Crystal City Council Meeting Preliminary Agenda June 21, 2011 7:00 P.M. Council Chambers I. CALL TO ORDER, ROLL CALL, AND PLEDGE OF ALLEGIANCE II. PRESENTATION The Council will receive a $1,400 Community Partnership Grant from Center Point Energy to the Crystal Police Department for a portable radio. III. ACKNOWLEDGMENT(S) The Mayor will acknowledge the following donations: $500 from the Rotary Club to the Crystal Police Department for D.A.R.E Programs; $1,000 from 2MK Sports Marketing LLC to the Crystal Recreation Department. IV. COUNCIL MEETING MINUTES The Council will consider the minutes from the following meetings, in a single motion: a. The Regular City Council Meeting from June 7, 2011; and b. Two Council Work Sessions from June 7, 2011. V. CONSENT AGENDA The Council will consider the following items, which are routine and non-controversial in nature, in a single motion: 1. Approval of the list of license applications submitted by the City Clerk to the City Council, a list that is on file in the office of the City Clerk; 2. Approval of disbursements over $25,000 submitted by the Finance Director to the City Council, a list that is on file in the office of the Finance Director; 3. Approval of authorizing $1,000 from the City Initiatives Fund for mediation services; 4. Adoption of a resolution approving the execution of a contract for Hennepin County Assessing Services for the City of Crystal; 5. Approval of a special permit for wine and beer for a birthday party at Welcome Park on Saturday, June 18, 2011 submitted by Michael Mlaskoch; 6. Approval of temporary on-sale liquor licenses at Becker Park and Welcome Park for the Crystal Frolics on July 28-31, 2011, submitted by the Crystal Lions Club; 7. Approval of a 3.2 malt liquor, on-sale license at Welcome Park for the Crystal Frolics on July 29-31, 2011, submitted by the Crystal Lions Club; and 8. Adoption of a resolution approving an application to conduct Off-Site Gambling at Becker Park from July 28 – 31, 2011 during the Crystal Frolics, submitted by the Crystal Lions Club. Mayor Bowman will open a public hearing to receive public comment and Council consideration of new liquor licenses for property located at 5632 West Broadway submitted by Kneadin’ Dough Inc. d/b/a Broadway Bar & Pizza. The background investigation has been completed and the application has been reviewed. There is no basis to deny the liquor licenses for Broadway Bar & Pizza. Recommend approval. VII. OPEN FORUM (Open forum is a time for individuals in the audience to address the Council on subjects not on the regular Council agenda. Individuals are asked to step up to the podium and speak clearly into the microphone. You are allowed 3 minutes to make your comments. The Council will not take action on items discussed during open forum; however, the Council may add the item to a future meeting agenda and ask city staff for follow-up.) VIII. REGULAR AGENDA 1. The Council will consider a variance from limitations on hours of operation in the C- 1 Neighborhood Commercial district at 3537 Douglas Drive North. A potential tenant of the multi-tenant building at 36th and Douglas is proposing a dance and fitness center which is a permitted use in the neighborhood commercial zoning district. However, the use is proposed to open at 5 a.m. and the zoning allows such businesses in this district to operate from 6 a.m. to 9 p.m. The applicant is requesting a variance to this provision. The Planning Commission held a public hearing on the application on June 13 and recommended denial of the application because the applicant can’t meet Criteria #2 for variances (the plight of the landowner is due to circumstances unique to the property not created by the property owner). The Planning Commission also recommended the Council direct staff to prepare an amendment to the Zoning Ordinance which would provide greater flexibility in setting hours of operations limitations in the Neighborhood Commercial zoning district. Finally, the Planning Commission recommended enforcement of the 6 a.m. start time at this location be suspended until the ordinance amendment is considered by the Council. 2. The Council will consider the division of 4044 Hampshire Avenue North to detach the rear 173 feet and add it to the adjacent park. The EDA acquired this property earlier this year. The rear 173 feet of the lot is proposed to be split off to become part of Hagemeister Pond Preserve and the balance of the lot and house will be resold. At its June 13 meeting, the Planning Commission recommended approval of the proposed lot division for this property. Crystal City Council Meeting Agenda June 21, 2011 Page 3 of 4 VIII. REGULAR AGENDA CONTINUED 3. The Council will consider a resolution providing for the issuance and sale of approximately $1,705,000 General Obligation Improvement Bonds, Series 2011A. The city sells bonds to fund a portion of each street reconstruction project. Recommend approval of the resolution authorizing the issuance and sale of bonds for Phase 11, this year’s project. 4. The Council will consider a resolution indicating Crystal’s intent to participate in the State Performance Measurement Program. In 2010, a local results and innovation committee was created by the Legislature. This committee developed a list of ten performance measures for cities. Cities can participate in this program on a voluntary basis. Participating cities must implement some way to track the measurements in 2012. Benefits to participating cities include a nominal reimbursement as well as exemption to any levy limits for calendar year 2012. Due to the uncertain status of levy limits, recommend approval of the resolution indicating Crystal’s participation in this program. 5. The Council will consider a resolution ordering a Feasibility Study for Forest North Phase 12 Street Reconstruction Project No. 2011-12. The Council will be discussing the status of the proposed 2012 Street Reconstruction project (Forest North area) at a work session before Tuesday’s regular meeting. In order to keep the project on schedule, recommend approval of ordering the feasibility study. 6. The Council will consider the 2011 Labor Agreement with Law Enforcement Labor Service (L.E.L.S.), Local 44 Police Officers. The proposed settlement with Local 44 for a cost of living adjustment and health insurance contribution is consistent with what was approved for Local 49 and non-represented employees. The unit did agree to a cap on the tuition reimbursement, but not the language we proposed. Recommend authorizing execution the agreement. 7. The Council will consider a resolution relating to lawful gambling; approving a new premises permit at Broadway Bar & Pizza located at 5632 West Broadway submitted by Armstrong Youth Hockey Association. The background investigation has been completed for the lawful gambling permit for Broadway Bar & Pizza. There are no reasons to prohibit issuance of the permit. Recommend approval. The City is NOT conducting a fireworks display for the Fourth of July Holiday. c.
