.42.21 of the Zoning Regulations to grant an exception to Sec. 42.09, Use Regu- lations for Commercial C-1 District, to allow a 10'x12' family room addition to exist- ing house in the commercial C-1 District. Motion carried Secretary, Neubarth Chairman, Elsen 225 JANUARY 23, 1967 The regular meeting of the Planning Commission convened at 7:30 P.M. with the fol- lowing members present: Johnson, Nystrom, Neubarth, Eisen, Sawicki, Peters, Dunn, and Linkenheil; the following were absent: Malmberg, Pahns, Anderson, Juday, chi and Plaaencia; ,also present were planning consultants Schmock and Sherburne. Moved by.Xommissioner Sawicki and seconded by Commissioner Peters to approve the minut5 of the January 8, 1967 meeting. Motion carried Moved by Commissioner Peters and seconded by Commissioner Johnson to approve build- ing permit to Lowell Helmer #15684 for a 6' x 4' addition to Vana's Restaurant at 3517 Vera Cruz Avenue North, subject to standard procedure. Motion carried Moved by Commissioner Nystrom and seconded by Commissioner Johnson to table for fur- ther study proposed Cameron Addition, a,replat of Lots 1 and 2, Block 1 Finch Addition, until Mr. Cameron submits a plat showing verification of size of lots. Motion carried Mr. Howard J. Moore of Maloney, Carroll & Olson, representing John C. Hendrickson regarding replat of Lot 1 and park in Block 1, Hendrickson's Addition. At that time the plat of Hendrickson's Addition was prepared an error was made in locating the diagonal boundary line of said Lot 1 on the Easterly side, east of the diagonal line is park area which was dedicated by Mr. Hendrickson to the City. Inasmuch as Mr. Hendrickson's house extends beyond this line it is in effect partially located on the part dedicated to the City as park. The replat is being submitted to change the line of Lot 1 and the park. This error apparently came abort because of the differ- ence in the dimensions of Welcome Avenue on the preliminary specs drawn by the sur- veyor and the dimension of Welcome Avenue drawn on the final plat. Moved by Commissioner Peters and seconded by Commissioner Sawicki to approve replat of Lot 1 and Park, Block 1 in Hendrickson's Addition, subject to standard procedure. Motion carried Moved by Commissioner Sawicki and seconded by Commissioner Dunn to DENY request from J. H. Nelson of Tasty Freez Stores ato grant variance in parking requirements at 3415 Douglas Drive, for this type of operation. Voting yes: Nystrom, Eisen, Sawicki and Dunn; voting no: Johnson, Linkenhiel, Neubarth & Peters. Motion lost because of tie vote. After motion lost because of tie vote a further discussion as to classification of a Tasty Freez store was held. Moved by Commissioner Peters and seconded by Commissioner Johnson to give Mr. J. H. Nelson of Tasty Freez Stores tacit consent to grant a building permit when application is submitted considering this operation as a restaurant requiring 21 parking spaces rather than 57, needed for drive-in type of business. Voting yes: Johnson, Nystrom, Linkenheil, Neubarth, Sawicki, Peters; voting no: Dunn and Eisen. Motion carried William Wolfe, chairman of the building commission, Brunswick Methodist Church re- questing: A. Variance for parking of 22 cars on Super Vaihu parking lot adjacent to church to fulfill total parking requirements. B. To allow the stair tower to project 4' into side street set back requirements at east property line. Reason for request of A. allow for landscaped area. Reason for request of B. provid8s for the required separation of the building from the stair tower exit door, as required by the building code, 14' minimum. JANUARY 23, 1967 Moved by Commissioner Dunn and seconded by Commissioner Peters to grant Brunswick Methodist Church variance in parking. They are required 100 parking spaces. That their 78 parking spaces be supplemented by 22 parking spaces of the Super Valu parking lot, subject to that when Super Valu parking permission is removed that the church would be required to add additional spaces on its own property. Motion carried Moved by Commissioner Nystrom and seconded by Commissioner Peters to grant Brunswick Methodist Church a variance of 4' encroachment on east side yard set back requirements to build stair tower only. Motion carried' Moved by Commissioner Nystrom and seconded by Commissioner Dunn to nominate Com- missioner Elsen as chairman for the year 1967. Motion carried Moved by Commissioner Johnson and seconded by Commissioner Peters that nominations be closed and the secretary be instructed to cast a unanimous ballot for Commis- sioner Elsen as chairman. Motion carried Moved by Commissioner Nystrom and seconded by Commissioner Sawicki to nominate Commissioner Peters as vice-chairman for the year 1967. Motion carried Moved by Commissioner Dunn and seconded by Commissioner Sawicki that the nominations be closed and the secretary cast a unanimous ballot for Commissioner Peters as vice- chairman. Motion carried Moved by Commissioner Johnson and seconded by Commissioner Peters to nominate com- missioner Neubarth as secretary for the year 1967. Motion carried Moved by Commissioner Nystrom and seconded by Commissioner Johnson that nominations be closed and the secretary be instructed to cast a unanimous ballot for Commis- sioner Neubarth as secretary. Motion carried Thomas F. Motion carried Building permit requevt from Pure Oil Company referred back to the Planning Commis- sion by the City Council regarding improvement needs requirements for Pure Oil Station at 3555 Vera Cruz Avenue North, for further study and the clarification of the ration- ale in arriving at their decision. Moved by Commissioner Dunn and seconded by Commissioner Juday to table for fur- ther study the Pure Oil Cocrpany building permit #15717. Voting no: Peters. Motion carried A motion by the City Council and carried by a three to two vote to return to the Plan- ning Commission with instructions to hold a public hearing, the zoning application of Herb Elfstrom to rezone from R-1 to C-1 part of Lot 12, Block 1, Rosedale Acres, except street. Moved by Commissioner Dunn and seconded by Commissioner Peters to hold a public hearing at 7:30 P.M., May 8, 1967 at 4141 Douglas Drive to consider the rezoning from R-1 to C-1 that part of Lot 12, Block 1, Rosedale Acres, lying West of the East 150 feet, except street. Motion carried Howard Grivna of Timesavers, Inc., regarding bu8lding permit for an addition to allow a roof to be placed between two existing buildings and moving the existing wall of the passageway 632 feet to the end of the building and that storage in this area would be on portable racks, as per Timesavers Inc., drawing #33363. Moved by Commissioner Juday and seconded by Commissioner Nystrom to approve building permit to Timesavers, Inc. for an addition by placing a roof between two existing buildings and moving the existing wall of the passageway 632 feet over the sanitary sewer easement, and that storage in this area would be on portable racks, as per Timesavers, Inc., drawing #33363; subject to standard procedure and that a hold harmless agreement be executed to extend over all the sewer easement. Motion carried Moved by Commissioner Juday and seconded by Commissioner Peters to table for further study the request for variance in set back requirements, pursuant to Chapter 42, Zoning Regulations, paragraph 42.21 to grant an exception to paragraph 42.16 (d) 2, Area Regulations for Residential Districts to allow a 16' side yard set back on the street side in lieu of 35', providing the set back to the closest point of the pro- posed dwelling from the front street is 60 feetand in the meantime Mr. Joe Reichert lcw 2 April 10, 1967 (Continued) endeavor to secure plans that would meet the setback requirements. Moved by Commissioner Neubarth and seconded by Commissioner Dunn to approve building permit #15717 to Pure Oil Company for addition and remodeling of gasoline filling station at 3555 Vera Cruz Avenue North, subject to standard procedure. Motion carried Joe Reichert regarding setback variance request tabled at Commission meeting on April 10, 1967, for further study. Moved by Commissioner Linkenheil and seconded by Commissioner Nystrom that pursuant to Chapter 42, Zoning Regulations, Paragraph 42.21 to grant an exception to Paragraph 42.16 (d) 2, Area Regulations for Residential Districts to allow a 16' side yard setback on the street side in lieu of 35', providing the setback to the closest point of the proposed dwelling from the front street is 40 feet. Stanley, Supervisor, Marshall Erdman and Associates, Inc., regarding build- ing permit for remodeling the basement of clinic building at 3501 Douglas Drive for Broadway Suburban Clinic, Inc. Moved by Commissioner Sawicki and seconded by Commissioner Malmberg to approve building permit #15809 to remodel basement of clinic building at 3501 Douglas Drive to Marshall Erdman and Associates, Inc. Motion carried Roy C. Edison, Crystal State Bank, regarding proposed plat of Crystal State Bank addition, part of Lot 26, Auditor's Subdivision No. 226. Moved by Commissioner Juday and seconded by Commissioner Linkenheil to grant tentative approval of the proposed plat of Crystal State Bank addition legally des- cribed as that part of Lot 26, Auditor's Subdivision No. 226, lying south of the north 131.8 feet thereof and west of the west line of Lot 19, Auditor's Subdivision No. 226 extended northerly, except street, and to recommend to Crystal State Bank that they replat all their property into one plat. Motion carried Reuben Lundquist appeared in behalf of Mr. Abe Toles regarding zoning application to rezone from R-1 District - one family dwelling to R-4 District - general multi- ple dwellings, the north 180' of that part of the NE-, of the SW -4 of Sec. 9, Twp. 118, Rge. 21, lying west of the east 200' thereof and east of the railroad right- of-way, except the north 301.
