7. PUBLIC HEARINGS
7.1 The Mayor will open a public hearing to receive comment and consider a resolution
for proposed assessments for Phase 14 Driveway Construction and Sanitary
Sewer Repair Project. No. 2014-14.
As part of street reconstruction projects, residents have the option to have
driveways reconstructed and sanitary sewer services repaired. Now that the
majority of this work is complete, it is time to consider the assessments for
the work. Recommend approval of the resolution approving the
assessments for Phase 14 driveway construction and sanitary sewer repairs,
after hearing public comment.
7.2 The Mayor will open a public hearing to receive comment and consider a resolution
for proposed assessments for 2015 Alley and Driveway Construction and Sanitary
Sewer Repair Project No. 2015-07.
This year’s alley project is nearing completion and project costs are known
as well as proposed assessments. As part of alley reconstruction projects,
residents have the option to have driveways reconstructed and sanitary
sewer services repaired. Now that the majority of this work is complete, it is
time to consider the assessments for the work. Recommend approval of the
resolution approving the assessments for 2015 alley and driveway
construction and sanitary sewer repairs, after hearing public comment.
7.3 The Mayor will open a public hearing to receive comment and consider a resolution
adopting an Assessment Roll for Year 2015 delinquent accounts.
Once a year, the Council considers assessments for delinquent accounts
(outstanding utility bills, outstanding code enforcement matters, etc.) The
City Council should take public comment on the delinquent accounts.
Recommend approval of the resolution adopting the assessment roll for the
2015 delinquent accounts.
7.4 The Mayor will open a public hearing to receive comment regarding the draft 2016
proposed budget.
As discussed at the September 1 discussion of the preliminary 2016 levy, the
Council requested time for public comment on the proposed 2016 budget
prior to the December 1 hearing on the 2016 budget. Finance Director
Charles Hansen will provide an overview of the proposed 2016 general fund
budget. After receiving public comment, no action is necessary.
8. REGULAR AGENDA
8.1 The Council will consider approval of disbursements over $25,000 submitted by the
Finance Director to the City Council, a list that is on file in the office of the Finance
Director.
Recommend approval of disbursements over $25,000.

8.2 The Council will consider a commercial kennel license for Pet Supplies Plus at 345
Willow Bend.
A pet shop is proposed for the vacant storefront at Crystal Shopping Center
at 345 Willow Bend. Section 910.07 of the City Code requires a commercial
kennel license for pet shops boarding or grooming animals. Animal Control
Officer Tom Mahan has been working with the business owners, conducted
an inspection of the property and recommends approval of the commercial
kennel license.
8.3 The Council will consider a resolution for a conditional use permit for two drive-
through facilities and outdoor sales at 5717 West Broadway.
The owners of 5717 West Broadway are proposed to operate a hardware
store and thrift retail store in the existing building, currently vacant. Both
uses are permitted in the C-2 zoning district, within the building. The
property owner is proposing an outdoor sales area for the hardware store
and drive-through facilities for the thrift store. These uses require a
conditional use permit. The Planning Commission held a public hearing on
the conditional use permit application on October 12 and recommended
approval of the permit contingent on the conditions outlined in the staff
report. Recommend approval of the resolution.

a. The Crystal Business Association meets on Wednesday, October 21, at 8:30 a.m.
at Crystal City Hall.
b. The next City Council Meeting begins at 7:00 p.m. on Tuesday, November 3, in the

Pursuant to due call and notice thereof, the Regular Meeting of the Crystal City Council
was held on Tuesday, October 6, 2015 at 7:00 p.m. in the Council Chambers at 4141

WHEREAS, Minnesota Statute §465.03 requires that all gifts and donations of real or personal
property be accepted only with the adoption of a resolution; and
WHEREAS, said donations must be accepted by a resolution adopted by the City Council.

SUBJECT: Phase 14 Private Sanitary Sewer and Driveway Construction
Background
On September 16, 2015 the City Council declared the amount to be assessed as part of the
Phase 14 Street Reconstruction Project’s optional Private Sanitary Sewer and Driveway
Construction Project, ordered the preparation of the assessment rolls, and called for a public
hearing on the assessment for October 20, 2015.
The purpose of the public hearing is to give property owners an opportunity to express
concerns about the actual special assessment. At the Assessment Hearing the City Council shall
hear and consider all objections to the proposed assessment, whether presented orally or in
writing. This is a required step in Minnesota State Statutes for projects with assessments.
Once the public hearing is closed, City Council must, by resolution, adopt the same as the
special assessment against the lands named in the assessment roll. Again, this is part of the
Minnesota State Statute process for special assessments and allows for the project to move
forward with beginning the actual construction process. Once the assessment roll is adopted
the assessments are set and become liens against the properties listed.
Discussion
Of the 394 parcels in Phase 14, 80 participated in the driveway program and 86 in the sewer
repair program. Of these, 25 had both done. While every participant signed an agreement
showing the cost of the proposed work and waiving their right to appeal the assessment, it is
still required to go through the formal assessment process.

WHEREAS, Crystal residents in the Phase 14 Street Reconstruction Project area were given the
option to participate in a private driveway replacement program and/or a private sanitary sewer service
replacement program as part of the project; and
WHERAS; the cost for the optional private work is assessed to the benefitting property; and
WHEREAS, the Crystal City Council ordered the assessment hearing at the September 16, 2015
City Council meeting; and
WHEREAS, the Crystal City Council held the assessment hearing on October 20, 2015.

MINNESOTA:
The proposed assessment, a copy of which is on file in the office of the City Clerk, is hereby
accepted and shall constitute the special assessment against the lands named therein, and each
tract of land therein included is hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it. The total amount to be assessed is $521,667.49.
1. Such assessment shall be payable in equal principal installments extending over a period of
15 years, the first of the installments to be payable on or before the first Monday in January
2016, and shall bear interest at the rate of 4.5 percent per annum from the date of adoption of
this assessment resolution until December 31, 2030. To each subsequent installment when
due shall be added interest for one year on all unpaid installments.
2. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property, or make
partial payment as provided by City Code, with no interest accrued if the entire assessment is
paid or on that principal portion paid within 30 days from the adoption of this resolution (end
of business on November 25, 2015); and the owners may, at any time thereafter, pay to the
City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must be made prior
to November 15 or interest will be charged through December 31 of the next succeeding year.
3. The Clerk shall transmit a certified copy of this assessment to the County Auditor to be
extended on the property tax lists of the County. Such assessments shall be collected and
paid over in the same manner as other municipal taxes.

On October 20, 2015, the City of Crystal levied a special assessment (lien) against properties that participated in optional
driveway construction and sanitary sewer service repairs performed by the City and its contractors in conjunction with
local street reconstruction. A special assessment is a charge to the property owner for work performed by the City that
benefits the property.
Assessment Information
The City Council set a simple interest rate of 4.5% for a 15-year term for property owners desiring to have the assessment
added to their property tax statements.
Assessment payment options for property owners:
Pre-payment options:
1) Prepay the entire assessment without interest no later than 30 days after the levy date.
2) Prepay a portion of the assessment (minimum $100) without interest no later than 30 days after the levy date
3) Prepay the entire assessment until 4:30 p.m. on November 25, 2015, with interest charged from the levy date.
4) Prepay a portion (minimum $100) until 4:30 p.m. on November 25, 2015, with interest charged from the levy
date.
Payments after November 25, 2015:
Any portion of the assessment remaining after November 25, 2015 will be added to the property tax statement over a 15-
year period beginning in 2016 and ending in 2030. The first year will be charged 15 months of interest on the original
assessment (principal). After the first year, the amount added to your annual property tax statement will be computed by
adding 1/15th of the original assessment (principal), and interest computed at the set rate on the declining balance.
The assessment can be paid off at any time in a future year; however, the entire balance must be paid off prior to
November 15 in order to avoid interest charges for the entire following year.
Assessment deferment options:
If you are over the age of 65 or retired due to a total and permanent disability, if the affected property is your homestead,
and your income is below the to be determined 2016 levels, you may qualify to defer your assessment to some later date.
If an assessment is deferred, interest will accrue at the set rate for the term of the assessment or until the assessment is

Background
On September 16, 2015 the City Council declared the amount to be assessed as part of the
2015 Alley and Private Sanitary Sewer and Driveway Construction Project, ordered the
preparation of the assessment rolls, and called for a public hearing on the assessment for
October 20, 2015.
The purpose of the public hearing is to give property owners an opportunity to express
concerns about the actual special assessment. At the Assessment Hearing the City Council shall
hear and consider all objections to the proposed assessment, whether presented orally or in
writing. This is a required step in Minnesota State Statutes for projects with assessments.
Once the public hearing is closed, City Council must, by resolution, adopt the same as the
special assessment against the lands named in the assessment roll. Again, this is part of the
Minnesota State Statute process for special assessments and allows for the project to move
forward with beginning the actual construction process. Once the assessment roll is adopted
the assessments are set and become liens against the properties listed.
Discussion
The final cost for the 2015 Alley and Private Sanitary Sewer and Driveway Project is as follows:

The final cost represents a decrease of $51.01 from the $1,745 amount originally proposed in
the initial public notice. The 2014 project rate was $1,619.29. The project is assessed to
property owners abutting the affected alleys.
Of the 54 parcels, 13 participated in the private driveway program and 4 participated in both
the private driveway and sanitary sewer service repair programs. The value of the private work
totaled $49,364.90. While every participant signed an agreement which included the estimated
cost of the proposed driveway and sanitary work and waiving their right to appeal the
assessment, it is still necessary to provide the hearing.

to allow outdoor sales and drive-through facilities for the property
located at 5717 West Broadway Avenue
A. BACKGROUND
Drew and Terri Kabanuk own the property at 5717 West Broadway, and are proposing to
operate a hardware store and a thrift retail store in the existing building, formerly known
as the Thriftway grocery store. The property is zoned General Commercial (C-2).
The existing building is located on a 2.9 acre property, and is currently vacant. The
proposed hardware store would be located on the north side of the building and the
thrift store located on the south side of the building. These uses are permitted in the C-
2 zoning district without Planning Commission or City Council review and approval.
However, the applicant is proposing an outdoor sales area for the hardware store and
drive-through facilities for the thrift store. These two uses require the approval of a
conditional use permit (CUP). Notice of the October 12 public hearing was published in
the Sun Post on October 1 and mailed to owners within 350 feet. No comments have
been received to date.

B. PROPOSED CONDITIONAL USES
1. Outdoor sales – The applicant is proposing to have year-round outdoor
sales at the hardware store, which will be used for the sale of lawn and
garden supplies such as rock, sand, dirt, plants, and some building
materials. City Code Section 515.49, Subd. 4(f) provides requirements for
outdoor sales areas as a conditional use in the C-2 zoning district. The
following are those requirements, followed by staff’s response.
1) The area is hard surfaced and clearly designated on the site as
being limited to the specific, approved area.
Response: The area is currently hard-surfaced. Staff
recommends that the area be screened, which will limit the
outdoor sales to a specific area.
2) The service, sale, display, or rental area does not exceed 30% of
the gross floor area of the principal use, 20% of the area of the
property, or 2,000 square feet.
Response: The applicant has proposed a 7,600 SF outdoor
sales area on the north side of the building. However, the
maximum allowable size is 2,000 SF because, in accordance
with 515.01 Subd. 7b, the most restrictive limit prevails. This
is calculated as follows:
Gross floor area of the building is 52,000 SF x 30% =
15,600 SF
Area of the property is 124,527 SF x 20% = 24,905 SF
Since the first two calculations exceed 2,000 SF, the maximum
size of the outdoor sales area is 2,000 SF. A condition of
approval of the CUP is that the outdoor sales area be limited to
2,000 SF so as to not violate City Code . However, the
proposed resolution contains language that adjusts the
maximum size for the outdoor sales area for this CUP in the
event that the maximum size is increased as part of the
upcoming review of City Code Chapter 5 which includes the
zoning ordinance.
3) The items to be stored outdoors are typically found outdoors and
are constructed of materials appropriate for outdoor weather
conditions.
Response: The items proposed for outdoor sale will be items
typically sold at a hardware store and normally kept outdoors.

4) The city council finds that there will be adequate screening and
buffering between the establishment and adjacent uses.
Response: A condition of approval is that the outdoor sales
area be screened by a 6-foot high fence constructed of staff-
approved opaque material or a chain link fence with slats for
screening, unless the City Council finds that such screening is
unnecessary.
5) The city council determines that all applicable requirements of
subsection 515.05, subdivision 3 a) and section 520 are consider ed
and satisfactorily met. Section 515.05: 1) Consistency of the
proposed use with the comprehensive plan; 2) Characteristics of
the subject property as they relate to the proposed use; and 3)
impact of the proposed use on the surrounding area. Section 520
are the requirements for a site plan.
Response: 1) The 2030 Comprehensive Plan land use
designation for this property is “General Commercial”, which
is described as “retail, offices, restaurants, and some
automobile-oriented businesses”. The proposed outdoor
sales is consistent with this designation; 2) The property and
existing building are designed for a commercial retail use, and
the proposed outdoor sales is consistent with that design; 3)
The property has been used for commercial retail for many
years, and the proposed outdoor sales is consistent with the
character of the property.
The applicant is not proposing any building or parking lot
additions that require extensive site plan review. The only
changes to the property are the addition of the outdoor sales
area, and the conversion of areas of the building to allow
donation drop-offs and food sales within the thrift retail store.
2. Drive-through facilities. The site plan shows drive-through facilities for the
thrift store in the following locations:
Donation drop-off locations on the east and west sides of the
building. Previously on the east side, this area was used for
patrons to pick up their groceries. A new sliding door will be
added to this east side for smaller donations. Previously on the
west side, this area was a loading dock area. This west side
area will function as a drop-off area for larger donations.
Drive-up window to allow food pick-ups from the deli restaurant
proposed to be located within the thrift store. The applicant is
also proposing to add a menu board, located at the entrance of
the drive-through, with a speaker system for order taking.

City Code Section 515.49, Subd. 4(k) provides requirements for drive-
through facilities as a conditional use in the C-2 zoning district. The
following are those requirements, followed by staff’s response.
1) The establishment is served by arterial, collector or municipal state
aid streets and such pedestrian facilities as are necessary to
accommodate the traffic generated by the facility. The City Council
may require the applicant to provide a traffic study prepared by a
professional engineer for the proposed use, and may base its
findings of fact on said study or other information related to
potential traffic impacts on the street system and adjacent land
uses.
Response: According to the City’s Comprehensive Plan, this
portion of West Broadway Avenue is a collector street. The
site is served by entrances and exits on both West Broadway
and Kentucky Avenue, which will provide adequate traffic
access for patrons of this property. In addition, the City’s
Public Works Director and the West Metro Fire Rescue District
have reviewed this proposal and found it adequate to meet
vehicle movement within the site, including fire trucks.
2) The facility can meet the required separation distance and hours of
operation limitations. For the purposes of this section, “facility”
means any part of the lot where the city council determines that it is
likely that vehicles will be driven, stopped, or parked as part of the
operations of the drive-thru establishment.
i) No such facility shall be located less than 50 feet from any
property zoned R-1, R-2 or R-3.
Response: There is no property zoned R-1, R-2, or R-3
less than 50 feet from this property.
ii) If the facility is located at least 50 but less than 100 feet from
property zoned R-1, R-2 or R-3, then it may not be open
before 6:00 a.m. or after 9:00 p.m.
Response: The donation drop-off location on the west
side of the building is located more than 50 feet, but
less than 100 feet from property zoned R-3 across
Kentucky Avenue North. This means that this drop-off
location cannot be open before 6 am or after 9 pm.
iii) If the facility is located at least 100 but less than 250 feet
from property zoned R-1, R-2 or R-3, then it may not be
open before 5:00 a.m. or after 11:00 p.m.

Response: The drive-through window on the south side
of the building and the donation drop-off located on the
east side of the building would be at least 100 feet, but
less than 250 feet from the nearest residential property.
This means that the deli window and east side donation
drop-off location cannot be open before 5 am or after 11
pm.
iv) If the facility is located at least 250 feet from property zoned
R-1, R-2 or R-3, then no hours of operations restriction is
specified by this Code.
Response: Property zoned R-1 and R-3 is located less
than 250 feet from 5717 West Broadway.
3) The city council finds that there will be adequate screening a nd
buffering between the establishment and adjacent uses.
Response: For the east side donation drop-off location, this
area is located approximately 250 feet from residentially zoned
property. In addition, this east side area was formerly used for
a similar purpose by the previous grocery store. For the west
side donation drop-off location, this area is located at least
100 feet from residentially zoned property. In addition, this
west side area was formerly used as a loading dock by the
previous grocery store. The south side drive-up window will
face a commercial use. Given the distance to residential uses
and hours of operation limitations, there is no need for
screening and buffering for these drive-through facilities.
4) The city council determines that all applicable requirements of
subsection 515.05, subdivision 3 a) and section 520 are considered
and satisfactorily met. Section 515.05: 1) Consistency of the
proposed use with the comprehensive plan; 2) Characteristics of
the subject property as they relate to the proposed use; and 3)
impact of the proposed use on the surrounding area. Section 520
are the requirements for a site plan.
Response: 1) The 2030 Comprehensive Plan land use
designation for this property is “General Commercial”, which
is described as “retail, offices, restaurants, and some
automobile-oriented businesses”. The proposed drive-
through facilities are consistent with this designation; 2) The
property and existing building are designed for a commercial
retail use, and the proposed drive-through facilities are
consistent with that design; 3) The property has been used for

commercial retail for many years, and the proposed drive-
through facilities are consistent with the character of the
property. Moreover, the drive-through facilities will either face
another commercial area, or be located at a great distance
from residential areas.
The applicant is not proposing any building or parking lot
additions that require extensive site plan review. The only
changes to the property are the addition of the outdoor sales
area, and the conversion of areas of the building to allow
donation drop-offs and food sales within the thrift retail store.
C. NOTABLE SITE PLAN ELEMENTS
1. Parking. The existing building was constructed in 1970. Since that
time the City has approved four variances to reduce the number of
required parking spaces. The last variance, in 1980, was to reduce the
number of required spaces to 143. The applicant has indicated on
their site plan that there are 146 parking spaces on the property,
including six handicapped parking spaces as required by the State
Building Code.
After the Planning Commission meeting on October 12, 2015, the
applicant provided more detailed information relating to the proposed
specific uses within the building. Approximately 12,000 square feet of
the building’s gross floor area will be storage not retail or office uses.
With this more detailed information, staff is able to determine that the
minimum required number of parking spaces is 128 instead of 143.
With 146 existing spaces, the applicant can remove up to 18 parking
spaces in order to accommodate the outdoor sales area. Condition
Number 2, below, previously recommended by the Planning
Commission has been revised to reflect this new minimum parking
space requirement.
The parking lot’s pavement has not been adequately maintained and
will revert to a gravel surface if not restored (patch & seal coat) or
replaced (mill and overlay), depending on current conditions. Because
hard surfacing is required for the proposed uses, applicant will need to
work with the City Engineer to determine the necessary repairs and a
timeline for completion that prevents further deterioration of the
parking lot and maintains it in serviceable condition.
2. Exterior lighting. The applicant is not proposing to add any additional
exterior lighting to the building or the property.
3. Screening. Staff is recommending that the proposed outdoor sales
area be screened by a 6-foot high fence composed of staff-approved

opaque material or a chain link fence with slats for screening. In
addition, according to City Code Section 520.17 (e), the City may
require trash and recycling facilities to be screened. Currently, the
dumpsters located on the west side of the building are not screened.
Staff recommends these be screened as a condition of approval of the
CUP.
4. Landscaping. The applicant is proposing to add shrubs to the median
leading to the proposed east side donation drop-off area, as well as
adding shrubs and flowers to the area near the existing freestanding
sign.
5. Signs. There is an existing unused freestanding sign in the southeast
area of the property that will be used for the future retail stores. The
applicant is also proposing to install a menu board sign near the
entrance of the food pick-up window. The applicant will be required to
obtain sign permits before installing any signage on the property.
D. REQUESTED ACTION
At the October 12, 2015 Planning Commission, the Commission recommended
approval to the City Council of the CUP to allow outdoor sales and drive-through
facilities at 5717 West Broadway Avenue by a vote of 7 to 0 (with two
Commission members absent), subject to the following conditions of approval,
except as noted below by “*” which indicates changes recommended by staff
since the Planning Commission hearing:
1. The applicant shall work with the City Engineer to determine the
necessary repairs and a timeline for completion that prevents further
deterioration of the parking and maintains it in serviceable condition.
The parking lot shall also be restriped according to the parking space
and drive aisle dimensional requirements in City Code and in
accordance with the revised site plan submitted as part of condition
#2.
2. The outdoor sales area:
Shall be for the hardware store only;
Shall be limited to 2,000 SF in size or whatever maximum size
is applicable if an ordinance amendment is adopted after this
CUP is approved*;
Shall not lessen the number of parking spaces on the property
to below 143 128* spaces. Prior to a Certificate of Occupancy
being issued for the proposed uses, the applicant shall submit a
revised site plan showing a maximum outdoor sales area of
2,000 SF and no less than 143 128* Zoning Code compliant off-
street parking spaces for the property; and

Shall be screened by a 6-foot high fence constructed of staff-
approved opaque material or a chain link fence with slats for
screening.
3. The drive-through facilities are subject to the following hours of
operation:
The drive-through deli on the south side of the building shall not
be open before 5:00 a.m. or after 11:00 p.m.
The donation drive-thru on the east (West Broadway) side of
the building shall not be open 5:00 a.m. or after 11:00 p.m.
The donation drive-thru on the west (Kentucky) side of the
building shall not be open before 6:00 a.m. or after 9:00 p.m.
4. Trash and recycling containers on the property shall be screened by
enclosures constructed of materials compatible to the building.
5. Shrubs and flowers shall be added to the property as shown on the
site plan.
6. No signs shall be installed on the property prior to the approval of a
sign permit.
City Council consideration of the proposed resolution (Attachment G) is requested.

RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR
THE PROPERTY LOCATED AT 5717 WEST BROADWAY AVENUE
WHEREAS, Drew Kabanuk and Terri Kabanuk (“Applicants”) submitted an application
to the City of Crystal (“City”) for a conditional use permit to allow outside sales and drive-
through facilities at 5717 West Broadway Avenue in Crystal, which is legally described in
Exhibit A (“Property”); and
WHEREAS, the Planning Commission held a public hearing regarding the Applicants’
request on October 12, 2015 and voted to forward the application to the City Council with a
recommendation that the requested conditional use permit be approved with certain conditions;
and
WHEREAS, the City Planner’s report dated October 16, 2015 regarding this matter,
which is attached hereto as Exhibit B, is incorporated herein and made part of this conditional
use permit, except that the conditions set out below are controlling; and
WHEREAS, the City Council finds that the conditional use permit as recommended by
the Planning Commission would be in compliance with the applicable rules and regulations of
the Crystal City Code.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Crystal,
based on the record of this matter and the findings and determinations contained herein, hereby
approves and issues a conditional use permit to allow outside sales and drive-through facilities at
the Property subject to compliance with all of the following conditions of approval:
1. Required Repairs. The Applicants shall work with the City Engineer to determine the
necessary repairs, and a timeline for completion, to prevent further deterioration of the
parking lot and outdoor sales area to maintain it in serviceable condition. The Applicants
shall make the identified repairs within the established timeline. The Applicants shall also
restripe the parking lot in accordance with the parking space and drive aisle dimensional
requirements in City Code and the revised site plan submitted as part of condition #2.
2. Outdoor Sales Area. The outdoor sales area and its use shall comply with all of the
following:
(a) Shall be for the hardware store only;

(b) Shall be limited to 2,000 SF in size, however if the City Code is amended subsequent to
the adoption of this resolution to allow a larger outdoor sales area, the property owner
shall be allowed to enlarge the existing outdoor sales area up to the new maximum;
(c) Shall not lessen the number of parking spaces on the property to below 128 spaces.
Prior to a Certificate of Occupancy being issued for the proposed uses, the Applicants
shall submit a revised site plan showing a maximum outdoor sales area of 2,000 SF and
no less than 128 Zoning Code compliant off-street parking spaces for the property; and
(d) Shall be screened by a 6-foot high fence constructed of staff-approved opaque material
or a chain link fence with slats for screening.
3. Hours of Operation. The drive-through facilities are subject to the following hours of
operation:
(a) The drive-through deli on the south side of the building shall not be open before 5:00 a.m.
or after 11:00 p.m.;
(b) The donation drive-thru on the east (West Broadway) side of the building shall not be
open 5:00 a.m. or after 11:00 p.m.; and
(c) The donation drive-thru on the west (Kentucky) side of the building shall not be open
before 6:00 a.m. or after 9:00 p.m.
4. Trash Containers. Trash and recycling containers on the Property shall be screened by
enclosures constructed of materials compatible to the building.
5. Landscaping. Shrubs and flowers shall be added to the Property as shown on the site plan.
6. Signs. No signs shall be installed on the Property prior to the approval of a sign permit.
7. Compliance. This conditional use permit is subject to the applicable requirements of the City
Code, the Applicants are required to comply with all applicable federal, state, and local laws,
rules, regulations, and ordinances, and are required to obtain such other permits and
permissions as may be required.
8. No Waiver. Failure by the City to take action with respect to any violation of any condition,
covenant or term of this conditional use permit shall not be deemed to be a waiver of such
condition, covenant, or term or any subsequent violation of the same or any other condition,
covenant, or term.
9. Revocation. The violation of any terms or conditions of this conditional use permit
including, but not limited to, any applicable federal, state, or local laws, rules, regulations,
and ordinances, may result in revocation of the conditional use permit. The Applicants shall
be given written notice of any violation and reasonable time, as determined by the City, to
cure the violation before a revocation of the permit will occur.
10. Binding Effect. This conditional use permit, and the conditions placed on it, are binding on
the Applicants, their successors and assigns, shall run with the Property, and shall not in any

way be affected by the subsequent sale, lease, or other change from current ownership, until
the conditional use permit is terminated or revoked as provided herein. The obligations of
the Applicants under this conditional use permit shall also be the obligations of the current
and any subsequent owners of the Property.
11. Acceptance of Conditions. Utilization of the Property for any of the uses allowed by this
conditional use permit shall automatically be deemed acceptance of, and agreement to, the
terms and conditions of this conditional use permit without qualification, reservation, or
exception.
