engage in an attorney-client privileged discussion with the city’s attorneys regarding the
Watt litigation*

3. Parks & Recreation Commission review of annual work plan

SUBJECT: Administrative Penalties – Alcohol and Tobacco Violations
City ordinances and state laws regulate establishments that sell alcohol and tobacco.
When a business is granted a license, the licensee has a responsibility to ensure
compliance with existing ordinances and laws.
In the event a business is found to have engaged in an illegal sale or committed a
violation of state law, City Code Sections 1137.11 and 1200.35 provide for civil
penalties to be imposed on tobacco and liquor licensees, respectively.
The City Council historically has taken violations of alcohol and tobacco regulations
very seriously, requested owners to appear before the Council to address the
allegations, and imposed consequences. Violations do not appear before the Council
until after the criminal process, and a business is found guilty.
Early last year, the Council reviewed the civil penalties and modified them so the
penalties for both alcohol and tobacco were more consistent with the other in terms of
severity. Tobacco and liquor licensees are subject to graduated penalties of increasing
severity for multiple violations.
Attached is a current schedule of penalties the Council may impose on licensees for
violation of alcohol and tobacco regulations.
The City Council will review the penalties and process for considering penalties at its
March 12 work session. The Council will be considering several license violations at its
March 17 meeting.
