I. CALL TO ORDER, ROLL CALL, AND PLEDGE OF ALLEGIANCE
II. COUNCIL MEETING MINUTES
The Council will consider the minutes from the following meetings in a single motion:
a. The Regular City Council Meeting from August 1, 2011; and
b. The Council Work Session from August 1, 2011.
III. CONSENT AGENDA
The Council will consider the following items, which are routine and non-controversial
in nature, in a single motion:
1. Approval of the list of license applications submitted by the City Clerk to the City
Council, a list that is on file in the office of the City Clerk; and
2. Approval of disbursements over $25,000 submitted by the Finance Director to the
City Council, a list that is on file in the office of the Finance Director.
3. Approval of a special permit for wine and beer at Bassett Creek Park on Saturday,
September 17, 2011, submitted by Laura Johnson;
IV. PUBLIC HEARING
1. Mayor Bowman will open a public hearing to receive public comment and Council
consideration of a resolution ordering the abatement of conditions creating a
nuisance and hazardous property at 3817 Brunswick Avenue North.
Staff has been working with the owner of 3817 Brunswick Avenue on health
and hazard issues since July 2010. The property was posted as unfit for
habitation in August of 2010. Staff has made repeated efforts to notify the
property owner about work required to correct the situation. Some work was
completed on the exterior of the residence but very little, if any, work has
been done on the interior. Due to the conditions in the residence,
recommend approval of the resolution declaring the property at 3817
Brunswick to be hazardous as defined by Minnesota Statutes, Section 463.15.

V. OPEN FORUM
(Open forum is a time for individuals in the audience to address the Council on
subjects not on the regular Council agenda. Individuals are asked to step up to the
podium and speak clearly into the microphone. You are allowed 3 minutes to make
your comments. The Council will not take action on items discussed during open
forum; however, the Council may add the item to a future meeting agenda and ask city
staff for follow-up.)
VI. REGULAR AGENDA
1. The Council will consider a resolution ordering the preparation of an Assessment
Roll, declaring the amount to be assessed, and setting the date for a public hearing
for Year 2011 Delinquent Accounts.
Each year the city levies special assessments for services received but not
paid for including utility charges, administrative citations, abatement of
public nuisances, tree trimmings, etc. Recommend approval of the resolution
setting the hearing for October 18.
2. The Council will consider a variance to reduce the south setback requirement for
property located at 5009 Quail Avenue North.
The existing home at 5009 was constructed in 1952, before the current
setback requirements were in effect and the house encroaches in the south
yard setback. This encroachment makes the house a non-conforming
structure. The homeowner wants to construct an addition which would
expand the non-conformity. In order to proceed with the addition, a variance
to the south yard setback is needed. At its August 8 meeting, the Planning
Commission held a public hearing and unanimously recommended approval
of the variance at 5009 Quail.
3. The Council will consider a conditional use permit for an indoor recreation facility at
7300 32 nd Avenue North.
The property is zoned I-1, Light Industrial. The applicant is proposing to
lease a portion of the building for an indoor beach volleyball facility.
Recreational uses in this zoning district require a conditional use permit. The
Planning Commission held a public hearing on this application on August 8
and unanimously recommended approval of the conditional use permit with
the conditions outlined in the staff report.
4. The Council will consider a conditional use permit to expand the drive-through at
5400 West Broadway (McDonald’s).
The McDonald’s at 5400 West Broadway is proposing a full remodel of the
existing building, including reconfiguring and expanding the drive-through

from a single lane to a two lane facility. Drive through facilities in the General
Commercial zoning district require a conditional use permit. At its August 8
meeting, the Planning Commission held a public hearing on this application
and unanimously recommended approval of the conditional use permit with
the conditions outlined in the staff report.
5. The Council will consider a resolution ordering the preparation of an Assessment
Roll, declaring the amount to be assessed, and setting the date for a public hearing
for Alley and Driveway Construction Project No. 2011-7.
This year’s alley reconstruction project is complete and the assessment
hearing needs to be scheduled for September 20. Recommend approval.
6. The Council will consider a resolution requesting information from West Metro Fire
District.
According to a provision in the updated joint powers agreement for West
Metro, either city council can request information from the West Metro Board
through a formal query process. The Crystal Council has asked for some
information to better understand the proposed 2012 West Metro budget.
Recommend approval of the resolution.

The next City Council Meeting will be at 7:00 p.m. on Tuesday, September 6 in the
Council Chambers at City Hall.
