COUNCIL STAFF REPORT Blue Line Update FROM: John Sutter, Community Development Director DATE: May 5, 2016 TO: Anne Norris, City Manager (for May 12 work session) SUBJECT: Blue Line Update The purpose of this work session is for the Blue Line Project Office (BPO) staff to present an update on their work on specific items and take questions from the Council. The specific items are as follows: a) June Avenue access from 36th Avenue to construction staging area b) Traction power sub -stations and signal bungalows c) Visual screening north of Bass Lake Road d) Noise wall south of Corvallis Avenue e) Vertical circulation buildings for pedestrian bridge over Bottineau Boulevard The attachments represent what was available to city staff for the work session packet deadline. BPO will have a slide show at the work session which may contain updated graphics. a) June Avenue access from 36th Avenue to construction staging area • The project will use Sochacki Park in Robbinsdale as a construction staging area, with access to and from 36th Avenue via June Avenue. f The Crystal/Robbinsdale boundary is the centerline of June Avenue and Crystal is on the west side. • There are 11 houses on the Crystal side of the street. Two of them have driveways on June Avenue and the other nine use an alley. • The project does not anticipate any access restrictions for the Crystal or Robbinsdale homeowners along June Avenue, but there will be heavy construction traffic to and from the staging area. • Due to construction traffic, the project does anticipate having to mill & overlay the bituminous pavement upon project completion at project expense. The street was reconstructed in 2001 (Phase 5) so the mill & overlay will occur when the street is approx. 20 years old. PAGE 1 OF 3 b) Traction power sub -stations and signal bungalows ■ TPSS are 15'x40' metal buildings that house the transformers and other electrical equipment needed to power the trains. The project's electrical load flow study has firmed up the locations where TPSS are needed - 15 total (3 in Crystal.) TPSS locations in Crystal are West Broadway (Steve O's site), Bass Lake Road (south end of the park & ride) and the vacant 60th Avenue ROW between Elmhurst and the BNSF ROW. • Also proposed are signal bungalows which generally look like much smaller versions of a TPSS • The next step is for the project office to meet on-site, one-on-one with the property owners on each side of the 60th Avenue ROW to discuss screening, security, etc. c) Visual screening north of Bass Lake Road ■ It is assumed that BNSF will require a standard -issue 6' chain link fence and that it would be located in the same place as the old chain link BNSF fence, which is approx. 1' into the BNSF ROW. But that fence would be owned and maintained (to whatever extent) by BNSF and could not be relied on for visual screening. + For this reason, the project office is considering installing a parallel fence for visual screening along the homeowners' east lot line. This would be a project expense. i One option would be an 8' tall screening fence similar to what Metro Transit has installed between the 63rd Avenue park & ride and the adjacent single family homes. (This fence was one of the examples cited by the residents in February petition.) But the specific height and materials will need to be discussed with the residents. • Because the screening fence would be on private property, each homeowner would need to grant a no -cost right of entry so Metro Transit can build the fence on private property. • Once the screening fence is installed it would become the property of each of the respective homeowners and maintenance would be their responsibility. * The screening fence would need to go through the Planning Commission public hearing process for a CUP or variance to allow a fence over 6 feet tall. The Council discussed this in its 2/29 resolution and staff does not anticipate any objections. is The next step is for the project office to convene a neighborhood meeting with the Elmhurst & Hampshire homeowners to get their reaction to the proposed fence. BPO is proposing Tuesday 5/24 at the Becker Park building, with an open house from 6-8 and a short presentation and Q&A at 7. City staff will be present and Councilmembers are welcome to attend as well. PAGE 2 OF 3 d) Noise wall south of Corvallis Avenue * The noise wall is now expected to be 10' tall instead of 8'. Please note that the wall height is measured from the top of the LRT rail. This means that the actual wall height may be more or less than 10 feet if the ground elevation at the base of the wall is different from top of rail. • The proposed location is still right along the east edge of the BNSF ROW. • Specific materials/finishes are not yet determined; that would occur during preparation of the detailed engineering (60%) plans in 2017. The next step is for the project office to meet on-site, one-on-one with each adjacent property owner (there are 7 houses, 1 duplex and 1 apartment building). * (Related, non -Crystal issue) The 45'/2 Avenue crossing and intersection with West Broadway will be shifted approximately 80' north to align with 45th Avenue by the Osterhus bible store. Left turns from eastbound 45'/2 to northbound West Broadway would be prohibited to ensure that cars can clear the crossing when a train comes. Some residents in the east end of the Welcome Park neighborhood may be using the 45'/2 crossing and turning left on West Broadway to get to 47th and its signal at CR81. This change would require them to turn right and go south a bit on West Broadway then backtrack up Lakeland to get to the 47th-CR81 signal. e) Vertical circulation buildings for pedestrian bridge over Bottineau Boulevard BPO thinks the bridge can span CR81 without needing a center pier in the median, which would create a cleaner look and reduce visual obstruction. • The vertical circulation buildings at each end of the bridge would be in the same locations as shown before. • Each building would have a glass elevator tower which would be semi - climate -controlled only to the extent necessary for the elevator equipment. • The rest of each building, such as the staircase and landings, would be roofed and the sides would have see-through metal mesh instead of glass. The mesh was used at the UofM West Bank station on the Green Line and Metro Transit Operations found it to be more robust less maintenance - intensive than glass which was used on the Northstar Corridor. The mesh lets air flow through while preventing rain/snow from entering. • The next step is to firm up the cost estimate for the Corridor Management Committee to consider recommending adding it to the project scope & budget in June. Putpose. Intended to ensure the public's business is conducted in the public (i.e., at public meeting preceded by notice). Interpreted broadly to achieve the purpose of allowing the residents to stay informed and participate in the process. Not adopted for the convenience of elected official or to promote efficiency in conducting public business. ? Application. The OML law applies when a quorum or more of the city council (commission or board) gather to discuss, decide, or receive information regarding the council's business. a. Quorum or more — 4 or more councilmembers. b. Gather — in person, by electronic means, serial meetings (domino or hub & spoke). c. Discuss, decide or receive information — broad and does not depend on a decision being made. d. Council's business — Any city business within the scope of the council's authority. .3. Exceptions. The general requirements of the OML do not apply in the following situations: a. When any one of the four elements identified above are missing i. Discussions between less than a quorum, social gatherings, non -city business b. Social media -- use by council members is not a violation "so long as the social media use is limited to exchanges with all members of the general public." E-mail is not social media. c. Closed Meetings i. Must Close — allegations or charges ii. May Close — Employee review; attorney-client iii. Procedure to close — identify authority as part of motion to close, record unless an attorney-client meeting, retain the recording for three years, provide summary of meeting if a review 4, Potential Issues. a. Social gatherings turning into meetings b. E-mails exchanges and serial meetings c. Attending meetings of other bodies d. Pre or post meeting discussions `+. Penalties. a. Personal liability — civil fine of up to $300 for a single occurrence i. Cannot be paid by the City or its insurer b. Intentional violation in three or more actions brought under the OML, the official forfeits office and cannot serve in any capacity with the body for a period equal to the term of the office c. Court may award up to $13,000 in costs, disbursements, and attorney fees i. Defendant eligible only if action was frivolous and without merit d. No penalties or attorney fees award against the official unless the court finds there was "an intent to violate" the OML Data Practices Act 1. PuI42ose. The Minnesota Government Data Practices Act ("Act") "regulates the collection, creation, storage, maintenance, dissemination, and access to government data in government entities. It establishes a presumption that government data are public and are accessible by the public for both inspection and copying unless there is federal law, a state statute, or a temporary classification of data that provides that certain data are not public." Data Classifications. The Act establishes classifications of data: a. Public — accessible to anyone. b. Not Public i. Private/non-public — accessible to the person who is the subject of the data and to the governmental entity. ii. Confidential/protected non-public — accessible only to the governmental entity. General Requirements. a. The City must allow a person to see and make copies of data when the law gives the person the right to such access; b. The City must not allow unauthorized persons to have access to data that is not public; and ce The City must appoint a Responsible Authority to ensure that the requirements of the Act are satisfied. 4. Scope. The Act has a broad scope in that it includes governmental data regardless of the device it is on or its location (home, office). Includes government data on cell phones, home computers, telephone log book kept at home, etc. 5. Penalties. Any person who willfully violates the Act, or whose conduct constitutes a knowing unauthorized acquisition of not public data, is guilty of a misdemeanor. An employee who willfully violates can be suspended without pay or dismissed. Litigation Holds Threat of litigation a. Need to avoid speaking about the issue to the parties making the threat b. Best to avoid speaking of the issue in public to the extent possible c. Retain all data related to the matter! d. Series penalties can be imposed by a court if the judge believes data was destroyed when the possibility of litigation was apparent. 2. Actual litigation — No communications with the plaintiff or the public about the case a. A wide range of data may be subpoenaed as part of litigation Gift Law 1. Pu ose. Uphold the integrity of public institutions and ensure objective decision making. ?, Prohibition. "An interested person may not give a gift or request another to give a gift to a local official. A local official may not accept a gift from an interested person." a. Interested person — a "person or a representative of a person or association that has a direct financial interest in a decision that a local official is authorized to make." 15, Gift — "means money, real or personal property, a service, a loan, a forbearance or forgiveness of indebtedness, or a promise of future employment, that is given and received without the giver receiving consideration of equal or greater value in return."
